AMENDMENTS, WITHIN THE DISTRICT'S UNINCORPORATED PORTIONS OF
WELD COUNTY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Section 32-1-1002(1)(d), C.R.S., provides that a fire code promulgated by a
fire district may be enforced in the unincorporated portions of a county only with the consent of
the board of county commissioners of such county, and
WHEREAS, the Frederick-Firestone Fire Protection District (the "District") has presented
a resolution and minutes, dated February 11, 2008, adopting and promising to enforce the
2006 International Fire Code, with certain amendments set forth in said resolution and minutes,
within the District's unincorporated portions of Weld County, and
WHEREAS, the Frederick-Firestone Fire Protection District Board of Directors held
one (1) public meeting on February 11, 2008, following a posting of the notice of the meeting, at
which the 2006 International Fire Code and its adoption by the District was discussed, and
WHEREAS, after review, the Board deems it advisable to consent to the enforcement by
the District of the 2006 International Fire Code, with certain amendments set forth in said
resolutions, (a copy of which is attached hereto as an exhibit), within the District's
unincorporated portions of Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that it hereby consents to the enforcement by the Frederick-Firestone
Fire Protection District of the 2006 International Fire Code, with certain amendments set forth in
its resolution and minutes dated February 11, 2008, within the incorporated area of such
District.

Dear Ms. Arries,
This letter is in reference to the Frederick-Firestone Fire Protection District (the Fire District")
enforcing the 2006 International Fire Code in the unincorporated parts of Weld County that are
located within the boundaries and jurisdiction of the Frederick-Firestone Fire Protection District.
On February 11, 2008, the Frederick-Firestone Fire Protection District Board of Directors passed
Resolution 2008-004 to enforce the 2006 International Fire Code in the unincorporated parts of
Weld County that are located within the boundaries and jurisdiction of the Fire District. A copy
of Resolution 2008-004 is attached with this letter.
In January of each year the Frederick-Firestone Fire Protection District is required to adopt a
resolution by the Board of Directors to post a notice of time and place designated for all regular
and special meetings in at least three public places within the limits of the Fire District and in the
office of the county clerk and recorder in which the Fire District is located. All meetings must
be posted at least three days prior to said meeting(s).
Frederick-Firestone Fire Protection District Board monthly and special Board meetings are
posted 72 hours in advance of the Fire District Board of Directors meetings at the following
locations:
Town of Frederick Post Office at 411 Oak Street, Frederick, Colorado, 80530;
Town of Firestone Post Office at 478 First Street, Firestone, Colorado, 80520;
Fire District Station 1 at 31 Walnut Drive, Frederick Colorado 80530; and
Fire District Station 3 at 6800 Tilbury Ave, Firestone, Colorado 80504
The Frederick-Firestone Fire Protection District Board of Directors' monthly Board meetings
schedule and location are sent to the Weld County Clerk and Recorder's office and the
Department of Local Affairs Division of Local Government in December of each year for the
next calendar year.

The only time that the Fire District would be asked to enforce the current fire code in the
unincorporated parts of Weld County is when the Town of Frederick and/or the Town of
Firestone adopt a new building code or adopt an amendment to the existing building codes or fire
codes.
Since February 2008 both the Town of Frederick and the Town of Firestone have amended one
section of the 2006 International Fire Code. Both towns added a section to Chapter 5 of the 2006
International Fire Code addressing Radio Signal Amplification. I have attached a copy of the adopted
amendment from the Town of Firestone with this letter.
The Frederick-Firestone Fire Protection District is asking for Weld County to allow the Fire
District to enforce the 2006 International Fire Code in the unincorporated parts of Weld County
that are within the District's boundaries and jurisdiction.

RESOLUTION OF THE
BOARD OF DIRECTORS OF THE
FREDERICK-FIRESTONE FIRE PROTECTION DISTRICT
RESOLUTION ADOPTING THE 2006 EDITION OF THE INTERNATIONAL FIRE CODE
WITH LOCAL AMENDMENTS FOR UNINCORPORATED WELD COUNTY
WHEREAS, the Frederick-Firestone Fire Protection District ("District") is a quasi-
municipal corporation and political subdivision of the State of Colorado, formed pursuant to
C.R.S. §32-1-101, et seq. ("Special District Act") to provide fire suppression, fire prevention,
rescue, hazardous materials, ambulance and emergency medical services;
WHEREAS, a portion of the District's jurisdiction lies within unincorporated Weld
County("County");
WHEREAS, the Special District Act authorizes the District's Board of Directors
("Board") to adopt and enforce a fire code within the District's jurisdiction; provided, however,
that a fire code adopted by the District Board can only be enforced within the County if it is first
approved by the Board of County Commissioners ("Commissioners");
WHEREAS, CRS 32-1-1002(3)(b)(I) of the Special District Act requires the District's
Fire Chief to "[e]nforce all laws of this state and ordinances and resolutions of the appropriate
political subdivisions relating to the prevention of fires and the suppression of arson";
WHEREAS, the District Board desires to adopt the 2006 Edition of the International Fire
Code with the Local Amendments To The 2006 International Fire Code attached to this
Resolution as Appendix A (collectively, the "Fire Code") and incorporated in its entirety herein
by this reference; and,
WHEREAS, in accordance with the Special District Act, the District Board intends to
submit the Fire Code to the County Commissioners for approval. The District Board further
intends that the Fire Code shall not apply within the County until the County Commissioners
adopt an ordinance or resolution stating the Fire Code applies within that portion of the
unincorporated County that also lies within the District's jurisdiction, or unless the County gives
written authorization for the District to enforce the Fire Code on an interim basis, with such
limitations and conditions as the County deems appropriate, pending formal adoption by the
County Commissioners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
FREDERICK-FIRESTONE FIRE PROTECTION DISTRICT:
1. The International Fire Code®, 2006 Edition, published by the International Code
Council, Inc., 500 New Jersey Ave. NW 6`h Floor, Washington DC, 20001-2070, including the
outline of contents, index, Chapters 1-45 and Appendix Chapters A-G, as amended by the Local

Amendments to the 2006 International Fire Code attached to this Resolution as Appendix A
(collectively, the "Fire Code"), is hereby adopted as the District's Fire Code for all purposes
within that portion of the District that lies within unincorporated Weld County; provided,
however, the Fire Code shall not apply within the County until the County Commissioners adopt
an ordinance or resolution stating the Fire Code applies within the portion of the unincorporated
County lying within the District, or unless the County gives written authorization to the District
to enforce the Fire Code on an interim basis, with such limitations and conditions as the County
deems appropriate,pending formal adoption by the County Commissioners.
2. The District's Fire Chief shall promptly submit the Fire Code to the County
Commissioners for approval. On and after the date the County Commissioners adopt an
ordinance or resolution stating the Fire Code applies within the portions of the District lying
within the County, or on and after the date the County gives written authorization to the District
to enforce the Fire Code on an interim basis pending formal adoption by the County
Commissioners, whichever date is earlier ("Effective Date"), the Fire Code shall be
administered and enforced by the District's Fire Chief, or his/her authorized representative, as
required and provided for in the Special District Act, and any other applicable federal, state or
local laws, rules, and ordinances, or common law;
3. The District's Fire Marshal, for the purpose of enforcing the Fire Code on and
after the Effective Date, is an authorized representative of the Fire Chief. This section shall not
limit the designation of additional authorized representatives if the Fire Chief deems it necessary
for the effective enforcement of the Fire Code;
4. Nothing contained in this Resolution shall be construed as modifying or limiting
in any manner the powers, duties, and responsibilities of the District, and the District's Fire Chief
or his/her authorized representative(s), set forth in the Special District Act, or as otherwise
provided by statutory or common law;
5. The Fire Code shall be interpreted in conformance with all federal, state and local
laws and ordinances, including but not limited to the Special District Act, and shall, to the extent
possible, be interpreted in a manner that does not conflict with the County's building codes,
regulations and ordinances.
6. If any provision of this Resolution or the Fire Code is for any reason held to be
invalid,that invalidity shall not affect the validity of the remaining provisions of this Resolution and
the Fire Code. The Board expressly declares it would have adopted this Resolution and the Fire
Code even if a provision contained in either this Resolution or the Fire Code is declared invalid.

Attorneys'Report
Attorney Dino Ross presented the attorneys'report. A copy of the written report is included in
the Board packet. Attorney Ross also updated the Board on the St.Vrain State Park inclusion
action,pending legislation that may affect special districts,and Public Law Number 110-142,
which provides a partial tax exemption for volunteer stipends.
Fire Chief's Report
Fire Chief Poszywak presented the Chiefs Report. Fire Chief Poszywak informed the Board
that the Town of Firestone's Centennial Celebration Kick-Off event is Saturday March 1,2008,
at Coal Ridge Middle School,from 2:30 p.m.until 7:30 p.m. Pete Ditmon,the centennial
celebration coordinator,would appreciate the opportunity to display historical information
during the event;anyone with historical information should contact Mr.Ditmon.
Fire Chief Poszywak informed the Board that the Air Life Denver Welcoming Celebration is
currently on the front page of the District's website. Fire Chief reminded that Board that the
festivities for Air Life Denver will begin at 7:30 a.m.on February 12,2008 and conclude at
approximately 9:30 am. The helicopter fly-in is scheduled for 8:00 am.
Fire Chief Poszywak updated the Board on the renovation projects. The upstairs renovations at
Fire Station 2 are complete. A copy of the lease agreement with Air Life Denver is included in
the Board packet. A helicopter pad will be installed soon. The next item on the priority list is
the installation of the emergency generators at Fire Stations 1 and 2. The downstairs renovation
at Fire Station 2 will start in May 2008.
Fire Chief Poszywak updated the Board on the activities of the District's Grant Committee. The
District was awarded$227,000 from the State of Colorado Minerals and Energy Impact Grant
for the purchase of a fire truck and extrication equipment. The money for the grant is provided
by funds from the State Severance Tax. Fire Chief Poszywak and the Grant Committee member
are scheduled to meet with Don Sandoval with the State of Colorado Department of Local
Affairs on Thursday,February 28,2008 to discuss the details of the award. The Grant
Committee also is actively working on an application for a State of Colorado EMS grant. With
the purchase of a new fire truck moved to the 2008 budget schedule,the purchase of an
additional ambulance will be deferred until 2009. Monies designated for the fleet replacement
fund will be used for both of these purchases.
Fire Chief Poszywak discussed with the Board the purchase of a new pick-up truck designated
for primary use by the Battalion Chief. Five(5)quotes have been received. Copies of three(3)
of the quotes are included in the Board packet. The most economical vehicle is on the state
purchase list. The total anticipated cost for the truck is$55,000 fully equipped. Fire Chief
Poszywak also discussed with the Board the purchase of a staff vehicle. The 2008 budget
includes$30,000 for the purchase. Chief Poszywak recommended a used cross-over or sports
utility(SUV)type vehicle with less than 20,000 miles at the time of purchase. Purchasing a
certified used vehicle could save the District up to$11,000.

Fire Chief Poszywak updated the Board on the 2008 hiring process. Advertisements for a new
Training Officer began on Friday,January 18,2008. A new job description has been prepared,
which specifies lieutenant-level candidates. No applications have been received to date.The
application period closes on Friday,February 15,2008. The position may need to be re-
advertised with an adjustment of$10,000 annually,bringing the position up to an entry-level
captain salary.
Fire Chief Poszywak also informed the Board that Administrative Secretary Tammy Reasoner
has requested a six(6)week medical leave of absence beginning approximately at the end of the
month. Fire Chief Poszywak requested permission to hire a temporary contract person to assist
Administrative Manager Dale Ingraham with administrative and front office duties. The Board
instructed the Fire Chief to use his discretion in this matter.
Fire Chief Poszywak informed the Board that the decision on the 48/96 proposal was announced
at the all staff meeting on Tuesday,January 22,2008.This issue is now closed.
Fire Chief informed the Board that he will be out of town from Sunday, March 30 through
Saturday,April 12,2008 to attend National Fire Academy Executive Fire Officer training.
Fire Chief Poszywak also included in the Board packet a list of recent events and meetings,as
well as a list of upcoming events and meetings.
Fire Marshal's Report
Fire Chief Poszywak presented the Fire Marshal's Report for the month ending January 31,
2008. A copy of the written report is included in the Board packet.Fire Chief Poszywak
informed the Board of the District's new policy of informing business owners one month prior to
the due date of their annual business fire safety inspections. Effective immediately,the District
also will send follow-up cards to all inspected businesses requesting feedback.
Operations Report
Battalion Chief Reasoner presented the Operations Report for the month ending January 31,
2008. A copy of the written report was distributed.
Administrative Manager's Report
Administrative Manager Dale Ingraham presented the Administrative Manager's Report for the
month ending January 31,2008.

• A copy of the Fire and Police Pension Association of Colorado(FPPA)Fourth Quarter
Allocation Report for the quarter ending December 31,2007 is included in the Board

• A Call for Nominations is included in the Board packet. The notice states that an election
will be held on the 6th day of May,2008 between the hours of 7:00 am.and 7:00 p.m. At
that time,three(3)Directors will be elected to serve four(4)year terms. One Director
each from Ward 1,Ward 4 and Ward 5. If an eligible elector of the District is interested
in serving on the Board of Directors,a Self-Nomination and Acceptance form may be
obtained from the District Designated Election Official. The deadline to submit a Self-
Nomination and Acceptance form is 3:00 p.m.on Friday February 29,2008. The Call for
Nominations also is being advertised on the District's website.
• A thank-you card from the Chioda family for the District's kindness and support.
• A thank-you card from the Town of Frederick Police Chief Gary Barbour for the
District's assistance at the Santa Cops reception at the municipal court on Saturday,
December 15,2007.
• An invitation from the Carbon Valley Chamber of Commerce to attend their Annual
Dinner on Saturday,February 23,2008,at the Radisson Conference Center in Longmont,
Colorado. Reservations must be submitted no later than February 19,2008.
• A request for donation of money,goods,and/or in-kind services in support of Imagine
Charter School at Firestone.
The Board took no action at this time.
Ms.Ingraham distributed corrected 2007 Form 1099-MISC forms to the Board members and to
legal counsel.On February 8,2008,Ms.Ingraham conducted an audit of the District's 2007
Accounts Payable and Payroll records in comparison to the 2007 Form 1099-MISC forms issued
on January 25,2008. Ms.Ingraham determined that the original information reported to the
Internal Revenue was understated and incorrect.

AN ORDINANCE AMENDING SECTION 15.32.020 OF THE FIRESTONE MUNICIPAL
CODE TO ENACT AMENDMENTS TO THE 2006 EDITION OF THE INTERNATIONAL
FIRE CODE AS ADOPTED BY THE TOWN WITH AMENDMENTS IN ORDER TO
REGULATE PUBLIC SAFETY RADIO AMPLIFICATION SYSTEMS
WHEREAS, the Board of Trustees adopted Ordinance No. 670 on February 28, 2008,
which adopted by reference the 2006 Edition of the International Fire Code with certain
amendments; and
WHEREAS, the Frederick-Firestone Fire Protection Distnct has recommended that the
Board of Trustees further amend the 2006 Edition of the International Fire Code in order to
address emergency communication concerns not addressed in the Town's Fire Code; and
WHEREAS, the Board of Trustees has determined it is in the best interest of the citizens
of Firestone, and in the interest of the public health, safety and general welfare, to further revise
the 2006 International Fire Code to include provisions regulating public safety radio
amplification systems;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FIRESTONE, COLORADO:
Section 1. Section 15.32.020 of the Firestone Municipal Code is hereby amended to
adopt a new subsection D to read as follows:
D. The following new Chapter 5, Section 511 is added:
CHAPTER 5, SECTION 511
PUBLIC SAFETY RADIO AMPLIFICATION SYSTEMS
511.1 General. Public safety radio amplification systems for the enhancement of
emergency services communications within buildings shall be designed, installed and
maintained in accordance with this section.
511.2 Approval and Permit. Plans shall be submitted for approval prior to
installation. At the conclusion of successful acceptance testing, a renewable permit
shall be issued for the public safety radio enhancement system by the town.
511.3 Where required. Subject to the exceptions provided for below, where
adequate radio coverage cannot be established within a building, as defined by the
fire code official, public safety radio amplification systems shall be installed in the
following locations:
1. New buildings with a total building area greater than 50,000 square feet. For
the purposes of this section, fire walls shall not be used to define separate
buildings.
2. All new basements over 10,000 square feet.
3. Existing buildings meeting the criteria of section number 1 or 2 of above
undergoing alterations or additions exceeding 50% of the existing aggregate
area of the building as of the date of this ordinance.
Exceptions:
1. One- and two-family dwellings and townhouses.
2. If approved by the fire code official, buildings that provide a documented
engineering analysis indicating the building is in compliance with radio
reception levels in accordance with Section 511.3 and final fire department
testing.
511.4 Design and installation. Public safety radio amplification systems shall be
designed and installed in accordance with the criteria established by the fire code
official based on the capabilities and communication features of the jurisdiction
providing the emergency services. Except as otherwise provided in this section, no
person shall erect, construct, or modify any building or structure or any part thereof,
or cause the same to be done which fails to support adequate radio coverage for
emergency services providers.
I. After a building permit has been issued, upon request by the owner or the
owner's agent, the fire department will, within ten to fourteen days, identify
the frequency range or ranges that must be supported.
2. In the event that an emergency service provider modifies its communications
equipment in any way that impairs its ability to communicate with an existing
system installed in accordance with this section, such agency shall be
responsible for all costs associated with reestablishing communications within
the affected building or structure.
3. For purposes of this section, adequate radio coverage shall constitute a
successful communications test between the building and the communications
centers for all appropriate emergency service providers for the building.
Inbound into the building: A minimum average in-building field strength of (-95
dBm) throughout 100% of the area of each floor of the building when transmitted
from the appropriate emergency service dispatch centers which are providing police,
fire and emergency medical protection services to the building is required.
If the field strength outside the building where the receiver antenna system for the in-
building system is located, is less than the -95 dBm, then the minimum required in-
building field strength shall equal the field strength being delivered to the receive
antenna of the building.
As used in this part, 100% coverage or reliability means the radio will transmit 85%
of the time at the field strength and levels as defined in this subsection.
Outbound from the building: A minimum average signal strength of (-95 dBm) as
received by the appropriate emergency service dispatch centers which are providing
police, fire and emergency medical protection services to the building is required.
FCC Authorization: If amplification is used in the system, all FCC authorizations
must be obtained prior to the use of the system. A copy of these authorizations shall
be provided to the town.
511.5 Enhanced Amplification Systems. Where buildings and structures are
required to provide amenities to achieve adequate signal strength, such buildings and
structures shall be equipped with any of the following to achieve the required radio
coverage: radiating cable systems, internal multiple antenna systems with a frequency
range as established in Section 511.4, with amplification systems as needed.
If any part of the installed system or systems contains an electrically powered
component, the system shall be capable of operation on an independent battery and/or
generator system for a period of at least 12 hours without external power input or
maintenance. The battery system shall automatically charge in the presence of
external power input.
The public radio enhancement system shall include automatic supervisory and trouble
signals for malfunction of the signal booster(s) and power supplies that are
annunciated by the fire alarm system.
511.6 Final Acceptance Test. A minimum signal strength of -95 DBM must be
receivable in 90% of the area of each floor of the building when a 700/800 MHZ
radio signal is transmitted from the nearest public safety radio communication site.

The 700/800 MHZ frequency range must be able to be received and transmitted
within 90% of the structure at least 95%of the time.
511.7 Testing Procedures. Tests shall be made using frequencies close to the
frequencies used by the emergency services agencies. If testing is done on the actual
frequencies, then this testing must be coordinated with the appropriate emergency
services agencies. All testing must be done on frequencies that are authorized by the
FCC. A valid FCC license will be required if testing is done on frequencies different
from the police, fire or emergency medical frequencies.

Where in-building radio coverage is required, and upon completion of the installation,
it will be the building owner's responsibility to have the radio system tested to ensure
that two-way coverage on each floor of the building is a minimum of 90%.
Each floor of the building shall he divided into a grid of approximately 20 equal
areas. A maximum of two (2) nonadjacent areas will be allowed to fail the test. In the
event that three of the areas fail the test, in order to be more statistically accurate, the
floor may be divided into 40 equal areas, and if so divided, a maximum of four (4)
nonadjacent areas will be allowed to fail the test.
511.8 Annual Tests. Building owners shall conduct tests at a minimum of once every
12 months to ensure working order of all active components of the system, including,
but not limited to, signal boosters, power supplies, and backup batteries. If the
communications appear to have degraded or if the tests fail to demonstrate adequate
system performance, the owner of the building or structure is required to remedy the
problem and restore the system in a manner consistent with the original approved
criteria.
If the degradation to the system is due to building additions or remodeling, the owner
of the building or structure is required to remedy the problem and restore the system
in a manner consistent with the original approval criteria in order to obtain a final
inspection for occupancy.
Any system degradation or failure not related to the performance of the owners on-
site system will be the responsibility of the appropriate emergency service agency.
511.9 Maintenance. Public safety radio amplification systems shall be maintained in
an operative condition at all times and shall be replaced or repaired where defective.
A complete and accurate maintenance log shall he kept at the site at all times, made
available for inspection by the fire code official and such official's designees, and
shall, at a minimum, include the following information:
I. Installing Contractor
2. Site Address
3. Maintenance Performed
4. Maintenance Contractor
Section 2. If any section, paragraph, sentence, clause, or phrase of this ordinance is
held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or
constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby
declares that it would have passed this ordinance and each part or parts hereof irrespective of the
fact that any one part or parts be declared unconstitutional or invalid.
Section 3. All other ordinances or portions thereof inconsistent or conflicting with
this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or
conflict.

Section 4. The repeal or modification of any provision of any prior ordinance by this
ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty,
forfeiture, or liability, either civil or criminal, which shall have been incurred under such
provision, and each provision shall be treated and held as still remaining in force for the purpose
of sustaining any and all proper actions, suits, proceedings, and prosecutions for the enforcement
of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any judgment,
decree, or order which can or may be rendered, entered, or made in such actions, suits,
proceedings, or prosecutions.

Hi Stephanie,
I did some research regarding the fire departments code adoption. The fire departments amendment to the fire code
(Chpt. 5 Section 511) has to do with communication for first responders within a building.This was generated from 9/11
.Some buildings, mostly the larger tall ones, have radio frequency communication signal issues in building(dead spots
for signal).What this amendment does, and interesting enough it is in the up and coming 2009 code, is to install a radio
amplification system where buildings have less than -95 dBm for basements 10000+sq. ft and new construction
500000+sq. ft.This amendment is not retroactive.
In a nut shell,this currently will have little to no effect to Weld County.
It is my professional opinion and recommendation it should be accepted as amended.
