RE: RECORDED EXEMPTION NO. 272 - FRED ARENS , JR.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
onihe 29th day of August, 1977 , in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Fred Arens, Jr. , located
seven miles east of Peckham, Colorado, described as the E2 of
Section 23, Township 4 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, more particularly described as follows :
The East Half (E') of Section 23, Township 4
North, Range 65 West of the 6th P.M. , Weld
County, Colorado.
Said described parcel of land contains 320 acres ,
more or less , including a strip of ground 30 feet
in width along the North, South and East, lines
of said described parcel of land reserved for County
Road ROW purposes and is subject to any rights-of-
way or other easements as recorded by instruments
of record or as now existing on said described
parcel of land.
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-
28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Fred Arens , Jr. , be exempt from
the definition of the terms, "Subdivision" and "subdivided land"

RE: Recorded Exemption #272
Dear Commissioners:
The attached application, plat, and related items are in reference
to a request by Fred Arens, Jr. for a recorded exemption. The
parcel of land in question is descrbed as the Ee of Section 23,
T4N, R65W of the 6th p.m. , Weld County, Colorado. Said property
is located seven miles east of Peckham. The subject property
contains 320 acres of Class I and III irrigated soils.
The request is to split the property into parcels of 5 acres and
315 acres. Presently there are no improvements on either of the
two proposed parcels. As stated in a letter dated August 8, 1977,
it is Mr. Arens desire to convey the five acre parcel to his son
and daughter-in-law as a new home site. Additionally, Mr. Arens
has indicated he intends to install sprinkler systems over the
half section in question. As a result of this, the five acre
parcel Mr. Arens desires to convey to his son would be outside of
the area covered by the pivot irrigation systems and thereby
become unproductive ground. Additionally, Mr. Arens has indicated
that his son is involved with his farming operations.
Based upon the information submitted and the adopted policies in
the county, the Department of Planning Services staff recommends
the request be approved for the following reasons :
1. The proposed split conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricultural

Districts (Section 3. 3(A) of the Weld County Zoning Resolution) ,
and the Weld County Comprehensive Plan since the use would be
compatible with the surrounding agricultural uses.
2. The request complies with the provisions of Section 9-4(A) of
the Weld County Subdivision Regulations.
