HomeMy WebLinkAbout970283.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST RUSTIN PETERSON, JIM GOODEN, AND ROBERTA PIRAMI FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rustin Peterson, Jim Gooden, and Roberta Pirami, VI #9600298, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of February, 1997, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Jim Gooden, tenant, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to delay referral of said violation to the Weld County Attorney's Office initially for a period of thirty (30) days to allow adequate time for the property owner, Rustin Peterson, to submit the appropriate permit application and, WHEREAS, the Board deems it advisable after receipt of said application, to delay referral of said violation for an additional sixty (60) days to complete the permit process and bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff, and WHEREAS, the Board deems it advisable to proceed with legal action against the above named individuals without further Board action if the subject property is not brought into compliance within the timeframe stated above. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that if Rustin Peterson, property owner, does not submit the appropriate permit application by March 13, 1997, the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Rustin Peterson, Jim Gooden, and Roberta Pirami to remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. 970283 PL0824 PG; en; Gtodcn VIOLATIONS -VI #9600298 - PETERSON, GOODEN, AND PIRAMI PAGE 2 BE IT FURTHER RESOLVED that if said violation still exists sixty (60) days after receipt of said permit application, the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Rustin Peterson, Jim Gooden, and Roberta Pirami to remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. Peterson • cOMMISSIONERS WORK SESSION NOTES; Week of December 16, 1996 Barbara Kirkmeyer, George Baxter, Dale Hall , and Connie Harbert Bill Webster absent Staff : Vicky Sprague Northern Colorado Regional Project: December 16 Monica Daniels-Mika Monica advised the board that the Larimer County Commissioners do not intend to participate in the Northern Colorado Regional Project. Peterson Case: December 16 Monica Daniels-Mika, Bruce Barker, Lee Morrison, Ed Stoner, and Jim Sheehan Staff briefed the board on property at 7352 WCR 11 . Rustin Peterson owns the property. Occupants are Jim Gooden and Roberta Pirami, two elderly parents, and seven children. Staff has been working with the owner and tenants to correct building, zoning, and septic system violations. Imminent danger building code violations have been corrected, but there are still severe problems. They also need an engineer-designed septic system. The tenants are acting in good faith to correct the problems, but they have no money. The wood burning stove, vent connector and chimney shall be installed according to the manufacturer's installation instructions or the Uniform Mechanical Code as an unlisted appliance or removed from the structure. The wall furnace shall be installed according to the manufacturer's installation instructions, inspected by a factory representative and certified by such representative that the furnace is operating as originally approved. As an alternative to these requirements, the furnace could be replaced. C. All electrical outlet covers shall be installed and all "zip" cords being used to provide electrical current to any lighting or outlets shall be removed. These requirements must be resolved by December 9, 1996 and an inspection of these items and equipment will be scheduled for that day. If, at the time of the inspection, the above hazardous equipment is found not to be in compliance with the above requirements and the appropriate regulations, the Department will proceed to disconnect the building utilities and electrical service. In addition the facility is in violation of Section 20.13 and subsections for substandard housing. 1. Section 20.13.2.1 - Improper water closet, lavatories, and bathtub or shower. This Section requires that the residence be provided with a bathroom constructed according to the Uniform Building Code. 2. Section 20.13.2.8 - Room and space dimensions are less than that required by Chapter 5 of the Uniform Housing Code. The main room if used for sleeping purposes must have a floor area of at least 200 square feet plus 100 square feet for every occupant over two. 3. Section 20.13.2.9 - Lack of connection to a required and approved sewage disposal system. 4. Section 20.13.5 - Electrical wiring that was installed in violation of the code requirements in effect at the time of the installation or electrical wiring not installed in accordance with generally accn: te:d construction practices or which has not been maintained in good condition or which is not being used in a safe manner shall be considered substandard. This building will be required to be entirely rewired, including a new service, as a single family residence. 5 Section 20.13.t ; - All Buildings or portions thereof occupied for living , sleeping, cooking, or dining purposed which were not designed or intended to be used for such occupancies shall be considered substandard. This shed was not constructed or designed to be used as a single family residence. If you wish to bring this building into compliance as a single family residence, the appropriate permits need to be acquired by December 15, 1996. The construction and remodel to bring this building into compliance will need to be completed by January 15, 1997. C. The third problem is a violation of the following sections of the Zoning Ordinance. 1. Section 31.2.1 - Only one single family dwelling unit per legal lot is allowed by right. 2. Section 31.3 - A second residence is not allowed as an accessory use unless they are primarily employed at or engaged in farming, ranching, or gardening-subject to additional requirements of Section 43. 3.
