RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST RUSTIN PETERSON, JIM GOODEN, AND ROBERTA
PIRAMI FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rustin Peterson, Jim Gooden, and Roberta Pirami, VI #9600298, are
allegedly in violation of the Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of February, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Jim Gooden, tenant, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of
said violation to the Weld County Attorney's Office initially for a period of thirty (30) days to
allow adequate time for the property owner, Rustin Peterson, to submit the appropriate permit
application and,
WHEREAS, the Board deems it advisable after receipt of said application, to delay
referral of said violation for an additional sixty (60) days to complete the permit process and
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into
compliance within the timeframe stated above.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that if Rustin Peterson, property owner, does not submit the
appropriate permit application by March 13, 1997, the Weld County Attorney be, and hereby is,
authorized to proceed with legal action against Rustin Peterson, Jim Gooden, and Roberta
Pirami to remedy the violation of the Weld County Zoning Ordinance, and any other persons
occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

BE IT FURTHER RESOLVED that if said violation still exists sixty (60) days after receipt
of said permit application, the Weld County Attorney be, and hereby is, authorized to proceed
with legal action against Rustin Peterson, Jim Gooden, and Roberta Pirami to remedy the
violation of the Weld County Zoning Ordinance, and any other persons occupying the
properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of February, A.D., 1997.

The shed is still being used as a residence on the property without the appropriate permits and
without appropriate septic system and water. These are violations of Sections 31.2.1, 31.3 and 43
of the Weld County Zoning Ordinance, Sections 30, 30.2.1, 30.5.2.1, 40 and Section and
Subsections of 20.13 of the Weld County Building Code Ordinance, and Sections 3.1 and 3.24 of
the Weld County Individual Sewage Disposal System Regulations. To bring the property into
compliance the shed must not be used as a residence or all appropriate permits must be obtained
and the structure must be brought up to current Building Code Standards as a residence.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

En reference to a recent telephone conversation with my account(Claire l3ogdanski) I
understand there are zoning and compliance issues with the above property. My intent is
not to put anybody out, but I will do what is necessary to comply with your zoning/safety
requests.
Due to violations on the property. I request there to be only one residence on the property.
I grant permission for that one residence. In additional, I will board up and disconnect the
second structure known as "the shit house".

The purpose of this discussion was to decide at what point Ordinance 191
should apply to development in the Del Camino area. The board decided the
ordinance standards will apply to projects in all stages of development, no
matter when the projects were introduced. If a project cannot meet the
standards because of a conflict with changes in zone, zone changes will take
precedence. Each final plan will be reviewed and staff will work with the
developers . Developers are to be reminded of the reason the board adopted
these standards . Many complaints were received over the way the area was
being developed.

On Deceiber 2, 1996 the property at 7352 W.C.R. I1 was inspected by Will Birchfield,building '
inspector, Julie Chester, zoning compliance officer and myself. Several non-compliance issues
where ob rved by each of us. My concern was that Mr.Gooden,the tenant,had attached a camp •
trailer tote shed and he and his fiance were living iq it with seven (7) children. The trailer has
bathroom ilities and Mr. Gooden has dug a hole back behind the trailer for the sewage to flow to.

1an adequate sewage disposal system. On the day of the inspection, Mr.
G000den ' formed me that he had tried to install a sentic system but was informed by the person
who was oing the backhoe work that because of the high ground water he would need an
cngineere system. I informed Mr. Gooden that if tat were the case we would try to get the
Housing Authority to possibly get involved. At present I am drafting a letter to the owner of the
property reforming them of the need to take out a repair permit so an adequate sewage disposal
system car be installed at the property. •

This letter is to inform that the conversion of the shed to a single family residence is a violation
of the Weld County Zoning and Building Code Ordinances. There are three separate problems
associated with the violations:
A. The first problem is a violation of the Building Code Ordinance and is of immediate
importance to insure the health and safety-of the inhabitants.
1. Section 92.3.3 - Hazardous and Defective Equipment
A. The wood burning stove, vent connector and chimney shall be installed
according to the manufacturer's installation instructions or the Uniform
Mechanical Code as an unlisted appliance or removed from the structure.
B. The wall furnace shall be installed according to the manufacturer's installation
instructions, inspected by a factory representative and certified by such
representative that the furnace is operating as originally approved. As an
alternative to these requirements, the furnace could be replaced.
C. All electrical outlet covers shall be installed and all "zip" cords being
used to provide electrical current to any lighting or outlets shall be removed.
These requirements must be resolved by December 9, 1996 and an inspection of these
items and equipment will be scheduled for that day. If, at the time of the inspection, the
above hazardous equipment is found not to be in compliance with the above
requirements and the appropriate regulations, the Department will proceed to disconnect
the building utilities and electrical service.

B. The second problem is also a violation of the Building Code Ordinance. Specifically
Sections 30, 30.2.1, 30.5.2.1, and 40 where a building permit is required for the change of
occupancy from a shed to a residence, the addition of the travel trailer, and the installation of
mechanical equipment. In addition the facility is in violation of Section 20.13 and
subsections for substandard housing.
1. Section 20.13.2.1 - Improper water closet, lavatories, and bathtub or shower. This
Section requires that the residence be provided with a bathroom
constructed according to the Uniform Building Code.
2. Section 20.13.2.8 - Room and space dimensions are less than that required by
Chapter 5 of the Uniform Housing Code. The main room if used
for sleeping purposes must have a floor area of at least 200
square feet plus 100 square feet for every occupant over two.
3. Section 20.13.2.9 - Lack of connection to a required and approved sewage disposal
system.
4. Section 20.13.5 - Electrical wiring that was installed in violation of the code
requirements in effect at the time of the installation or electrical
wiring not installed in accordance with generally accn: te:d
construction practices or which has not been maintained in good
condition or which is not being used in a safe manner shall be
considered substandard. This building will be required to be
entirely rewired, including a new service, as a single family
residence.
5 Section 20.13.t ; - All Buildings or portions thereof occupied for living , sleeping,
cooking, or dining purposed which were not designed or intended
to be used for such occupancies shall be considered
substandard. This shed was not constructed or designed to be
used as a single family residence.
If you wish to bring this building into compliance as a single family residence, the
appropriate permits need to be acquired by December 15, 1996. The construction
and remodel to bring this building into compliance will need to be completed by
January 15, 1997.
C. The third problem is a violation of the following sections of the Zoning Ordinance.
1. Section 31.2.1 - Only one single family dwelling unit per legal lot is allowed by right.
2. Section 31.3 - A second residence is not allowed as an accessory use unless they
are primarily employed at or engaged in farming, ranching, or
gardening-subject to additional requirements of Section 43.
3. Section 43 - Mobile homes and Accessory dwelling units

The violations of the Zoning Ordinance need to be resolved by January 15, 1997. Please
contact a Current Planner for those options that are available to you.
It is the intention of this office to assist and cooperate with the residents of Weld County without
imposing undue hardship. Any information you have regarding this violation would be
appreciated. However if you fail to come into compliance by the specified dates we may
schedule a hearing before the Board of County Commissioners to consider whether the
violations should be referred to the County Attorney's office for legal action.
If you have any questions concerning these violations please call or write the Department of
Planning Services for clarification.
