Sorry, I didn't send you anything earlier because you were going out of town. The changes are: 1) The USR boundary should only be around Lot 12. It should be shown in a darker/bolder line to distinguish from the other lots. 2) The topographic lines should be in a light font (grayscale). 3) The legal description should read "Lot 12"— because this is a special use permit on Lot 12 only Lot 12 should be indicated on the legal description. 4) A USR does not technically require a survey, therefore the Title Policy Schedule B Exceptions should not be shown on the plat. 5) Because other structures/buildings shown on the plat are not within the boundaries of the USR—they should either be removed or be shown in a lighter font(grayscale). 6) The names of the signatories on the plat should be printed below the signature block. The Clerk and Recorders Office is picky about this. I will go ahead and call/e-mail the surveyor as well. An amended Use by Special Review Permit will not be required. The training facility will be required to adhere to the A (Agricultural) Zone District standard of four (4) horses per acre. It is my understanding that the applicants intend to own four (4) lots within the Carlson Subdivision which would allow a total of seventy-six (76) horses to be trained on site provided that the facility generates no more than 60 trips per day to and from the facility per Section 23-3-40.Q of the Weld County Code. One parcel is occupied by a residence(approximately 2,000 sq-ft)a garage/shop and sheds.Two parcels have no permanent structures on thcm. On the 4th parcel a high-quality steel structure was erected in 2002 to be used as a horse facility. Property Use Plan We envision using the entire 20 acre site for this operation.However,the majority of the activity will take place on the SE parcel;the site of the existing structure.The operation will entail boarding animals for training purposes as opposed to general boarding common to most facilities of this type.Therefore,the general level of activity on the property and travel on and off the property will be somewhat reduced.The majority of the animals arc owned by non- local residents whose interest is in the development of their animal not in regular visits or riding the animal. These guidelines apply to residential and commercial structures, schools, and churches, and were not meant to be used for ancillary buildings, such as barns, sheds, or gazebos, where structural integrity and cosmetic damage are less of a concern. The standard for ancillary buildings applies for other geologic hazards, such as rockfall and debris flow hazards. Therefore, a subsidence investigation for placement of a barn over an abandoned mine would not be required. Please call me if there are any questions. Yours truly, �/ iCelia Green Geologist Weld County Department of Planning Services January 4, 2002 Attention: Chris Gathman Re: USR-1348 Geological Hazard Overlay District Development Permit Chris, Per our conversation, I am requesting an exempt status for the Geological Hazard permit for the horse barn project for the USR-1348. The Engineered foundation currently proposed will make a safe secure facility. The data and the reports supplied have the information to support our position. I have received from the State, maps indicating that the area under our proposed structure has been mined. The Clayton Coal mine covers many miles in our area including under our home and pond. Our home was built in 1972 with no engineered foundation and at present no evidence of subsidence damage. In reference to the letter from Celia Greenman of the Colorado State Geological Survey dated February 12, 2001 regarding Subsidence Investigation Requirements, I have spoken to Mrs. Greenman and she indicated that the investigation requirements were for houses. And not necessarily all houses depending on the mine depth. Clayton mine shaft and depth information has been well documented. The mine depth is 200 plus feet in the proposed construction area. Mrs. Greenman indicated on 1/4/02 that she would contact you regarding this matter. Lastly, we are building with a U occupancy classification of the Uniform Building Code. The U occupancy and the exemptions stated on page 4 of the Weld County Geologic Hazard Overlay District Application should give us our requested exemption. It is not our intent to cut corners or make an unsafe structure. We have done our home- work and consulted the proper geological, soils and foundation experts.
