Site of existing USR-1458 Kenneth Shannon Dear Mr. Silva: Staff has reviewed the details of your proposed use for the site referenced above. The request to store explosives has been determined to be an expansion of the existing Use by Special Review permit (USR-1458), which was approved by the Board of County Commissioners on May 13, 2005 for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility. As indicated in Section 23-2-280 of the Weld County Code, uses on a USR site are limited to those shown on the Special Review plan map and accompanying Development Standards. Major changes to either of these require an amendment to the permit by the Planning Commission, with approval by the Board of County Commissioners. In an effort to accommodate any delays from processing this required amendment to the existing USR, staff will recommend approval of a Pre-Advertisement before the County Commissioner hearing. This will allow for the Commissioners' hearing to take place shortly after the Planning Commission hearing. Requests for Pre-Advertisement can be made by providing a letter of request and a $100 processing fee. You may also request an early release of any Building Permits that might be required in conjunction with use of the site. This early release, however, would be at your risk, if changes become required during the processing of the USR. This amendment has been determined to be a major change to an existing USR, an administrative determination made under the authorization of Section 23-2-280 of the Weld County Code. As detailed in Section 23-6-20, you have the right to request a review of this decision by the Board of Adjustment, if such request is made within 30 days. Please see the attached BOA Submittal Checklist for the process and materials for filing an appeal. Also attached is a copy of a Procedural Guide for a Use by Special Review application. Condition 1D Water well Well permit number 261608 indicates that the site is serviced with a commmercial well. This condition is resolved and can be removed. Condition 1 E. Aboveground Storage Tanks Installation of the storage tanks will take place at a later time ranging from approximately one year to ten years, according to information supplied by Mr. Claps. The applicant are requesting relief of obtaining permits prior to recording the plat. The applicant's agree to contact EHS when the installation of storage tanks and proper permits are in place. Since this may not take place for several years this condition is causing a hardship on the applicant release of the plat. This condition can be removed with the understanding from the applicant that EHS will be contacted regarding the storage tanks and proper permits will be provided at that time. We have made all of the corrections you recently noted on or about March 13. We only have one minor clarification needed concerning the access points to each of the properties. In the resolution from our meeting with the County Commissioners,there are several specific features they had requested concerning the access points. The minimum standards among other things were set as follows;road width of at least 24 feet and road length of at least 50 feet and most importantly having adequate turning radiuses to accommodate two-way traffic.On our original submittal to you, we accidentally sent you a drawing that was of the minimum size and we realize that it would be acceptable but we feel that we need to be better on making an adequate area. So the question remains, is the minimum size of 24' by 50' adequate to support turning radiuses and to accommodate So-way traffic? To consider the facts we must first start with the sire and type of vehicles that will be using this access on a daily basis. With these semi tractor-trailers that have dimensions of nearly 9' wide and 60' long,you can quickly see that a 50' long driveway would leave up to 10' of the trailer hanging out in the future right of way. Because we saw this as a public safety hazard we extended the driveway to 67.5' from the future ROW. Similarly, consider the width of a single tractor-trailer, which when driving straight can pass reasonably through a width of 12• which is half of the 24° minimum figure for two-way traffic. However when a person considers the enormous turning radius of a 60' vehicle including tail spin and dog tracking it becomes obvious that a 12' roadway is grossly inadequate. As you know the only traffic that passes through these gates will be turning. Although we realize that this would be an additional financial burden for the additional Concrete or Asphalt on the driveway, we feel that protecting the public safety by not double turning into or out of the access points, will be well worth the costs. This full sized driveway will also cut down on the potential property and vehicle damage that may occur when a semi is forced to drive over landscaping or bump into fences. As per your request we have installed some very nice looking landscaping in the entryway.It is the new landscaping detail that you saw on the plans. The landscaping uses a reasonable amount of space and we feel that it will not have a negative effect on the safety of the intersection by allowing only 43' at the access point per lane. We did note that you corrected the fact that the surface needs to be asphalt or concrete and we will and have complied with this requirement. So in closing we would like to respectfully request that you allow us to stay with the same landscape detail recently submitted with the correction of concrete or asphalt as a surface. These gauges are not suitable for winged slats. You can use the lock-top pvc slats.
