MEMORANDUM 1• TO: Chris Gathman, Planning Services CFROM: Lauren Light, Environmental Health SUBJECT: USR-1735 Bruce and Susan MacMillian COLORADO DATE: 4/19/2010 Environmental Health Services has reviewed this proposal for an artisans studio (custom metal work) in an existing barn. There are no employees; however clients may come to the studio from 1 to 3 times a month. Little Thompson Water District provides water to the site and an individual sewage disposal system (ISDS) provides sewer. Customers must have access to sanitary facilities. The restroom in the home may be utilized, however that may require adhering to building department requirements as well as upgrading the existing septic system. The other option is to install a restroom in the barn which connects to a new ISDS. • The existing septic system is permitted under permit number SE-0700015 (Statement of Existing) and was evaluated for adequate size and capacity on April 10, 2007. The results of that evaluation found that the septic tanks are of sufficient size and capacity to handle the flow for the four-bedroom home but not enough information was available to determine if the field sizes are adequate. There are two septic systems; one serves the basement and the other serves the rest of the home. There were no visible signs of ISDS failure when the inspection was completed. Septic Policy 2.2.D.3 was adopted December 7`h 2009 and requires evaluation of any septic system that is changing from residential to commercial use. As the field size is unknown the applicant is required to provide an accurate drawing, which depicts sizing, of the septic system to this Department. If the absorption field is undersized by more than 20 percent, this Department requires that the absorption field be brought into compliance with current ISDS Regulations. As there will be a maximum of three vehicles per month associated with the business, a dust abatement plan is not required for on site dust control. A waste handling plan is required to ensure the business items are disposed of in an appropriate manner. EXHIBIT 27 2010-1077 • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed of (including the facility name, address, and phone number). 2. If the applicant intends to utilize the existing septic systems at the home for customer usage of 1 to 3 people a month, an accurate drawing, which depicts sizing and location, of the septic systems shall be provided to this Department. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. If the • absorption field is undersized by more than 20 percent, the absorption field shall be brought into compliance with current ISDS Regulations. 3. Alternately to item #2 above, the applicant shall install an individual sewage disposal system for customer use and the system shall be installed according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. • 2 • 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, handwashing and toilet facilities shall be provided for customers of the facility, at all times. 8. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing public water supply. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: Weld County Road Classification Plan (FHU): WCR 17 is a major arterial road, which requires a 140- foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Our most recent AADT count reflects 1624 vehicles per day taken in April 2009; the 85th percentile reflects speed limits at 65 mph. Trucks account for 8% of the traffic at this location. • Site Plan: The applicant shall utilize the existing access to this parcel. Parking areas and the access drive shall be surfaced with gravel, recycled asphalt or the equivalent and shall be graded to prevent drainage problems. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.
