RE: APPROVAL OF RECORDED EXEMPTION NO. 334 - HARLAN WARD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 30th day of August, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 334 , being the property of
Harlan Ward, described as the East Half of the Northeast Quarter
of Section 20 , Township 6 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :
All the Fast Half of the Northeast Quarter of Section
20, Township 6 North, Range 66 West of the 6th P.M. ,
County of Weld, State of Colorado, more particularly
described as follows:
Beginning at the Northeast corner of said Fast half
of the Northeast Quarter; thence along the North
line of said Northeast Quarter South 88°27'27"
West 1320.78 feet to a point on the West line of
said East half of the Northeast Quarter; thence
along said line South 00°38'00" Fast 2655.53 feet
to a point on the South line of said East half of
the Northeast Quarter; thence along said line
North 88°09'05" East 1328.13 feet to a point on
the Fast line of said Northeast Quarter; thence
along said line North 00°47'22" West 2648.33 feet
more or less to the POINT OF 11W INNING.
The above described parcel contains a yLuss acreage
of 80.62 Acres more or less.
The above described parcel is subject to a 30.00 foot
wide reservation for County Road along the easterly
side thereof. Also subject to a 30.00 foot wide
reservation for State Highway 302 along the Northerly
side thereof.

under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within

Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Harlan Ward, be and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30th day of
August, A.D. , 1978.

Dear Commissioners :
The attached application, plat and related materials are in
reference to a request by Harlan Ward for a recorded exemp-
tion. The property on which this request has been made is
described as EzNE4 Section 20, T6N, R66W of the 6th P.M. ,
Weld County, Colorado. This property is located 5 miles
east of the Town of Windsor. The property contains approx-
imately 80 acres of Class II and III irrigated soils. The
request is to split the property into parcels of 4. 27 acres
and 76. 35 acres.
Mr. Ward desires to sell the 4. 27 acre parcel which was , at
one time , a home site. The parcel is surrounded by large
cottonwood trees and has not been farmed in the past . If
this request is approved, Mr. Ward wishes to use the money
from the sale of the property to help pay for some land
leveling and a water recovery system proposed on the balance
of the property.
Based upon the information submitted and the adopted policies
in the County, the Department of Planning Services Staff
recommends the request be approved for the following reasons :
1 . The request is in compliance with the intent clause of
the recorded exemption procedure (Section 9-2 of the Weld
County Subdivision Regulations) in that non-productive
agricultural land (the old home site) will be developed
for higher uses. The proposed use would be compatible
with surrounding agricultural uses.

2. The request is in compliance with the intent clause of
the Agricultural Zone District (Section 3. 3 A. of the
Weld County Zoning Resolution) and the Weld County Com-
prehensive Plan in that the request will be encouraging
a related use to agricultural which is the predominant
land use.
3. The request complies with Section 9-4A. of the Weld
County Subdivision Regulations.
