RE: APPROVE ACCEPTANCE OF DEED OF DEDICATION FOR RIGHT-OF-WAY ALONG
STATE HIGHWAY 392 BETWEEN COUNTY ROADS 74 AND 69 AND AUTHORIZE CHAIR
TO SIGN - RODNEY WILSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Deed of Dedication to the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Department of Planning Services, from Rodney Wilson, 37900 County Road 61, Eaton,
Colorado 80615, with terms and conditions being as stated in said Deed of Dedication, and
WHEREAS, after review, the Board deems it advisable to accept said Deed of Dedication, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Deed of Dedication to the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Planning Services, and Rodney Wilson, be, and hereby is, accepted.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said Deed of Dedication.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 6th day of December, A.D., 2010.

DEED OF DEDICATION
KNOW ALL MEN BY THESE PRESENTS that Rodney 645 on , whose address is

in Weld County, Colorado, which is described in the attached exhibit"A", do hereby dedicate
forever said property as parts of a public highway, pursuant to Colorado Revised Statute 43-2-
201(1)(a), free and clear of all liens and encumbrances, except existing easements, and warrants
title to the same.
EXCEPT RESERVING UNTO OWNERS the mineral estate under the Right of Way,
including oil, gas and any and all water rights currently attached or associated with the Right of
Way.

A parcel of land lying in the Southeast one-quarter(SE 'A)of Section 34,Township 7 North,
Range 63 West,of the 6th Principal Meridian, County of Weld, State of Colorado,described as
follows:
Beginning at the southeast corner of Lot A, RECORDED EXEMPTION NO. 0713-344 RE
5008,Weld County Records,the TRUE POINT OF BEGINNING:
thence northeasterly along the east line of said Lot A the following two (2)courses:
I —N 45°36'40"E, 544.07 feet;
2—N 25°16'15"E, 136.36 feet to the west right-of-way line of County Road 69;
thence S 00°27'29"W, 92.93 feet along said west right-of-way line to the northwesterly line of
that parcel of land as described in Book 300,Page 78,Weld County Records;
thence S 45°36'40"W, 587.60 feet along said northwesterly line to the north right-of-way line of
County Road 74;
