This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Weld County Road Classification Plan (FHU): WCR 22.5 &WCR 25.5 are local gravel roads and require a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Access: • 1. The applicant shall utilize the existing accesses to the property. No new accesses will be granted. 2. If the access off of WCR 25.5 will be shared by both lots a 30 foot access easement must be granted (15 feet on each lot) or the access should be entirely on Lot B. 3. One of the two accesses to Lot B just east of the Platte Valley Canal must be permanently closed. Photographic evidence of the closure must be submitted to Public Works. 4. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. Storm Water Drainage: The applicant has provided a water quality depression that is acceptable to the Public Works department. 1. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. 2. Please add the following note to the final plat: "Weld County is not responsible for the maintenance of drainage related features." Flood Hazard Development Standards: • This area IS in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). All structures are in place and no new construction is proposed. There will be a total of 5 employees using the site; 2 part-time office employees, the two property owners and 1 on-call driver. There are two homes on the property; a four bedroom farmhouse which is currently vacant, and a three bedroom modular home that is used for the applicant's residence. Both homes are served by individual sewage disposal systems: Permit SE-1000024 for • the farmhouse and Permit G-19840209 for the modular home. According to the applicant, the restroom in the 3 bedroom modular home will be utilized by the office staff. The septic system for the modular home is designed for 3 bedrooms which is equivalent to 6 people. The septic system will not require an engineer's evaluation unless the hydraulic load exceeds 6 people. Both homes are served by individual wells: Permit 195192-A for the farmhouse and Permit 124133-A for the modular home. Both wells are permitted for domestic purposes. As the water in the modular home will be utilized by employees for drinking and sanitary purposes, the well (Permit 124133-A) may not be sufficient for business usage. Written documentation from the State Division of Water Resources is required to verify the well is appropriately permitted for the proposed use. According to the application, the property owners are applying for a recorded exemption dividing the farmhouse off onto its own lot. The driveway is paved; therefore a dust abatement plan will not be required. A waste handling plan is required and shall include removal and disposal of office trash and garbage. According to the application, no vehicle or equipment maintenance is performed on-site. • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Vehicle washing areas should be designated on the plat. 2. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the well for the modular home (Permit 124133-A) is appropriately permitted for the commercial use. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should • include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. • 2 • 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 10.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. • Additionally, please note the following: 1. This application is proposing a well(s) as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. This violation was initiated due to the operation of a construction company and commercial storage without first submitting and completing the necessary Weld County Zoning Permits. It was also discovered that a second home is located on the property. This aspect of the violation is being corrected through RE-5050. This case was presented to the Board of County Commissioners through the Violation Hearing process on October 20, 2009. At that Violation Hearing,the Board of County Commissioners referred this case to the County Attorney's Office, but delayed legal action for 30 days (11/23/09). Since this violation has already been filed in District Court(10-CV-78), investigation fees are required. Complaint submitted by a Planner. A Stipulated timeline has been approved by Judge Maus in reference to the above violation. As previously mentioned in our letter dated August 11, 2010 this proposal does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S. Therefore, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or the physical availability of water. The Applicant indicated that the water source for the property is currently provided by two existing wells, permit nos. 124133-A and 195192-A. • In our previous letter dated August 11, 2010 we indicated that since the original well permit no. 124133 was constructed and put to beneficial use prior to 1972, the use of the well, in addition to serving an existing family dwelling, could have included irrigation of home lawns/gardens and the watering of domestic animals. Also, according to the conditions of approval of the replacement permit no. 195192-A, the historic use of ground water from this well was clarified as ordinary household purposes inside a single-family dwelling, the irrigation of not more than 15,000 square-feet of home garden and lawns, and the watering of domestic animals. Based on the additional information provided, the proposed construction company will not employ any people at this site, and there will be no customers visiting the site. As long as the construction company will be operated solely by the property owner and no customers will visit the site, the wells constructed under well permit nos. 124133-A and 195192-A can be used to supply the property for the permitted uses. However, if the proposed construction company begins to employ people at the site, or have customers visit the site, we will view this as a commercial business that requires a commercial well permit and well permit nos. 124133-A and 195192-A could no longer be used to supply water to the property. At that time the Applicant would need to obtain a well permit for commercial use. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or the physical availability of water. • The referral information indicated that water for the water source for the property is currently provided by two existing wells, permit nos. 124133-A and 195192-A. The original permit no. 124133, was late registered in accordance with C.R.S. 37-92-602(5) on February 26, 1982 for the historical use of this well, being a well producing 13 gallons per minute and used for domestic purposes. On the same date, permit no. 124133-A was approved for the replacement of the existing well on the condition that the old well is plugged and abandoned. In addition , the registration of decreed existing well was approved in accordance with C.R.S. 37-92- 304(8) on May 22, 1996 and assigned permit no. 195192, for the historical use of this well, being a well producing 13.5 gallons per minute and used for domestic purposes. On the same date, permit no. 195192-A was approved for the replacement of the existing well on the condition that the old well is plugged and abandoned. Note that the use of the ground water for wells constructed and put to beneficial use prior to May 8, 1972 is limited to the uses that can reasonably be shown to have existed as of May 8, 1972 or the uses that can reasonably be shown to have been intended as of May 8, 1972 (provided such uses do not exceed the statutory use limits for a residential well as specified by CRS 37-92-602(1), which allows for up to three single-family dwellings, the watering of domestic animals and livestock, and the irrigation of not more than one acre of home lawn and garden). Since the original well permit no. 124133 was constructed and put to beneficial use prior to 1972, the use of the well, in addition to serving an existing family dwelling, could have included irrigation of home lawns/gardens and the watering of domestic animals. Therefore, the Applicant will need to obtain a commercial well permit for the well(s) that will be used to supply this development, that allow the water to be used for the proposed uses.
