RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JUSTIN COLE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Justin Cole, ZCV#0900310, is allegedly in violation of the Weld County Code, and WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not been corrected, and WHEREAS, on the 12th day of January, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Justin Cole, property owner, was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 12, 2010, to allow adequate time for the property owner to remove, restore, or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, in order to bring the subject property into compliance, and for an inspection of the property by the Department of Planning Services staff. The first: (u 7335 WCR 23, there is a property with a house and 5-1 heavy-duty, over-the-road trucks parked on the property that cause this ! in my mind: "Is this place approved for operating and parking heavy duty trucks on this property (commonly known as a USR)''" The second: 1 don't have an address for this observation, but just south of 7335 W'CR 23, on the same side of 223 (which happens to he "west", as you can tell from the "odd" 4 address) is another property that is sort of on a rise(hill) and there are lots and lots and lots of heavy duty trucks on that property. I apologize for not getting the address of this place, but I was late for an appointment and did not get hack there for the address.
