Subject: Conditions of Approval, Subdivision Exemption, SE-1154
Dear James Younger:
On September 28, 2009 your application for a Subdivision Exemption, SE-1154 was administratively
approved by the Weld County Department of Planning Services with specific Conditions of Approval.
One of the required Conditions of Approval grants the applicants sixty (60) days to submit a Mylar Plat. In
addition to the Mylar Plat all conditions outlined in the staff report needs to be completed. Should you choose
not to complete the Subdivision Exemption, SE-1154 process and provide the required Mylar Plat, the
Department of Planning Services will need to be notified in writing of your decision to withdraw the application.
Planning Services Staff is aware of the difficulty and associated delays in meeting the Conditions of Approval
normally associated with land use cases, and is willing to work with you in completing your request. Please
notify the Department of Planning Services, in writing,within 10 working days of your decision to complete the
Subdivision Exemption, SE-1154 within the next 30 days or withdraw.
If you chose to withdraw the application please sign and date the enclosed form and return to the Weld
County Department of Planning Services, Attention: Kim Ogle, 1555 North 17th Avenue, Greeley, CO
80631.
If you are unable to meet the Conditions of Approval and record the plat within 30 days of the date of this
letter your case will be scheduled for a hearing before the Weld County Board of County Commissioners

On April 29, 2010,an evaluation of the existing individual sewage disposal system at:
18284 County Road 12, Fort Lupton,Colorado;
Section 07,Township 01 North, Range 65 West,
was conducted by Lauren Light,an Environmental Health Specialist of this department.
The existing individual sewage disposal system is of sufficient size and capacity to adequately handle the
proposed load. This evaluation is based on a final treatment capacity for a 3 bedroom residence.
Be advised, neither the County of Weld nor any of its agents or employees undertake or assume any
liability to the owner of the above property,to any purchaser of the above property or to any lending agency
making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and for
detecting health hazards observable at the time of inspection. This does not constitute a warranty that the
system is without flaw or that it will continue to function in the future. Inspections requested during
periods of snow cover and high soil saturation may be of questionable value to potential buyers due to
adverse conditions. Evaluations based on Statements of Existing(S.O.E.)relies on information the
property owner provides, under oath, indicating current status of the system and representing to the best of
his/her knowledge the system is not failing to function properly.

Conditions of Approval for RE-4966 & SE-1154 and both the Recorded Exemption (RE-4966)
and Subdivision Exemption (SE-1154) plats are submitted, reviewed and approved for recording
and recorded, this case will be closed and the above referenced hearing will be cancelled.

This hearing will take place in the County Commissioners Hearing Room, first floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a

Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy
