RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT FOR A HOG OPERATION FOR DENNIS TILLEY, ROUTE 1, BOX 620 , STRASBURG, COLORADO 80136 . WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 2nd day of November, 1977, at the hour of 2 : 00 o ' clock p.m. , in the Chambers of the Board of County Commissioners, for the purpose of hearing the application of Dennis Tilley, Route 1, Box 620, Strasburg, Colorado 80136 , for the granting of a Special Use Permit for a hog operation on the following described real estate, to-wit: The D and L Special Use Area is described as being the West 699 feet of the North 405 feet of the South 1172 feet of the SWn SW4 of Section 6, Township 1 North, Range 63 Westof the 6th P.M. , subject to road and ditch easement along the West side, containing in all 6.50 acres of which 6.22 acres are net. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the grant of the Special Use Permit for a hog operation on the above-described real estate, and WHEREAS, Section 3. 3.E. 4 .d. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District on the grant of a Special Use Permit by the Board of County Com- missioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Special Use Permit for a hog operation on the hereinabove described real estate, com- plies with all of the conditions as set out in Section 3. 3.E. 4 .d. of the Weld County Zoning Resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the petitioner for a Special Use Permit for a hog operation on the hereinabove described tract of land, be, and hereby is , granted /I( PL0645 770264 subject to the Development Standards contained in the Special Use Permit. BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated September 20, 1977, be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. RESOLUTION September 20, 1977 the future development in the area and will not adversely affect the health, safety, and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. The hog operation and management practices as outlined and controlled in the development standards will make this operation compatible with the surrounding area by minimizing the potential adverse impacts. B. The 'proposal is for an agri-business in an agriculturally zoned area, with existing land uses being predominantly agricultural. C. The Weld County Extension Agent has indicated the facilities will provide adequate space for proposed number of animals. He did not observe any problems with the proposed operation. D. The Weld County Health Department has indicated the proposed operation is in compliance with all applicable Weld County and State Health Standards and regulations. E. The Keenesburg Planning Commission has indicated they have no objections to the proposed hog operation. E. The Weld County Engineering Department indicated no engineering problems could be identified with the proposed G. The State Engineer, Division of Water Resources, indicated the domestic/livestock well may be utilized for the proposed hog operation and they have no objections to the approval of this application. Comment: 1. A petition form in opposition to this Special Use Permit request was submitted (see copy in attached packets). 2. One additional item had been received since the September 6, 1977, meeting. This was a letter from the Weld County Health Department regarding the concerns of the Planning Commission regarding the fly and odor problem at the Weld Central School. Mrs. Dennis Tilley stated that she had checked with the National Weather Service regarding the wind blowing the odor in the direction of the school and was told that the wind blew to the west 6 percent of the time which would probably be about ten school days a year. She also feels there would be no problem with flies as they will be spraying for control . Floyd Willmot stated he felt there would be no problem with flies and odor if the operation is run efficiently. He also checked with the Soil Conservation Service and the Keenesburg Planning Board and they also felt there would be no fly and odor problem. LeRoy Sigwardt again spoke in opposition of the operation saying that he felt there would be a definite fly and odor problem at the school . Jerry Ehrlich of the Keenesburg Planning Board indicated he had again spoke with each member of the Keenesburg Planning Board. They felt there would be no problem with an operation of this kind. MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners. Motion by Jerry Kiefer, seconded by Frank Suckla. The area in question began to develop in 1968 at which time two homes were built. Since that time development has not progressed. Mr. Peterson and Mr. Alexander now wish to develop approximately 15 lots ranging in size from 1 to 2.2 acres. A petition was also presented at this time by Mr. Stientjes supporting the rezoning request . Ken McWilliams then read the staff recommendation. Mr. Suckla then asked about water and sewage. Mr. Stientjes responded by saying that the water would be city water and the sewage system would be either septic or transpiration/evaporation. Ken McWilliams and Tom Honn of the Planning staff and Kay Norton, Assistant County Attorney, then explained and discussed with the Planning Commission at some length the proposed amendments to the Weld County Mobile Home Regulations and the Weld County Building Code. The following proposals were discussed and motions made: Proposal for the repeal and re-enactment of Section 6 .1(2) , the y �4 1 repeal of Section 3 .6-A, 3 . 3(C) (2) (c) and 3 .15, the repeal of the "Mobile Home and Mobile HOme Park Regulations" adopted October 19, 1961, and revised August, 1966, and amendments to Section 3 . 14 and 12.2 of the Weld County Zoning Resolution, all relating to the regulation of mobile homes. Mr. Hiatt comments that he had site reviewed the area and found the operation to be very clean and reclamation looks satisfactory. Mr. Carlson asked whether it was dry or water pits. Mr. Davidson responded by saying that it was dry pits, but that there is subsurface water there that is not being used in the operation. The water is left to stand where the gravel is being extracted and the top soil is being broughtback and replaced. There will be no open pits when the operation is complete. Tom Ilonn then read the staff recommendation, Extraction Standards, and Reclamation Standards. Some discussion followed. Tom Honn then read the staff recommendation and Development Standards. Mr. Tilley stated he was in agreement with the Standards. When asked for any opposition from the audience by Mr. Carlson, Mr. Leroy Sigwardt presented his reasons for opposing the operation being devaluation of the property and the surrounding area, fly and odor problem, and open pond with raw manure which would seep after a heavy rain or snow causing a health hazard and also cause damage to his property which had occurred previously. Mr. Sigwardt then distributed pictures to the Planning Commission which showed the result of run-off from the holding pond of irrigation water onto his land which is approximately six acres. Approximately five other persons also spoke in opposition of the hog operation request , most of whom were opposed to it because of the health hazard and fly and odor problem. The confined hog farrowing and finishing operation on the hereon described parcel of land shall be limited to the facilities shown which are designed to handle approximately 100 sows, 500 weaners, and 1000 feeders. 2. The Special Use Permit area shall be maintained in such a manner as to prevent the growth of noxious weeds, fugitive dust, and soil erosion. 3. All sewage disposal facilities installed on the site shall conform with all applicable Weld County and State Health Regulations. 4. Access shall be limited to the one existing point as shown hereon. 5. There shall be no discharge from any of the proposed hog operation into streams, other bodies of water, or adjacent draining systems without obtaining a wastewater discharge permit from the Water Quality Control Commission, State Health Department. 6. The Special Use Permit shall be limited to the plans submitted and governed by the development standards stated above. I wish to respond to that letter. 1. Carl and Ann Russel owned a quarter section of land which Mr. Sigwardt was interested in purchasing in November or December of 1967. Mr. Sigwardt approached the under- signed, who had approximately 3 to 6 acres leased from the Russels, and operated an egg ranch. Mr. Sigwardt wanted me to pur- chase 61/2 acres of the quarter section, and he would purchase the balance of it. This transaction was completed and I continued the operation of an egg ranch from that date up to the present time, and over the years I have fed hogs on the acreage without any objection from anyone, including Mr. Sigwardt. No one has ever complained to me about flies, odor or stench arising from the egg ranch operation and the feeding of hogs on this acreage. The hog operation would not devaluate the Sigwardt place any more than the egg operation has done over the years. 2. Mr. Sigwardt commutes 31/2 miles to the farm in the area in question, and owns a house in Hudson, 8 miles away. He would have an alternative as to where to live. 3. Many of the people who signed Mr. Sigwardt' s petition live several miles away from the location of the egg ranch. Almost without exception, the people that I contacted and explained the operation to said it was not the way it was explained to them by Mr. Sigwardt. Many of those people signed the petition in favor of granting a license to operate the hog operation when the entire matter was explained to them. 4. There is a feed lot located 3/4 of a mile from Prospect Grade School, which feeds several thousand cattle. The Weld Central Junior Senior High School is one mile west of the property where the hog operation will be conducted. Neither the feed lot nor the egg ranch have ever caused a health or environ- mental hazard to the school. Many teachers and workers from Weld Central Junior Senior High School have signed the petition in favor of granting Mr. and Mrs. Tilley' s request. 5. During the time that I have fed hogs on the particular piece of property involved, none or my hogs ruined any ditches or furrows down the row which Mr. Sigwardt uses to irrigate crops. In the past, there have been maybe three or four times when hogs escaped onto Mr. Sigwardt' s land, but they were immediately rounded up and put back into their pens. 6. The plans that the Tilley' s have for holding the hogs is to hold them on concrete floors. The buildings on the property which Mr. Tilley will purchase if his request is granted are the type he has been looking for. The area is zoned for agricultural purposes, and the operation of the hog ranch is an agricultural operation. They are as follows: The Weld County School is within a good flight range of the house fly. The flight range of the house fly is from one (1) to six (6) miles or even up to 13 miles when the food is not plentiful at the place of hatching. The odor problem could always be a potential problem at gatherings at the school, when there is 600 to 800 people, five days a week and some night meetings. Mr. Bob C. Gudka, Superintendant of Weld County School District RE 3 (J), wants assurance that the Health Department would take steps to see that the operator corrects the problems. The potential problem depends upon the operators. One person could do a good job where another could do a very poor job. Our land surrounds the area, in question and there- fore we are submitting the following objections and suggestions. 1. A Hog Operation on these premises would devaluate our property. 2. We would constantly be in contact with the flies, odor and stench from the Hogs and pens while working on our farm. 3. Since we rent the farm where we are presently living it could be sold at any time leaving us no alternative but to build a home on our own farm. In which cases we would definately not want to build next to Hog pens for the same reasons as stated in #2. 4. We have contacted the -immediate area landowners and residents who have signed a petition objecting to a Hog Operation on this location. 5. A major concern of ours and of the community is that Weld Central Jr. Sr. High School is located 1 mile west of the requested Hog Operation. This would create more flies and an offensive odor which the students would have to tolerate both indoors and out. 6. There will be the problem of Mr. Tilley's Hogs getting on our land rooting and digging out our crops. The Hogs will also ruin our head ditches plus the furrows down the row which we irrigate our crops with. This is bound to happen because it has happened to me on this farm the past ten years. Below are some suggestions. 1. Mr. Tilley should be looking for sandy ground for his Hog Operation. Sand would absorb water more readily then clay ground such as ours. In the event of rain or snow storms his Hogs would not be bellie deep in mud and slop which would be more satisfactory and would make his job much easier. 2. Look for a Hog set-up that has quit its operation and has all the facilities required for a Hog Operation. It may also have or had a permit. 3. There are labor houses on this parcel which would be extremely near the hog. pensj wouldn't there be a health factor concerned here. 4. Allowing for the yard and houses there is not much land left for a 1;500 head Hog Operation. In the years to come Mr. Tilley may want to increase his operation and will not have the room or land to do so. (2/ Just recently we stopped at the Planning Commission Office; while there we were shown the blue prints for the requested Hog Operation. We were informed that it is to be A confined operation but after reviewing the blue prints we learned that they plan to have open outside pens which will drain to the East end of this property. The waste, Hog manure and all runoff will be drained into an open lagoon or holding reservoir. This reservoir would become a breeding place for flies and mosquitos plus would create an un- bearable stench. This would definatel,y be a Health Hazzard. Mr. Willnott,' the present owner, dug this reservoir approximately 4 years ago which he filled with water and let set and seep out on my land below him. After 2 years of this he put 6 acres out of production and ruined my land which started to get whilte alkalie on it. After I informed Mr. Willnott that he was liable for damages, he quit running water into the reservoir. We want Mr. Willnott to close this pond so the same problem will not arise.
