RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR PLANNED UNIT
DEVELOPMENT FINAL PLAN, S #554 - IDAHO CREEK, PHASE 3 - KB HOME OF
COLORADO, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated March 7, 2001,the Board approved the application of Kent
Carlson, P.O. Box 247, Eastlake, Colorado 80614, for 351 Residential lots in the Mixed Use
Development area for Idaho Creek, Phase 3, on a parcel of land located on the following described
real estate, to wit:
Part of the NW1/4 NE1/4 of Section 10, Township 2
North, Range 68 West of the 6th P.M., Weld County,
Colorado, as shown as on the final plat as Phase 3 of
Planned Unit Development Final Plan, S#554, Idaho
Creek, and
WHEREAS, on February 28, 2005, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements(Public Road Maintenance) between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, and KB Home of Colorado, Inc.,with
terms and conditions being as stated in said agreement, for Idaho Creek, Phase 3, and accepted
Subdivision Bond No. SU5011134, from Aon Risk Services, Inc., of Southern California Insurance
Services, P.O. Box 54670, Los Angeles, California 90054-0670, in the amount of$1,296,998.85,
and
WHEREAS, on August 24, 2009, the Board was presented with a replacement Warranty
Bond from Aon Risk Services, 707 Wilshire Boulevard, Suite 2600, Los Angeles, California 90017,
in the amount of$194,549.83, retaining 15 percent for a one-year warranty period, and
WHEREAS, staff from the Weld County Departments of Public Works and Planning Services
have conducted a visual inspection and recommend release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that replacement Subdivision Bond No. SU5011134, from Aon Risk Services,
Inc., in the amount of$194,549.83 be, and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

Request for Final Release of Collateral:
The Department of Public Works received a request from the applicant's representative, Katie
Cooley/Cooley Development Consulting, requesting an inspection of the property in order to
obtain the final release of collateral at the end of the warranty period.
Following completion of Punch List items, Weld County Public Works Department performed a
site inspection, at the above mentioned site, and observed the following:
• All Public Works related items on Exhibit A, of the Improvements Agreement According
To Policy Regarding Collateral For Improvements (Public Road Maintenance) Document
#2005-0662, have been completed and are found to be acceptable.

from Arch Insurance Company $1,296,998.85

Spoke to Maria Pena (213-630-1342) (AON) and Katie Cooley
from KB Homes 6/09. They received a letter from Josh Holbrook
requesting a reduction in collateral of $1,102,449.02, and retaining
$194,549.83 for a one year warranty. Expires 3/4/2010. Letter sent
to Katie Cooley by Kim Ogle on 04/01/09 stating current status.
Partial Release 08/24/09 (2009-2223) $1,102,449.02
One year warranty period expires 08/24/2010 $ 194,549.83
One year warranty period extended to 08/24/2011
Recommendation:
The Department's of Public Works and Planning Services are recommending final release of

Principal shall indemnify the Obligee for all loss that the Obligee may sustain by reason of any
defective materials or workmanship which become apparent during the period of One year(s)

Hi Katie,
I was just following up on the release of collateral for Idaho Creek, Phase 3—KB Home of Colorado, Inc.
A couple weeks ago you sent me an e-mail regarding who I sent the information regarding the release to. At this time
we still have not received the signed Certified Return Receipt card from Maria Pena with Arch Insurance Company
showing that the original bond had been delivered to them, so I thought I would ask you first if you know if the bond
was released with them, or do I need to call them and see if they received it, and just failed to sign the card. When I
sent them a letter in August of 2009, I did not receive the receipt back either, even though they had received it.
