RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST JAMIN AND BETH MAYER FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Jamin and Beth Mayer, ZCV#0900295, are allegedly in violation of the Weld
County Code, and
WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not
been corrected, and
WHEREAS, on the 12th day of January, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Jamin Mayer, property owner, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to
the Weld County Attorney's Office for legal action,with an instruction for delay of action upon such
referral until February 12, 2010, to allow adequate time for the property owners to submit an
application for a Use by Special Review(USR) permit for the operation of a tree trimming business,
in order to bring the subject property into compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0900295 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Jamin and Beth Mayer to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties,with an instruction for
delay of action upon such referral until February 12, 2010, to allow adequate time for the property
owners to submit an application for a Use by Special Review(USR)permit for the operation of a tree
trimming business, in order to bring the subject property into compliance.

REMEDY
As I indicated in my previous letters and explained during the Pre-Application Review meeting the
operation of a tree trimming business requires a Use by Special Review(USR) permit.
In order to cancel the above mentioned Violation Hearing, the USR application shall be assembled and
4 packets be submitted to the Department of Planning Services as soon as possible. Planning
Department Staff will review your packets and respond within 7 working days outlining any missing
paperwork or necessary corrections. The remaining packets and any other requirements as outlined in
Staffs follow up 7 Day Completeness Review memorandum and fees shall be submitted prior to the
hearing in order to cancel the Violation Hearing. If you are unable to meet this timeline, I recommend
you or a representative attend the January 12th Violation Hearing to request additional time from the
Board of County Commissioners.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

On Friday, October 23, 2009 an informal discussion took place at the Greeley Administrative
Offices Conference Room regarding a tree trimming business and outside storage. (The legal
description is Parcel B SE-755; Part of the SW4 of Section 19, T3N, R68W of the 6th P.M.; Situs
Address is 14438 CR 1)
Background Information:
The applicant has a tree trimming business which he would like to operate from his residence.
In addition there is outside storage of mulch and firewood provided for free.
There is one additional employee associated with the business.
Public Works
No Traffic Study is required.
No Geotech report is required.
No Drainage Report is required; however the applicant shall provide a short description of the
historic stormwater flows across the property and how their application will affect those flows.
The description shall include but not be limited to: 1)where the water originates if it flows onto
the property from an offsite source, 2)where it flows to as it leaves the property, 3)the direction
of flow across the property, and 4) if there have been previous drainage problems with the
property. The application shall also provide flow arrows on the map showing where the
stormwater starts, how it goes across the property, and where it leaves the property. The
applicant will still be responsible for providing a water quality feature that conforms to the
methodology outlined in Volume 3, Section 4.4.2 of the Urban Storm Drainage Criteria manual.
Planning Department
The applicant indicated that in the future he may build a shop to house the equipment(this
would include a restroom), a carport, and a possible greenhouse. He also indicated that he may
have a diesel fuel tank smaller than 500 gallons.
Water is provided by Longs Peak Water District. Staff advised the applicant to visit with the
water district regarding any concerns they may have with the commercial business.
Staff encouraged the applicant to visit with Lauren Light, Weld County Environmental Health, in
regard to septic requirements (970-304-6415 ex. 2211).
Signs are allowed in the agricultural zone district up to 16 square feet. If the applicant wishes to
have a larger sign it must be included in the application.
This application is classified as a home business and the fee is $1200. If the applicant wishes to
expand in the future he will need to amend the USR and follow the same process again.
Currently, the site is in violation (ZCV09-00295) and is scheduled for hearings on December 8,
2009. The applicant must submit a completed application by December 7, 2009 to avoid
violation hearings as well as additional fees.

Staff urged the applicant to contact staff for any questions:
Planner On Call available Monday through Thursday 7:30 a.m. to 4:30 p.m.
Staff explained the USR process. The applicant shall submit 4 packets for a 7 day
completeness review. After the 7 day completeness review the applicant will be informed of
what items are still required to make the application complete. Staff requested that the applicant
submit the remaining material in electronic form. Upon submittal of a completed application it
will be sent out for referral for 28 days. The applicant will then meet with their Planner to discuss
the referrals and address as many of the referrals as possible. At that meeting the Planning
Commission hearing will be scheduled. The Board of County Commissioners hearing typically
follows approximately 3 weeks after the Planning Commission hearing.

Thank you for informing me that I may not be in compliance with the Weld County
Code, Chapter 23. Yes, I do operate a free service business from my residence, and I
have been since 2002. I was unaware that I would have to obtain a Use by Special
Review(USR)permit. I apologize for this misunderstanding.
The usage of my property is twofold; first, it is our primary residence. Second, I park my
two work trucks here. I also dump mulch and wood at my location. I give away free
mulch and free wood. As of this year. I have processed firewood to be sold. The
processed firewood has been delivered to customer's homes, not sold at my location.
(This has also been some what of a test to see if I want to sell firewood as supplemental
income).
I'll be more than happy to comply with Weld County with this matter.

This is how I have my property laid out. The west side fence is about 30' from the road.
This space between the road and the fence is unknown (to me as to who owns it). It
would be nice to know who's it is, since I maintain it.
The drive way entrance is about 21' in width. There is plenty of space for people to drive
around on. The property has no landscaping done to it at all. So, parking and driving
around isn't an issue.
I have been parking my work vehicles in the front of my home lately to be seen by
potential customers. (With the slower economy, I felt necessary to get exposure). I used
to park out of sight in the past.
