RESOLUTION RE: ACTION OF THE BOARD CONCERNING VI #0500004 AGAINST BRUCE AND JANET RICHARD/B & J AUTO FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Bruce and Janet Richard/B & J Auto, VI #0500004, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of October, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, at the request of Planning staff, the Board deems it advisable to refer the matter back to the Department of Planning Services. REMEDY As was previously indicated, upon reviewing some of my older open violations, I ran across this violation case. This case was placed 'on hold' pending the outcome of the sign issue and CDOT working on the frontage road. Both of the items mentioned above appear to be resolved or at least partially resolved. The sign has been disassembled (parts of which are still sitting out front and visible). My records reflect that you came to the Greeley Planning Office on June 24, 2010 at which time staff explained the Use by Special Review(USR) process which is necessary if you desire to store DERELICT VEHICLES anywhere on the property other than inside the shop. He stated that he had just received my letter. He indicated that the fencing was already scheduled to be replaced. It was strictly a "Temporary" fix while CDOT was doing all of their work. He is hoping to have the new fencing installed by March; however, it is dependant upon the weather. I told him that I would be sending him a 60 day letter instead of my usual 30 day letter. He asked what he needed to do if he ran into any snags. I told him to just make sure and keep me advised of what is going on. We then discussed the sign. He said that he rented out that portion of the property to a sign company and was under the impression that the building permit had been finaled. I explained that it was still open. He said that the company was in litigation over the sign with CDOT. He said he would contact the sign company and find out what is going on and then let me know. I told him to find out if there was any type of court order regarding the sign and if so to have the company get a copy of the order for my files. He said he would keep me advised. 06/03/2010 Property Inspected Upon a visual inspection of the property, the following items were noted: There is outdoor storage in the back area. Additionally, a portable building along with advertisements have been added to the property. See pictures dated 06/03/10. 06/10/2010 Phone Call Bruce Richard called (303-828-0891). Kim Ogle and I called him back. He claimed that he had permission from me to install the fabric. I explained that when he and I spoke back in 2005, it was my understanding they were still working on the frontage road. The fabric was to replace the slats which were considered "temporary" fencing until the frontage road was completed. Kim told him that he needed to come in for a Pre-Application meeting. He tentatively scheduled him for June 24, 2010 at 9:30. I told Bruce that I would e-mail him (bwrichard@q.com) the Pre-Application Request form (2 pages) and he would need to fill out the front page and complete a narrative explaining what he wants to do and is currently doing and get it back to us as soon as possible. To bring your property into compliance with the Weld County Code: During review of active violation cases, staff noted this pending violation case. This case was placed 'on hold' pending the outcome of the sign issue and CDOT working on the SERVICE,TEAMWORK,INTEGRITY,QUALITY frontage road; however, staff has determined that the State of Colorado Attorney General's Office will address the sign issues separate from this violation case. Your letter dated November 15, 2000 (see enclosed) addressing the Site Plan Review questionnaire, #6 specifically states "the remaining vehicle is removed and sold as scrap iron. We would like to assure you that we do not intend to operate a salvage yard". Staffs interpretation of this comment is that this property would not turn into a storage yard/salvage yard; however, the back(Eastern) portion of the property appears to be utilized as a storage yard. This area is specifically called out on your recorded Amended Site Plan Review(AmSPR-208) map as the Storm Water Retention Area. Additionally,this area is shown that it would be surrounded with a chain link fence with aluminum slats. If you desire to store derelict vehicles anywhere on the property other than inside the shop, a Use by Special Review(USR) permit is required. When the initial violation notice was sent in 2005, we had a phone conversation, where you indicated the `slatted' fencing was still temporary due to CDOT and the City and County of Broomfields' intended work on the 1-25 frontage road. The road work has since been completed and the slats have been replaced with fabric. This was not approved through AmSPR-208. The plat map clearly shows an eight(8) foot decorative block wall. Furthermore, the landscape plan shows specific plant material for the site. Again visual inspection appears to indicate the existing site condition does not match the landscaping plan dated 02-28-01 (please see enclosed recorded plat map and landscape plan). I know I have quite a few out there with each of you. I haven't received any new information on most of my cases in quite a while. My referrals indicate when there is an outstanding violation. I am finding that cases are being closed, but I'm not getting the information. On Friday I found a 2003 case that the USR plat had been recorded in mid 2004 and I just happened to run across the recorded plat.
