Dear Ken,
The Weld County Code has the following provisions re: construction of an approved Use by
Special Review Permit (see below) . The plat has been recorded, I have not heard re: when they
are proposing to start construction.
Sec. 23-2-290. Termination of use.
A. Construction or USE pursuant to approval of a Use by Special Review Permit shall be
commenced within three (3) years from the date of approval, unless otherwise specified by the
Board of County Commissioners when issuing the original Permit, or the Permit shall be
vacated. The Director of Planning Services may grant an extension of time, for good cause
shown, upon a written request by the landowner.

Chris,
What can you tell me about the referenced project. There has not been
any mobilization on the site to start tank construction, and I am
curious as to the plans and where Weld County is involved. Isn't there
a deadline (I am thinking 1 yr from the date of the permit) at which the
planning permit is not longer valid if construction has not started?
