WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land being
the property of Robert G. Stroman and Doris V. Stroman, husband and
wife, Route 4, Greeley, Colorado, and more particularly described as
follows:
That portion of the Southwest Quarter of Section
26, Township 5 North, Range 65 West of the 6th
Principal Meridian, County of Weld, State of
Colorado, more particularly described as follows:
Beginning at the Southwest corner of said Section;
thence along the South line of said Southwest
Quarter East 30. 00 feet; thence North 0°16'23"
West 191. 00 feet; thence South 53°28'40" East
320. 93 feet to the South line of said Southwest
Quarter; thence along said South line East 2348. 92
feet to the Southeast corner of said Southwest
Quarter; thence along the North South center line
of said Section North 0°18'57" West 2398. 62 feet
to the Southerly right of way line of the Union
Pacific Railroad; thence along said right of way
line the following courses: South 69°20'34" West
1405. 15 feet to the West line of said Southwest
Quarter; thence along said West line South 0°16'23"
East 1193. 95 feet more or less to the point of
beginning. The above described parcel is subject
to a 30. 00 foot wide reservation of Right of Way
for County Roads along the Westerly and Southerly
sides thereof.
The above described parcel contains a gross acreage
of 108. 11 acres more or less,
does not come within the purview of the definition of theterms "subdivision"
and "subdivided lands" as set forth in 1973 C.R.S. 30-28-101 (10), as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission,
and having been fully informed, now desires to exempt this particular
division of land pursuant to its authority under 1973 C.R. S. 30-28-101
(10) (d), as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Robert G. Stroman and Doris V. Stroman,
husband and wife, Route 4, Greeley, Colorado, be exempted from the
definition of the terms "subdivision" and "subdivided lands" as provided
for in the new Weld County Subdivision Regulations at Section 2-1, A. ,

(3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 5th day of November, A. D. ,
1975.

Dear Sirs:
This letter is in reference to a request from Robert G. and Doris V.
Stroman for a Recorded Exemption on their property in part of the
SWa of Section 26, Township 5 North, Range 65 West of the 6th P.M.,
Weld County, Colorado. The proposed Lot B would be 1 .79 acres with
a 69.30 foot road frontage. The Weld County Board of Adjustment
granted a variance from the 180 foot road frontage requirement on
October 23, 1975. The main reasons for granting the variance was
that the reduced road frontage would not infringe on productive
agricultural land.
The Planning Commission staff recommends approval of this request for
the following reasons:
1 . The Intent Clause, Section 9-2 of the Weld County Subdivision
Regulations, has been met in that non-productive agricultural
lands are to be utilized.
2. All requirements of Sections 9-3 and 9-4 of the Subdivision
Regulations have been satisfied. The frontage variance
approved by the Board of Adjustment refers to Section 9-4
A (3).

at no expense to District, across Customer's Property for the purnose of installing
any pipelines constructed by District. District shall be responsible for restoring
surface area back to reasonable condition at District cost.
6. It is further mutually agreed that this agreement shall extend to and be .
binding upon the heirs, executors, administrators and assigns of the parties hereto.

9-4 Review Procedures for Recorded Exemptions from Definition of
"Subdivision" or " Subdivided Land "
A . The Planner shall review the application for recorded exemption
from the definition of " subdivision " or " subdivided land " and
make his recommendations to the Board of County Commissioners .
'tip,on hearing the recommendations of the Planner and reviewing
the evidence presented in the application , the Board shall
make its decision . The Board shall not approve the exemption
of the proposed land division unless it finds the following :
(Rev . 4/ 17/74)
( 1 ) That the proposed lots are not part of a recorded ex-
emption from the definition of " subdivision " or " sub-
divided land " or a subdivision approved within less
than five (5 ) years previous ;
(2 ) That if the recorded exemption is approved , further
division of either tract or lot included in the re-
corded exemption into two (2 ) or more building sites ,
tracts or lots would not be allowed within a five ( 5 )
year period ; such five (5 ) year period being defined
as that period commencing upon the date of approval of
the most recent recorded exemption on the parcel of
land in question and extending five (5 ) years after
the date of such approval ; (Rev . 4/17/74 )
(3 ) That the lots resulting from the proposed land division
shall be accessible from an existing public road with
a minimum frontage in conformance with the Weld County
Zoning Resolution ;
(4) That the proposed lots will have access to an adequate
water supply ;
(5 ) That the proposed lots will have access to an adequate
means for the disposal of sewage ;
(6 ) That the original tract or parcel of land to be divided
under this Section meets the minimum lot size require-
ments established by the Weld County Zoning Resolution ;
variance from this requirement being allowed only upon
good cause being shown to the Board of County Commissioners
or where said tract or parcel of land lies within the
comprehensive plan area of an existing incorporated
town of Weld County . (Rev . 4/17/74 )
(7 ) That the minimum size of any building site , tract or
lot created by such land division shall not be less
than one ( 1 ) acre , except where smaller lot sizes are
allowed in a specific zoning district : (Rev . 4/ 17/74 )
(8) That the proposed land division is in compliance with
the Weld County Comprehensive Plan ;
(9 ) That said land division does not interfere with or lie
within major floodways or drainage courses ;
( 101 That the method of disposition described in this Section
9 is not being adopted by the applicant for the purpose
of evading the requirements and intent of the Weld County
Subdivision Regulations . (Rev . 4/17/74 )
9-5 Violations - Further division of building sites , tracts or lot
defined by an approved recorded exemption into additional building
sites , tracts or lots within five (5 ) years from the date of
approval of said recorded exemption , shall constitute a viola-
tion of the Weld County Subdivision Regulations . ( Rev . 4/ 17/74 )
