RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST WILLIAM ASKEW AND JANE STAMP FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,William Askew and Jane Stamp,ZCV#0900271, are allegedly in violation of the
Weld County Code, and
WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not
been corrected, and
WHEREAS, on the 9th day of February, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, William Askew, property owner, and Jane Stamp, property tenant, were not
present or represented at said hearing, although all parties were notified of said hearing by
Department of Planning Services staff, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to
the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such
referral until May 9, 2010, in order to allow adequate time for the property tenant to submit an
application for a Use by Special Review permit.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0900271 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against William Askew and Jane Stamp to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest in
the properties, and any persons acting in active concert with the identified parties,with an instruction
for delay of action upon such referral until May 9, 2010, in order to allow adequate time for the
property tenant to submit an application for a Use by Special Review permit.

To whom it may concern:
I am writing this letter to ask if I may be granted a 90 day extension to comply with the application of a "Special Lar
Use Permit". This winter season has been very cold and unproductive. There are a number of things that I need to ha\
done that until the snow and ice melts, I will be unable to do. The other huge issue is that my income has dropped
considerable through these cold months. I have two teenage children still living at home, one of which is expecting a
child in April. 1 am a single mother, self employed and have struggled through these winter months in paying the
regular house hold bills. I clean houses for a living and a lot of clients have dropped off due to the economy.
Thankfully, my clientele is beginning to pick up but it will take some time for me to recover my financial state. I am
very confident that if I was granted a 90 day extension, I will be able to comply 100% to the requirements pertaining
this special permit. I am hopeful that you will be wiling to work with me and help me to succeed in my dog breeding
business. If there are additional fee's, I will comply to the best of my ability.

PRE-APPLICATION REVIEW REQUEST
• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews are required
prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre-applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre-Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre-submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
information, a brief narrative and a map delineating the property location, in addition to the other items listed.

Hi Jane,
In order to run a kennel/boarding facility you will need what is called a Use by Special Review(USR) permit. I
am attaching a pre-application meeting request form. You will need to complete this and submit it back to our
Department. Once we receive that back a Planner will call you and set up a meeting which involves us, Public
Works, Health Department and yourselves. At that time we will look at what you are proposing, ensure you
have the property water/sewer/drainage etc and then will give you the application, walk you through the
requirements then allow you decide if you would like to continue to proceed with the permit. Please try to
submit this within the next two weeks. I will also follow up with a letter to you and Mr. Askew through the
mail. I'll get that out today.
Please feel free to contact me at any time if you have further questions or concerns. Otherwise we will be able
to answer anything regarding the application and it's process at the Pre-application meeting.

My name is Jane Stamp and my 'partner/landlord' is William 'Bill' Askew. I live at the 8029 CR 50 property in
Johnstown. 'Bill' is the legal owner of the property but I am the one setting up the kennel and going to buy the
property from Bill this coming spring (2010). I am wanting to 'legalize' my dog kennel and will do what ever it
is to get this special license I will need and Bill is willing to comply as well. I wanted to notify you via email so
you know we are working on this but wasn't sure how to proceed because he is the legal owner of the property
and I am the owner of the 'business'. All my dogs were being boarded out until a month ago... until I got the
proper kennels set up for them. I was in a car accident a year ago, with a brain injury, and was set back for a
while but am now ready to get all my licenses. Please let me know what is next for us to proceed to. We are
more than willing to comply.
