RESOLUTION RE: GRANT PERMIT FOR TEMPORARY ASSEMBLY TO WORSHIP AND THE WORD MOVEMENT, CIO LUKE BODLEY-JULY 30, 31, AND AUGUST 1, 2010 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Worship and the Word Movement, do Luke Bodley, 611 Pheasant View Court, P.O. Box 111, Frederick, Colorado 80530, has presented to the Board of County Commissioners an application for a Permit for Temporary Assembly on land within the unincorporated portion of the County of Weld, State of Colorado, to be held on July 30, 31, and August 1, 2010, on property described as follows: Lot B of Recorded Exemption #1389, being part of the NW1/4; and part of the NE1/4; both in Section 5, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant has paid Weld County the sum of ONE-HUNDRED DOLLARS ($100.00) for said Weld County Permit for Temporary Assembly, and WHEREAS, having examined said application, the Board deems it appropriate to grant a Weld County Permit for Temporary Assembly to Worship and the Word Movement,c/o Luke Bodley, conditional upon the following: 1. The applicant shall submit a Traffic Control Plan to the Weld County Department of Public Works, for review and approval, no later than July 1, 2010. 2. V 1 i LICENSE AGREEMENT THIS LICENSE AGREEMENT (this "Agreement") is made and entered into as of May 6, 2010, by and between LifeBridge Christian Church, a Colorado nonprofit corporation("Licensor"), and WORSHIP AND THE WORD MOVEMENT, a Colorado non-profit corporation ("Licensee"). RECITALS This Agreement is made with respect to the following facts: A. Licensor is the owner of certain real property depicted on Exhibit A attached hereto and incorporated herein by this reference (the"Property"). B. Licensee desires to obtain a license from Licensor to enter upon and use the Property and Licensor has agreed to grant such license upon the terms and provisions set forth in this Agreement. AGREEMENT In consideration of the mutual promises and agreements set forth below, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows: 1. Grant of License. Licensor hereby grants to Licensee a revocable license (the "License"), subject to all applicable laws and all of the terms and provisions of this Agreement, for Licensee and its employees, agents, representatives, contractors, licensees and invitees (collectively, "Licensee's Parties") to enter upon the Property for the Permitted Use(as hereinafter defined). 2. Term. The term of this Agreement(the "Term") shall be for the period of July 1 2010, through August 15th, 2010. The date of July 31 2010 shall hereinafter be referred to as the"Event Date." 3. Use of Property. Subject to all applicable laws and the terms and conditions of this Agreement, Licensee and Licensee's Parties shall have the right to access the Property at all times during the Event Date for the purposes of vehicular access and parking (the "Permitted Use"). Notwithstanding the foregoing, Licensee shall be permitted to enter the Property (i) on the first day of the Term for purposes of erecting barricades or any other reasonable temporary barriers and/or signs for parking, and (ii) on the last day of the Term for purposes of removing all trash and debris from the Property and repairing any damage to the Property. Licensee agrees, prior to the expiration of the Term, to remove any and all trash and debris from the Property and to repair any damage to the Property incurred during the Term as a result of the Permitted Use. The Property shall be restored to its condition prior to the use by Licensee. To determine the condition of the Property prior to the use by Licensee, the parties agree to meet at the property on July 1, 2010 to walk the property and to make written notes about the condition of the property. The parties will also take pictures of the Property on that date. 4. Security Deposit. Licensee agrees to give Licensor a security deposit to insure Licensee's compliance with the terms of this Agreement in the amount of$0.00. In the event of Licensee's compliance with the terms of this Agreement, then Licensor agrees to return said deposit on or before September 15,2010. In the event that Licensor determines there is a good faith basis to keep all or a portion of the security deposit, then, in that event, Licensor will {00166908.000/t} send Licensee a written statement by September 15, 2010, stating the basis for retention of the security deposit 5. Insurance. For the period of time from July 1, 2010 until August 15, 2010 Licensee will provide and keep in force commercial general liability insurance covering claims arising out of the ownership, operation, maintenance, condition or use of the Property, for personal and bodily injury and death, and damage to others' property, with limits of not less than $2,000,000.00 for any one accident or occurrence. Licensor will be named as an additional insured in the policy providing such liability insurance, which will include cross liability and severability of interests clauses. In addition, Licensee will provide and keep in force all risk fire and extended coverage insurance (including standard extended endorsement perils, leakage from fire protective devices and other water damage) covering loss or damage to the improvements on a full replacement cost basis, excluding existing architectural and engineering fees, undamaged excavation, footings and foundations. Licensee will file with Licensor, on or before the date that is 30 days after the date of this Agreement and at least 10 days before the expiration date of expiring policies, such copies of either current policies or certificates, or other proofs, as may be reasonably required to establish that the insurance coverage required hereunder is in effect from time to time. 6. Assumption of Risk; Indemnification. Licensee assumes any and all risk involved in the use of the Property and Licensee shall indemnify, defend and hold Licensor harmless from and against any and all loss, claims, actions, liens, proceedings, liability, damage, cost or expense, including, but not limited to, reasonable attorneys' fees, costs and expenses, resulting from the death or bodily injury of any person, claims from material men or laborers, or from the physical damage to any property, arising from or in connection with the exercise by Licensee and Licensee's Parties of the rights under the license granted hereunder, including Licensee's or Licensee's Parties' entry or presence upon the Property, or Licensee's or Licensee's Parties' activities thereon. Licensee's obligations under this Section 5 shall survive the expiration of the Term provided there have been no violations of this Agreement 7. Compliance with Laws. Licensee agrees to comply with all rules, regulations, ordinances, statutes, agreements, resolutions and requirements between Licensee and any governmental entity. 8. Hazardous Materials. Licensee and Licensee's Parties will not store, use or dispose of any substances, chemicals or other materials declared to be, or regulated as, hazardous or toxic under any applicable law ("Hazardous Materials") on the Property or transport any Hazardous Materials to or from the Property. 9. Notices. All notices required or permitted under this Agreement must be in writing and will only be deemed properly given and received (a)when actually given and received, if delivered in person to a party who acknowledges receipt in writing; or (b) three (3) business days after deposit in the United States mail, certified or registered mail with return receipt requested and postage prepaid. Licensee will not cause this Agreement to be recorded without the prior written consent of Licensor and, in the event this Agreement is recorded by Licensee without the prior written consent of Licensor, the License will automatically terminate. 12. Assignment. Licensee may not assign any of their rights or delegate any of its obligations under this Agreement without Licensor's consent, which consent may be withheld in Licensor's sole discretion. 13. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado. 14. Entire Agreement. This Agreement constitutes the entire agreement between the parties relating to the subject matter hereof and there are no prior or contemporaneous agreements, either oral or written,relating to the subject matter hereof except as expressly set forth herein. 15. Waiver; Amendment. No waiver of any of the provisions of this Agreement shall be valid unless in writing and signed by the party against whom it is sought to be enforced. No change or modification of this Agreement shall be valid unless the same is in writing and signed by the parties hereto. 16. Severability. If any term or provision of this Agreement is found by any court of competent jurisdiction to be unenforceable or otherwise contrary to applicable law, such provision shall be deemed to be severed herefrom and the remaining terms and provisions of this Agreement shall be enforced to the fullest extent permitted by applicable law. 17. Binding Effect. General Overview of Heaven Fest Heaven Fest is a Christian Music Festival happening in Longmont, Colorado on Saturday, July 31 2010. The purpose of the Music Festival is to provide a fun day of activities for teen, young adults and families, and to promote, raise awareness and raise money for various causes. On Friday, July 30 2010, the people who are camping will arrive to set-up their campsites and to enjoy the day with their family and friends. On the day of Saturday, July 31 2010, the music festival will occur. 7 stages of music will be located around the festival Grounds. There will also be skateboard demonstrations, an art gallery, food and merchandise vendors, and comedy. An estimated crowd of 30,000 people is expected to attend on this day. The goal is to raise $50,000 for various social causes. Heaven Fest was first held in Brighton, CO on July 26th 2008 and hosted over 12,000 people. Heaven Fest successfully took place again on August 8th 2009 and nearly doubled in size to over 23,000 people. We made a proactive effort to recycle what could be recycled by placing recycling bins next to regular waster bins. We brought in 2 Recycling Roll-Off containers to place all of the trash to be recycled. We also encouraged all of our vendors to use chlorine-free, biodegradable paper towels, napkins and utensils and environmentally- friendly containers(such as paper instead of polystyrene packaging or food containers). Retail Over 30 Restaurants served food and over 120 Vendors and Exhibitors in 2009. All we're required to pay the applicable state and city sales tax from the sales that were made. Permitted items are to include: - Set-up for the event from July 26th 2010-July 30`h 2010 - Any and all General Festival activities happening on Friday,July 30th 2010 and Saturday,July 31st 2010 - Loud Noise permit on Friday,July 30th 2010 from Noon— 10pm for sound checking - Overnight Camping on the night of Friday,July 30`h 2010 - Loud noise permit on Saturday July 31s`2010 from 10AM—Midnight - Overnight Camping on the night of Saturday,July 315` - Tear-down for the event from August 1th 2010—August 6`h 2010 10 HEAVENFEST MITAGATION : Heaven Fest 2010 Mitigation Plan The following is a list of questions and concerns that have been raised regarding Heaven Fest 2010 and how we plan to address them. Festival Logistics Attendance How many people do you expect to attend Heaven Fest We expect around 30,000 people to attend the festival. We have room to park 55,000+ people, and the festival grounds can comfortable fit over 150,000 people, so there is more than enough room for everyone. Camping How many people do you expect to camp at the festival? Compared to the expected attendance of the festival,the camping will be minimal. We have room for around 1400 campsites on the festival grounds equally around 3,000-4,000 people. From when to when will people be allowed to camp? People will be allowed to arrive on Friday as early as 2:00pm to set-up their campsite.The campers are asked to leave no later than Noon on Sunday. What If You Sell Out of All Your Camping Spaces? If we sell out,then we will direct people to the local Longmont hotels. We do not have any plans for overflow camping. What happens if there is a fire or emergency? The camping area can be accessed by one ingress point. One is on County Road 26 and the other is on County Road 3 1/2 just north of the railroad tracks. We will have camping security personal in the camping area at all times and will be able to communicate with emergency services should the need arise. Communication What infrastructure do you have in place for Communication? Our core leadership team which consists of about 100 people will have radios on the day of the event. The radios have 12 channels and are all ear-marked for specific departments. We also share some of our radios with on-site traffic and emergency personnel to make communication easier between the different organizations. Dust 12 Will dust be an issue at the festival? Dust should only be an issue on the dirt roads leading up to the event and on County Roads 3 Y and 26. What plans do you have in place to mitigate the dust that will be kicked up the cars? We are creating an official route for our festival attendees to follow. Food How will the people eat on the day of the event? People are allowed to bring small coolers with approved food and drink items. Food vendors will also be at the festival selling all kinds of snacks,entrees, deserts and drinks for a price. Parking What is the car to person ratio at your festival? It is roughly 2.9 people per car How many cars do you expect to park? We are expecting around 30,000 people and so we are expecting roughly 10,000 cars Do you have Room For That Many Cars? Yes, currently we have capacity to park 14,000+cars on the property that we have secured for the festival. Port-O-Lets/Restrooms How many Port-O-Lets will you have? The typical rule of thumb is to have 1 port-o-let for every 100 people. Since we are expecting 30,000 people we plan to have a total of 300 port-o-lets on-site. How is the solid and liquid waste disposed of? Our port-o-lets are provided by United Site Services.After the festival, United Site Services will pick up all of our port-o-lets and take them to their recycling plant.The solid waste is put onto drying beds and then eventually becomes fertilizer for local farms.The liquid waste is purified in an ultra-violet cleaning process before it is put back into the clean water cycle. United Site Services meets all local, state and federal clean water requirements. Security Will you have security at the festival? 13 Yes,we use a mix of Off-Duty Police officers and a large Volunteer security team to keep the event a safe one for all attendees How much crime/disturbances do you anticipate? We have a zero incident history at our festival. Meaning we have never had any arrests occur.The crowd at the festival is typically very pleasant and respectful. Alcohol is not served which is a large factor. Size/Capacity Can the event property event hold 30.000 people? Yes,the event property can comfortably hold over 150,000 people. Is the property even suitable to host such a large event such as Heaven Fest? Yes,the event property was picked out of many other locations for reasons such as size, emergency vehicle access, distance from an International Airport, infrastructure and other logistics. Sound When will amplified sound be played from the stages? There will be a sound check the night before the festival which will last for around an hour.Then on the day of the event, bands will play from Noon until midnight. How will the sound affect the local neighborhoods and houses? The sound system we use on the Main Stage is a very technologically advanced system that can be tilted,turned and directed to the exact degrees we need them to. We expect the sound decibel readings to be below 70 decibels where the Longview and Elms subdivisions are. Will You Measure the Decibel Readings This Year? Yes,we will hire a 3r°-Party sound expert to come and take sound decibel readings at various places at the festival and at various times to document the noise levels. Traffic What will Hwy 119 look like on the day of the event? Message Boards will be placed along Hwy 119 informing people about the event.These message boards will be placed a minimum of 72 hours before the event. On the day of the event the message boards will instruct thru-traffic to use the left lane, and the festival traffic to use the right lane. What about Traffic coming from The West from Longmont? Traffic coming from Longmont to the festival will come east down Hwy 119 to County Road 3 1/2 and make a left-hand turn where the officers will be running traffic control. 14 Where do you anticipate the traffic coming from? We estimate 95%of the Traffic will be coming from the Westbound lane on HWY 119. We estimate 3% will be coming from the North via Weld County, and even smaller percentage, 2%, will be coming from the Longmont and Boulder areas. What kind of Event Signage will you use to direct Traffic? We use different kinds of signage to help direct people to the proper place. The first is using large message boards, placed prior to the event to alert people to the upcoming event and then to help direct the festival traffic to the correct place. We also use directional signage placed every quarter-mile on different roads. Other large banners are used in different places to tell people not to enter a street or that the street is festival-traffic only. Trash/Recycling What is your plan to handle the trash and waste at the festival? Generally,we are partnered with United Site Services. United Site Services provides both trash and recycling roll-off containers and waste bins. Our Maintenance Module then is in charge of emptying the trash and recycling bins during the day to keep them from overflowing.After the event,the Maintenance team is in charge of walking the entire festival grounds to clean up any trash that has been left on the ground. What if it's windy and the trash is carried to other properties If it is windy, and we see that trash has blown into other properties, we will first ask permission from the property owner to go and clean-up the trash. Our clean-up team will be instructed to clean up every piece of trash that has blown into other properties. How will you handle items that can be recycled? Items placed in the recycling bin will be hauled off by United Site Services to single stream recycling center to be recycled. We have also begun conversations with eco-cycle on how we can work together to make this a greener festival. Safety/Health Emergencies/Natural Disasters/Mass Evacuations Will you monitor weather during the event? 15 Yes,we have an Administration Trailer Backstage that is equipped with laptops and internet connections.The Health and Safety Module is in charge of periodically checking the weather during the day. What happens if a tornado warning goes into effect for the area of the festival? If there is a tornado warning in the area,we will cancel the festival and activate our emergency evacuation plan. What is the procedure for the Fire Department to take command if there is a multi-patient incident? The final word for the Fire Department to assume control of the event will come from the Festival Executive Team.The Executive Team is equipped with Cell Phones and Radios and will be able to be easily contacted to make spur of the moment decisions to ensure the safety of everyone at the event. Fire What happens if there is a fire? This depends on where the fire occurs and how large it is. We have fire extinguishers located are various areas of the festival and can be used to put out smaller fires. If the fire is larger,then Longmont Fire will get involved. We are working with Longmont Fire to decide how to best staff the event on the day of, and to whether or not it will be appropriate to have an engine on-site. Ambulances/First Aid What happens is someone is injured on the day of the event? We have paramedics, doctors, nurses and ambulances on-site. If the situation merits it,the person will be transported either by ambulance or by Helicopter to the nearest hospital for further treatment. If all of our ambulances become unavailable,then we will activate the 911 system to utilize Longmont emergency services. Who will pay the police officers to be at Heaven Fest? Heaven Fest will pay off-duty rates to all Police Officers required for Traffic Control and Security on the festival Grounds Who will pay for the Ambulances and Paramedics to be at Heaven Fest? Heaven Fest employs a private ambulance company named "Stadium Medical".They will be in charge of supplying all ambulances and paramedics to handle Medical emergencies on the day of the event. Heat/Shade/Water It can get pretty hot in the summertime, how will you make sure a lot of people don't get dehydrated or get heat exhaustion? 16 The first thing we do is provide free drinking water at various places around the festival.The festival retail stores also sell bottled water.There are also other vendors that sell water,soda and other various drinks. Secondly we provide shade tents and a misting area for people to cool off. Lastly,we over- communicate all day long for people to drink plenty of water and seek shade as often as possible. Property Owners Property Changes, Restoration and Remediation What kind of changes will you have to make to the property? The changes to the site will be minimal and range from taking down barbed wire fencing to putting in a culvert so that larger trucks can access the property. Will you change everything back when you are done? Yes, however some of the changes such as enlarging a culvert might want to be kept there permanently because it enhances the property. What recourse do the property owners have if the property is damaged? Heaven Fest has entered into contracts with the various land owners to commit to restore the property as it was before the event. How will you handle all of the various contracts that will be interrupted due to this event? Heaven Fest is committed to contacting, and working with all people and organizations and working through all contracts that will be interrupted due to the festival. It is Heaven Fest's desire to make each contract holder"Whole" and to come to an acceptable resolution. Commercial Benefit How will Heaven Fest benefit the local economy? Heaven Fest is expected is bring in over$700,000 in revenue to surrounding cities and counties.This does not include the food and merchandise sales that will take place at the festival itself. What businesses will see the most benefit? The brick and mortar business that will see the most benefit are local hotels, restaurants, entertainment, and gas stations. However, Heaven Fest does allow food and sales vendors to vend on the day of the event at the festival, and virtually every business in the city can come and benefit directly from the event. Local Citizens 17 How will it affect the average local citizen? Just like any typical event, local citizens will notice and above average amount of traffic.The vast majority will be heading westbound on Hwy 119 on the day of the event. Does it cost the local residents money(Tax Dollars)to host Heaven Fest? No it does not. Heaven Fest pays out of their own budget for things like off-duty Police officers and paramedics.The festival handles all of the set-up, operations,tear-down and clean up of the festival. Union Reservoir Will Union Reservoir be open to the general public during the festival? Union Reservoir will be closed to the general public from Friday,July 30 to Sunday August 1 2010. What about Season Pass Ticket Holders To Union Reservoir? We are working with Union Reservoir to make sure that the season ticket holders are made whole. Sailing Club There is a sailing club next to Union Reservoir. How will they be affected? The only day they will be affected will be from Friday,July 30 to Sunday August 1 2010. Members of the sailing club will have to access their property via Hwy 119,to County Road 3%:to County Road 26. Attendees of the festival will also be using this route to access the festival. Members of the Sailing Club will experience longer wait times to enter their property, but will not be hindered once they are on it. Hobby Town USA There is a remote control race track next to the festival property. How will they be affected? Hobby Town USA only does their races in on Sundays in the summertime and not on Saturdays. We will make sure their area is roped off and secured.They will not encounter any adverse effects. Nearby Neighborhoods How will the festival affect the local neighbors? The neighbors and neighborhoods that will be most affected is the Longview Community and about another 15 or so houses that are in close proximity the festival grounds. Some of the neighbors will be able to hear music outside of their houses on the day of the event.The vast majority of neighbors will not be able to hear the music when inside their houses. Increased traffic will mostly affect the Longview Community and houses that are directly east of the festival along county road 3'A. What is your plan to alert the neighbors of the event? 18 We will be doing a neighborhood outreach via Postal Mail to inform people of the event and give an invitation to attend an informational meeting about the festival. At the informational meeting, we will be giving general information on how the event will affect their neighborhood and answer any questions that may arise. How will the residents of Longview get in and out of their neighborhood on the day of the event? We will have Police Traffic Control at Hwy 119 and County Road 3% . Residents should expect delays in entering and exiting their neighborhood during the busiest ingress and egress times of the festival. What if a bunch of trash gets dropped in the Longview Subdivision? Our Maintenance team will be in charge of roaming the neighborhood to make sure that no trash was deposited in their neighborhood. What about The Elms Subdivision? The Elms Subdivision is located directly east of the property and is located roughly a mile and a half away from where the Main Stage will be located. Because The Elms is over a mile away, sound and noise is not expected to be a problem. Environment Can Heaven Fest be a Zero-Waste Event? In general, it is extremely hard to produce a zero-waste event that is this size. We have recycling bins, and have encouraged our vendors to use bio-degradable materials. We have also offered free water re- filling stations as an alternative to buying plastic water bottles which saves over 10,000 plastic bottles from going to the land-fill. The Benevolence of Heaven Fest Does Heaven Fest donate any of its profit? Heaven Fest is under the 501(c)3 Non-Profit ministry of Worship and the Word Movement. Worship and the Word Movement has a huge heart for the poor, orphans and marginalized of society. In 2008, we gave 100% of our profit away to various social causes. In 2009, we gave over$50,000 to places like orphanages and to Help End Homelessness in Denver. What Else Does Heaven Fest Do? We have made the ticket price "Whatever You Can Afford" which is essentially a donation so that everyone can attend and no one will be turned away. We also give away over 10,000 free tickets to urban organizations who work with people that could never afford to come to the festival. 19 Property Restoration and Remediation Plan It is the intent of Heaven Fest to restore and remediate the property used for the event. Trash Collection All trash will be picked up from the event. The day after the festival, we have a large team come and walk side by side (similar to people looking for a missing person) picking up every piece of trash that is on the ground. Property Alterations We will be making minor alterations to the property for festival operation. Some of the alterations will actually be improvements to the property and we will leave them in.There are other alterations, such as removing barbed wire fencing, which will need to be put back the way we found it. Insurance Heaven Fest obtains a $2,000,000 insurance policy for the festival and will list the City of Longmont, Weld County,various land owners,various vendors and Union Reservoir as additional insured. The policy covers damage to property such as buildings, boats, playground equipment and other various items on the property grounds.According to our policy, anywhere where we can be proven negligent, the policy will cover the damages, including costs to defend. 20 HEAVENFEST HEALTH AND SAFETY: Heaven Fest Public Health and Safety Module The purpose of the Public Health and Safety Module is to make sure from a logistical standpoint that all of city/county's requirements and concerns are followed-up on and followed throughout the day of the festival to ensure the health and safety of all of the festival attendees. Water Supply Water will be available throughout the duration of the event. We will be selling bottled water at 3 other areas on the property located conveniently. Each area selling bottled water will be instructed to give bottled water out for free to any saying that they are dehydrated. Water Mill Express (http://www.watermillexpress.com/) will be distributing free water at several locations around the festival using their stations. (Picture below). Rocks on the ground will not be needed because the water facets will be not be emptying onto the ground. Watermill Express water never exceeds 50 ppm in total dissolved solids, meaning safety and excellent taste can always be expected r. i • Exfiri•ss a lyef v 22 Communication To Festival Attendees In regards To Water and Dehydration We will be encouraging people through our website and other forms of communication to bring plenty of water and/or water bottles. Dehydration is a major concern of ours for the well being and safety of all of the festival attendees. During the day of the festival, we will through communicate through signage and announcements from the various stages, and tell people to keep hydrated and to seek shade on a constant basis. Food Food will be available throughout the duration of the event. Food vendors will be on hand to sell the events food, and will feature a variety of different choices. There will also be a hospitality room where volunteers, VIPS, and staff will be able to enjoy a food buffet. These hospitality rooms are not open to the general public and people will need special credentials to access them and eat the food therein. Temporary Food License Each Heaven Fest vendor must have all of the proper licenses and permits to sell food at the festival. If the vendors do not meet these guidelines then they will not be allowed to serve food at the festival. Port-O-Lets We will have 300 port-o-lets placed in groups strategically over the festival grounds. Port-o-lets will be near the food concessions area. These port-o-lets should be no closer than 100ft and no more than 200 ft. When placing the port-o-lets you must avoid the "L" or "Z" pattern and put the port-o- lets in straight lines. This is so that if lines for the port-o-lets accumulate that there won't be a criss-cross of lines. Hand washing units will be provided by each group of port-o-lets. Solid Waste Trash services are being provided by United Site Services. 2 trash roll-offs and 2 recycle roll-offs will be located on the property. 50+trash / recycling receptacles will be placed in various locations throughout the festival. The Maintenance team and will be in charge of monitoring these receptacles periodically and emptying them as needed so that they do not accumulate outside the bins. 23 Protection against Insects We will be encouraging people though our website and other forms of communication to help in the prevention of insect bites. This will be done by encouraging our attendees to wear long pants and to apply insect repellant in the evening to protect against insect bites. During the day of the festival, we will through communicate through signage and announcements from the various stages, telling people to keep using insect repellent. Public Health and Safety Director Job Description Prior to Heaven Fest The director of this module will be responsible for • Coordinating qualified medical volunteers to staff the First Aid Trailer • Working with the Human Resources Director for staffing • Develop protocol manual for first responders • Contact ambulance service • Write up a supply list • Coordinate supplies • Coordinate with security on ways to keep festival participants safe and secure • Contact the local hospital • Plan and print Public Health Messages • Coordinate hand washing stations and supplies • Assist Executive Team with Public Health necessities During the Event The director of this module will be responsible for • Monitoring, training and overseeing First Aid volunteers • Act as liaison between Ambulance Service Staff, HF directors and volunteers • Assist as needed in First Aid • Coordinate Manager duties • Monitor Public Safety concerns • Set up and take down First Aid Trailer Facilities First Aid will be administered in a 28'X12' air-conditioned singlewide construction trailer that consists of 3 rooms. There is no running water and no bathroom. 24 Location: Please see the Site Plan for the location of The First Aid Station Staffing The First Aid Trailer (Station) will be stocked and prepared the day before the event. Stadium Medical— Paramedic and EMT, will continually staff the First Aid Station from 10 am to 12 midnight. The Director and Manager of Public Health and Safety, plus a minimum of 4 Heaven Fest First Aid volunteers will be on the site at all times. There will also be 1-2 Public Health and Safety volunteers to provide water and basic self-administered first aid to Heaven Fest staff and volunteers. Volunteers at Heaven Fest are expected to be available for a shift of 4 hours. Manager of Public Health and Safety The manager of the PHS module for Heaven Fest will be responsible for coordinating the Public Health and Safety volunteers and providing needed hospitality supplies such as water, sunscreen and self-administered health supplies to Heaven Fest staff and volunteers. Heaven Fest Volunteers will offer first aid and preventative care in partnership with Stadium Medical. Stadium Medical will make all decisions regarding calling for transport, or other emergencies. First Aid basics will be discussed the day before the festival at a meeting and protocol will be available for review the day of the festival. Site Set up In front of the First Aid Trailer, a tent will be placed to offer a hand washing and ice water cooling station under shade. The trailer itself will be stocked with basic first aid materials, water, chairs, and cots. One room will be a main treatment room, a second room will be stocked with cots and a third room will be available for counseling or prayer. Public Health Messages Throughout the Heaven Fest facilities, public health messages will be displayed on posters or flyers. They will enter on our Emergency Access and Special use road. This road will not be used by the public or festival attendees. Onsite Fire Hydrant Locations Please see the Heaven Fest Site Plan for a graphical illustration Emergency Medical Services Ambulance For serious injuries we will have 2 ambulances with at least 2 Paramedics each parked at the venue all day. Ambulance service is being provided at our cost by Stadium Medial. http://www.stadiummedical.com/ If an emergency occurs and off-site transport is needed then one ambulance will be utilized for off-site transport. If two ambulances are needed then we will then call 911 and an off-site ambulance will be called in for transport. It will be the paramedics call on whether to call-in outside transport. Paramedics will be given a 2-way Radio. The radio will have 12 channels and give the paramedic a way to communicate with the festival staff if the situation should arise. First Aid Trailer For less serious injuries such as a skinned knee or a sunburn, we will have a first-aid station with at least two registered nurses (RNs) present throughout the entire event at any given time. We will have plenty of high SPF suntan location there for free for anyone that needs it, as well as all the necessary first aid items like band-aids. We will have "consent to treat" forms available for people to fill out and keep on their person so that we will be able to legally treat other minor injuries or discomforts. Misting Tent A misting tent will be located on the grounds of the festival. This area will have overhead misters. This area will have proper signage to let people know of its existence. Insurance We will have insurance covering bodily injury and liability up to $2,000,000 in aggregate and $1,000,000 per occurrence. 30 In Case Of Fire We will coordinate with the Fire Department and they will be aware of the event in case their services are needed. On The Festival Grounds • Be familiar with the grounds and environment around you • Evacuate promptly out of the area of the fire • Get on the emergency channel and say CODE FIRE and the location of the fire. Then proceed to call 911 to call the fire department. • Fire Extinguishers are located in the corners of all tents larger than 200 Sq. Ft. On-Site and Off-Site Patient Transport On-Site Patient Transport There will be a golf cart that is strictly dedicated for emergencies such as medial to transport people from wherever they are at. There are also numerous golf carts that are being used by the directors of the festival. In case of a medical emergency, any directors with Golf Carts that are close to the area of the emergency can rush thee and do patient transport as well. Off-Site Patient Transport The on-site ambulance will be dedicated to on-site treatment only. If any emergencies occur, and transport is needed to area hospitals, then 911 will be called and an off-site ambulance will be called in for transport. It will be the paramedics call on whether to call-in outside transport. Plan for Environmental Emergencies Hypothermia We recognize hypothermia as a public risk as night when our campers will be in their tents. Below is our plan for prevention and treatment. Prevention We will instruct every attendee to not wear cotton clothes but to wear synthetic clothing. Also to bring warm blankets/sleeping bags. Treatment We will be staffing the Camping Area with an RN all night to monitor the environment for safety and provide instruction if a situation occurs. Dehydration Prevention: 31 Water and Food will be available throughout the duration of the event. A company has come forward to distribute free water outside. We will also be selling bottled water at a minimum of 3 other areas on the property located conveniently. Each area selling bottled water will be instructed to give bottled water out for free to any saying that they are dehydrated. Proper communication will be given to all attendees to say hydrated throughout the day. Treatment: People experiencing dehydration will be directed to the first aid trailer to consult with an RN. The RN will be able to make the proper call on treatment or if the person needs to be taken to the hospital. The on-site paramedic will be instructed to bring enough IV fluids to be able to treat on- site dehydrations. Heat Exhaustion - For mild cases of heat exhaustion Prevention: Several tents will be on the festival grounds to provide shade from the sun. Festival attendees will be instructed to stay out of the sun for extend periods of times and to monitor their own health. The following will be posted on our event website and communicated throughout the day from the stages to prevent heat exhaustion. * Rest in a cool, shaded area. * Give cool fluids such as water or sports drinks (that will replace the salt that has been lost). Salty snacks are appropriate as tolerated. * Loosen or remove extra clothing if present * Apply cool water to skin. * Do not use an alcohol rub. * Do not give any beverages containing alcohol or caffeine. Treatment If the festival attendees start to experience heat exhaustion, they will be instructed to visit the first aid station to consult with an RN. RN will call 911 or an ambulance if they deem it necessary. Heat Stroke We will call 911 immediately or call the Ambulance on the premises * Move the person to a cooler environment, or place him or her in a cool bath of water (as long as he or she is conscious and can be attended continuously). * Alternatively, moisten the skin with lukewarm water and use a fan to blow cool air across the skin. 32 * Give cool beverages by mouth only if the person has a normal mental state and can tolerate it. In Case of Security/ Crime We will have an adequate number uniformed Police Officers present at the festival. They will be doing general walkthroughs of the festival to create an atmosphere of safety and security. We will also have a 60+ person security team in charge of keeping certain areas restricted, keeping order at the larger stages, checking wristbands so no one sneaks in, and handling any of the problems regarding the safety and security of the people attending our event. Our security will be wearing bright red vests with the word "SECURITY" in large black letters. Our security director and his security managers will be on 2-way 12-channel Radios so that they can report any crime that may occur. Incident reports forms will be required to be filled out for any incident happening during the festival. Please see our security module for more information. Cancellation of Event It will be the call of the Heaven Fest staff to officially cancel the event. With the last word coming from Dave Powers and Luke Bodley. Weather will be checked periodically to get a heads up on possible storms coming and the severity of them. Communication To Attendees Ticket holders will be notified via the indoor and outside stages if the event is officially cancelled. Volunteers Our Volunteers and Security team will be wearing clearly marked vests so that any emergency or government departments will be able to spot them. Our security will be wearing bright red vests with the word "SECURITY" in large black letters. Our volunteers will be wearing bright green vests. Means To Report an Emergency Each Heaven Fest staff member as well as directors and managers and other important people will have 2-way 12-channel Radios to communicate with. Communication Plan There is a very structured hierarchy of staff and volunteers at Heaven Fest. Going from the Executive Producer, to the Director of Operations, to the festival directors, to their managers, and finally to their volunteers. Each Heaven Fest staff member as well as directors and managers and other important people will have 2-way Motorola 12- channel Radios to communicate with. Each channel will be given to a different department. 33 We will be designating a channel for Emergency use only. In case of emergency, a "CODE RED" will be given over the other entire channel instructing our staff and directors to turn to the emergency channel for instruction to follow. The director issuing the CODE RED will then give communication about the emergency. The Director of Operations will then take over from there in communication on how to proceed and what actions need to be taken and issuing commands to all the directors on how they need to proceed. As a backup, a cell-phone information sheet will be given to all staff, directors and managers with the cell phone number of every staff member, director and manager. Please see the "Radio Communication Plan"for a detailed list of the radio channels used ***If requested, government officials are to be given the same 2-way radios that we are using so that they can communicate with us as they wish. Each volunteer will be given instructions on the Public Health and Safety Plan before they begin their duties. Our written Public Health and Safety Plan will be given in writing to every volunteer. 34 Emergency Evacuation Plan The purpose of the Emergency Evacuation Plan is bring all of our festival attendees to a place of safety and out of the way of immediate danger. Incident Command System The details of how to ICS integrates into the festival is to be determined by the festival staff and Dan Eamon of the Longmont Fire Department. Fire Department Partnership Procedure The Fire Department will work with Festival staff in the event of a massive accident, catastrophe or natural disaster that is threatening the lives of our attendees. The final word for the Fire Department to assume control of the event will come from the Festival Executive Team.The Executive Team is equipped with Cell Phones and Radios and will be able to be easily contacted to make spur of the moment decisions to ensure the safety of everyone at the event. In Case Of Rain/Lightning/Hail Light/Regular Rain Since we have made all of the areas resistant to light and regular rain, no action will be taken. Consistent with this time of year we expect it to have some light showers in the afternoon. Torrential Rain/Lightning/Hail If a torrential downpour occurs then people will be instructed to wait in their cars until the rain subsides. If it appears through the weather resources that the rain does not plan on stopping, then the festival will be cancelled. We will do our best to inform our attendees of the coming weather and let them make a decision on what to do. This may be to hunker down and wait until lit passes, or to leave the festival altogether. If cancelled, our parking team will handle the logistics of getting the festival attendees to their cars in an orderly manner.The volunteers will follow the lead of the managers by directing people to their cars. In Case Of Tornado In Case Of A Tornado Watch The Safety Director is in charge of monitoring the weather on a regular basis. If a tornado watch is put into effect the constant monitoring of the weather will become mandatory to find out if there will be a tornado warning. In Case OF A Tornado Warning 35 If a tornado warning within the area goes into effect then the festival will be cancelled and announcements from all the stages will be made. We will do our best to inform our attendees of the coming weather and let them make a decision on what to do. As a general rule,we want them to stay where they are. A car can be picked up and thrown. We do not want a mass evacuation because there are only so many cars that can exit in a short amount of time, and the attendees could very well end up stuck in traffic on the highway in the path of the tornado. The hey will be to give the people great information ahead of time and to let them the places where they should not go in the event of a tornado, such as in their car or inside one of the Pole tents. Human Response to Fire and Evacuations Research indicates that people unfamiliar with alarms, eg. Occupants and visitors will usually react in the following manner: • Ignore the alarm in the hope that it may be a false alarm, or the situation will resolve itself; • Complete what they are doing when the alarm occurred. Eg. people will remain in a queue, continue with a task or continue eating a meal; • Locate any family or friends before trying to evacuate; • React in a similar way to those around them; • Most people will not panic.This usually occurs only when a person thinks they have no way out of a dangerous situation and are desperate to escape; or • They will usually maintain a passive role, expecting to be told what to do by someone in authority. It is this last feature that enables a Leader to control crowd s providing they follow these guidelines. Positioning of Leaders Leaders responsible for the movement of people out of a danger area should, in the first instance, position themselves so that they are: • Clearly visible; • Not exposing themselves or any other person to danger; and • Able to exercise control over persons leaving the area Movement Control Leaders should direct persons towards the exits using: • A calm but firm voice; and • Smooth and commanding hand signals • In directing crowds, leaders should use such terms as: • "This way please"; • "Move quickly over there"; or • "Quickly move that way" 36 Summary Words such as, "HURRY", "FASTER", "BOMB", and "TRAPPED" should be avoided at all costs.Jerky hand signals such as beckoning people towards you in a rapid and continuous manner should be avoided. People will obviously be bewildered and curious as to the cause of the evacuation, however, Leaders must not engage in lengthy explanations with people at exit points.The object is to quickly,calmly and safely move people out of the site. Exits must not be obstructed by persons stopping to ask questions or attempting to manhandle bulky items through exit points. 37 Emergency Announcements What Constitutes an "Emergency" Natural Disasters (tornadoes, lightening, high winds) Medical Emergencies Lost Children Unforeseen Emergency Circumstances Levels of Stage Interruption • Natural Disasters- Interrupt bands on all stages and make announcements based on the nature of what's happening. • Medical Emergencies - If a person is injured in the midst of crowds and an ambulance is unable to get through, the band should be interrupted on that stage only and crowds instructed to move out of the way. The band should only commence after the individual is safely carried away by the ambulance. • Lost Children - The first step should be that Security is alerted and an announcement should first be made to all security personnel over their radios to check their areas. After 60 minutes, if the child can still not be found, an announcement should be made from the Main Stage that the child should go to the Kidz Zone where the parent can meet them. This is if the child is 11 years old or under. Those 11 and higher, the announcement should be made at the break of the next set on all stages. • Unforeseen Emergency Circumstances-The HF Staff will make the call on when to make the announcement and to what Stages. People Authorized to Make the Call The Heaven Fest Staff(Dave &Tara Powers, Luke Bodley, Jeanie Rhoades or Tredessa Rhoades) are the only individuals authorized to make a call as to whether to make an emergency announcement or not. All individuals wanting one to be made will need direct approval from them first. Procedure for Making an Emergency Announcement The Heaven Fest Staff will alert the Stages Director that an announcement should be made, either from one particular stage or all stages. The Stages Director will then radio his Stage Manager(s) with the announcement and will let them know if they are to interrupt the band playing or wait until their set is over. 38 Fire Department Module The purpose of the Fire Department Module is to make sure that each and every requirement of the Fire Department is adhered to in a manner consistent with their expectations. The entrances of the special use road must be staffed at all times to ensure that only authorized personal and emergency vehicles and may enter. Correct signage will be applied to the entrance of the special use road consisting on a Vinyl banner measuring 4ft. wide X 2ft.Tall. Authorized personal will be issued an "Access Special Use Road" road permit for their car Authorized Personnel Includes: Upper Management Event Staff Food and Retail Vendors National Artists and their staff Emergency and Government Vehicles Any unauthorized personnel trying to enter this road will be turned away and referred to another entrance. All clippings must be removed from the field. The purpose of this is to reduce the likelihood of grass and weed fires. Parking/Vehicle Protocols Cars being parked on the grassland parking areas must have a minimum of 20 ft between vehicle aisles. There are to be no-dead-end parking rows so that cars will be able to ext from at least 2 options so they do not have to turnaround. Pyrotechnics Pyrotechnics will not be used at the 2010 event. Tents and Canopies All tents that are large enough will have both construction and operational permits. The Tent Company will provide CAD drawings of the event with all necessary safety equipment such as exit sign and fire extinguishers. Propane Use Propane storage and use shall be addressed including cylinder positioning, securing and quantity. In case of a FIRE On The Festival Grounds 41 • Be familiar with the grounds and environment around you • Evacuate promptly out of the area of the fire • Get on the emergency channel and say CODE FIRE and the location of the fire. Then proceed to call 911. • Fire Extinguishers are located in the corners of every tent Onsite Fire Hydrant Locations Please see the Heaven Fest Site Plan for a graphical illustration 42 SECURITY MODULE General Description: The purpose of the security module is to ensure the safety of our guests, staff, volunteers, bands and volunteers that will be attending our event as well as to ensure the safety of all cash that is exchanged at the event. The security team in charge of keeping certain areas restricted, keeping order at the larger stages, checking wristbands so no one sneaks in, and handling any of the problems regarding the safety and security of the people attending our event. Security Protocols 1. Rules on Drugs and Alcohol a. There is a NO tolerance rule for drugs and alcohol. b. Any person found on festival grounds with drugs or alcohol will be escorted out of the event and be 86ed c. All alcohol will be taken and any illegal substances will be reported to security manager and authorities on sight. d. If individuals refuse to leave, notify manager immediately and he will notify law enforcement. 2. Weapons, etc a. There is a NO tolerance for weapons of any kind or firecrackers. b. Weapons should be immediately reported to the Security Director so that law enforcement can be involved. It is very important for the security teams safety not to confront individuals with weapons. It is best to let the properly trained Law Enforcement deal with such issues.That is what they are there for. 3. Cameras a. Quick flash, disposable cameras, and phone cameras are ok b. Recording cameras, video cameras, and cameras with lenses that 4 in. or longer are not allowed c. If found, they will be asked to turn it off or return to car and if caught again, cameras will be taken and given back at time of exit. (clarify to individual that the 1st time is a warning and 2nd time, cameras will be taken) 4. Fights a. NO tolerance b. Step in and ask individual to stop (do not touch individuals yourself unless attacked, otherwise verbally request them to stop) c. If there is a large fight, notify manager immediately who will notify law enforcement. 5. Food a. NO coolers and or food allowed on grounds 43 b. These are to be kept in their own car 6. Off limit areas a. Yellow do not enter tape b. Backstage at any stage for any reason unless proper I.D c. Lake d. Oil rigs e. Leech Field f. If you find individuals in these areas, ask them to return to main grounds. Schedule There will be several security shifts. There will rotations of stations throughout the day. Please remain in designated areas unless you are asked to move. DO NOT approach artists for autographs/photos. We will go over these rules at the beginning of each shift and given a security shirt at that time. Communication Please see the Public Health and Safety Module CHECKLIST: Equipment: ❑ Security Safety Vest E 2-Way Radios for Director and Managers ❑ Security Credentials Job Descriptions: Security Director You will be in charge of managing the security team into strategic positions to check for wristbands. You will be the last say on what to do if any rules or lawns are broken. You will also need to place security at the main stage and the Rock stage to check for proper credentials so that no unauthorized person gets backstage. Security Manager The security mangers are placed in important strategic areas and are under the oversight of the Security Director. The Security Managers will be in charge of managing 44 all of the volunteers that are placed under and to make sure that they are trained and doing what is asked of them Security Worker The Security Worker must first get trained in the proper security, safety, and emergency protocols before beginning work. The Security Workers are under the supervision of the Security Manger and must listen and adhere to the commands from them. 45 Radio Communication Because of the amount of radios that we have, we must have an organizational plan as to how many radios each module gets and also how we communicate with each other and with the onsite Police Officers. Explanation on the Breakdown: -All Directors will get a radio. A good handful of Managers will as well, but only if they're consistently (most of the time) at a different location then the Director will be. -Radios are most important for those who need to contact back and forth regularly and won't be seeing their Director. Security and Parking will have a large amount because they're stationed all over and have to stay in the areas where they're at and are dealing with all of the festival attendees on the grounds. -If possible, please exchange cell numbers with your Managers (that don't have a radio) so that if there's a random question here and there it can be answered. Most cell phone plans have free minutes on the weekend so we're hoping that that's okay and so appreciate you all working with us on this one! Leaders of the Police/Sheriff's department running our traffic and security will also get a Heaven Fest radio to be able to easily communicate to each other and to the Heaven Fest Directors. Where do I (and my volunteers) pick up my radios? Radios will be pick-up at the Materials staging area. Radio Channel List: 1 - Emergency Channel 2 - Security Channel - If you need them, switch over to this channel to get a hold of them. 3 - Parking Channel - If you need them, switch over to this channel to get a hold of them. 4 - General Channel - EVERYONE ELSE WILL BE ON THIS CHANNEL. (Including Tredessa) 5 - Director of Operations - If you need to have an extended conversation with me, we'll switch over to this channel. All other channels - Please use these if you need to have an extended conversation with someone. Then come right back when you're done so that people aren't shouting you down on the General Channel. 46 HEAVENFEST TRAFFIC: Heaven Fest Traffic Plan The purpose of the Heaven Fest traffic plan is to safely and expediently accommodate all Heaven Fest ingress and egress traffic onto the event property and also to get all non-Heaven Fest traffic through the event area in a safe and fast manner. ***Please see the Heaven Fest Site Plan for a graphical illustration. 30,000 Expected Attendance 10,344 Expected Vehicles at 2.9 People per vehicle 14,858 Total parking spaces in parking lots 1,1418 Total Camping Spaces which fit a vehicle each General Festival Traffic Schedule 9AM—Gates open and people begin to ingress into the festival— Light to Moderate Traffic 12PM—Music Festival Officially Begins— Ingress becomes Heavy 2PM—Heaviest Ingress Time of The Day 5PM —Ingress slows down to moderate. Light ingress can be seen. 8PM—Moderate Egressing Begins 10PM—Egressing becomes Heavy 12AM—Egressing slows down to moderate 1AM—All Egress is complete Traffic Control Point Intersections: I-25 & Hwy 119 Hwy 119 and County Road 3 %3 County Road 3 A and County Road 26 Hwy 66 & I-25 (Signage to direct traffic south to HWY 119) Festival Traffic Only Roads County Road 26 from Union Reservoir east to County Road 3 %z will be closed off to the general public. People coming to the festival or members of the Sailing Club will be able to use this stretch of road. Note: County Road 26 will be blocked at Union Reservoir and no thru-traffic will be permitted to cross. Emergency Access and Special Use Road The stretch of road on County Road 26 from County Line Road 1 east to Union Reservoir will be completely closed off to traffic.This road will be used exclusively by Emergency Vehicles, Festival Staff, National Bands and Food Vendors. Signs will be placed along the road to make sure no one parks on the road,or stands or stops on it. Please see the "Traffic Control To Be Installed in Different Phases"section 48 of this document for times and locations of traffic devices.A Longmont police officer will be utilized to patrol County Road 1. Person Drop-Off and Pick-up There will be designated person off and pick up area for parents. People picking up others here will not be allowed to park for more than 3 minutes in this area.They must be waiting for them when they arrive or they will be forced to exit the property.This is similar to how airports handle their pick-up and drop- off areas. This area will be located on the south side of the South Parking lot. ADA Traffic All handi-Cap traffic will be directed to the designated parking area that is closest to the festival to accommodate their special needs. Roughly 3%or the total parking spaces have been designated for the handi-cap.The ADA nationally only requires 2%of spaces to designated as handi-capped so we meet and beat their requirements. Shuttling Some of the parking areas in the East Parking Area are more than a half mile from the festival grounds. In this case, flat-bed shuttles may be utilized to assist older people and people who do not wish to walk by foot the distance to the festival grounds. State Patrol State Patrol officers will be utilized on a State Highways where Longmont Police Officers or Weld County Sheriffs do not have jurisdiction. Light Towers To further avoid accidents and to create the proper presence light towers will be utilized at the needed intersections to ensure the safety of both the Officers and attendees. Squad Cars Squad cars of the traffic officers with flashing lights will be placed at all of the Traffic Control Point Intersections to create a safer environment. Cone Zones Based on the recommendations of the on-site traffic officers, cone zones will be put into place as to create a safe environment for the officers and to expedite the ingress and egress. Signage Message Boards 49 We are coordinating with CDOT to have them bring out Variable Message Boards that will be placed to the east and to the west of the event location on HWY 119. These message boards will be to alert the drivers on Hwy 119 to expect higher than usual traffic volumes. The eastern message boards will be placed on HWY 119 around County Road 7 and County Road 5 1/2. The western message board will be placed around County Road 1 on HWY 119. We are requesting CDOT to have these message boards placed a minimum of 72 hours before the event so as to give time for people to make alternate routes during the one day festival. Pre-Event Message The looping message will be to alert traffic that a large event is coming and to expect higher than normal traffic volume Day-of Event Message The boards on westbound hwy 119 will be used to communicate that thru-traffic needs to stay in their left lane, and festival traffic needs to keep in the right lane.The message board on Eastbound 119 will be used to communicate that thru-traffic needs to stay in their right lane, and festival traffic needs to keep in the left lane. Communication We will give the traffic officers on the scene 2-way Motorola radios that we are using so that they may be able to easily communicate with us. We will also be giving them a cell phone info sheet as a back-up if they need to get a hold of the festival staff. Ingress The primary Ingress for Heaven Fest will be from approximately 9AM—4PM.Traffic Control officers will be put in place based on their recommendations. Egress The Egress of Heaven Fest will be from approximately 8PM—lAM.Traffic Control officers will be put in place based on their recommendations. Other Traffic As of this writing we are not aware of any other large event happening near the location of the festival. Typical Saturday traffic is expected. Primary Ingress / Egress We estimate that 95%of the traffic will be coming from I-25 at the Longmont/ HWY 119 exit. (Exit 240). 50 Secondary Ingress / Egress We estimate that 3%of the traffic will be coming Exit 243 (HWY 66) on 1-25 which is the Mead exit. Traffic from 1-25 exit 243 will be coming from the North on County Road 1. All event traffic that exits off of 1-25 on HWY 66 will be directed to head south to Hwy 119 and 1-25.This will keep the majority of people from utilizing Hwy 66 to access the event. Tertiary Ingress/ Egress We estimate that 2%of the traffic will be coming from the City of Longmont via Hwy 66 Eastbound. Longmont traffic will be instructed to stay in the left lane on HWY 66 and to turn left at County Road 3 :. They will then travel north to our East Parking Area. Shuttles As of the writing of this document, no shuttling is planned because of the parking capacity that has been obtained. Currently, the festival property has enough room to park about 12,000 cars. This is 5,000 more spaces needed for the expected attendance. Dust Suppression On all dirt Roads that are part of the Traffic plan and Route,we will be using Water Trucks to suppress the dust during the day. Cones will be placed every 30ft on HWY 119. For approximately 3600 Feet. Needing a total of 120 Cones. No Parking Signage No parking signage will be standard size yard signs placed along roads where no parking is allowed. These signs are to be placed every 200ft. Locations: • Placed on both Northbound and South bound County Line Road 3 %3 running from hwy 119 to County Line Road 26.This route is approximately 5000 feet long. So a total 50 signs will be needed. 25 on Northbound and 25 on Southbound County Line Road 31/2 • Placed on both Northbound and Southbound County Line Road 1 from the Railroad Tracks to 9`h Ave. This route is approximately 2600 feet long. So a total 26 signs will be needed. 13 on Northbound and 13 on Southbound County Line Road 1. • Placed on both Eastbound and Westbound County Line Road 26 from County Road 3 %x and County Road 5. This route is approximately 2600 feet long. So a total 26 signs will be needed. 13 on Northbound and 13 on Southbound County Line Road 1. • Placed on both Northbound and South bound Fairview St. running from hwy 119 to the Deadend.This route is approximately 2000 feet long. So a total 20 signs will be needed. 10 on Northbound and 10 on Southbound County Line Road 3 'A Festival Traffic Signage Festival traffic signage will be standard size yard signs placed along the official driving route to keep people on the preferred roads. 53 No Event Entry Locations Weiland Direct No-entry banners and Bike Racks will be needed for the entries into the parking lot. One pop-tent and volunteer will man this area all day to keep people from entering the area. Sandstone Ranch Type 3 Barricade with "Road Closed", a "No Right Turn" sign and a "Do Not Enter" sign will be placed. Longview Subdivision A total of 2 no-entry banners and bike racks will be needed for the 2 entries into the subdivision. A pop- tent and a volunteer will be placed at the north entrance of the sub-division to stop people walking from the neighborhood to make sure they actually live there. Deerwood Drive 1 no-entry banner and bike rack will be needed for the 1 entry into the subdivision. Every vehicle will need to be directed to the appropriate place. This will be done with the use of cones, parking tape, barricades, and parking workers. This module will be in operation the duration of the event, with peak hours occurring at the beginning of the event as people enter and at the end as people leave. Different Police Officers will also be involved in this module with the purpose of directing traffic. So proper coordination and cooperation with all officials will be key for this event, as we would like to leave a good impression and be able to come back year after year. Job Descriptions: Parking Director The parking director is in charge of the entire parking module and responsible for making it work properly.The parking director will be in charge of: - Directing all of the Parking workers and assigning them their proper roles during the event. - Directing all of the Parking Signage Workers and giving out orders and instruction of what to do -Coordinating and cooperating with police officers Parking Direction Worker This is a volunteer that will be stationed at various areas of the event to direct traffic to the proper location and flag cars to park at the correct place.They will be required to wear proper safety attire such as bright orange vest so that they are visible to the traffic. Parking Signage Workers These workers will be in charge of setting up all of the parking signage through the event.These will include items such as barricades,traffic cones, parking tape, and signs. Parking Fee Collectors This worker will be in charge of collecting the parking fee and distributing parking passes. Please See the "Site Plan" for a detailed visual on the location of the parking lots. 67 HEAVENFEST NEARBY RESIDENTS: Longview Module The purpose if this module is to proactively maintain the safety, security and serenity of the surrounding community of Longview and its residents. Hierarchy Community Relations Director The responsibility of the Community Relations director it to manage the volunteers in the Longview module and to make sure that every related policy and procedure is adhered to during the duration of the festival. It is the responsibility of the Director to maintain the security, safety, and serenity of the residents. The Director will be the primary contact to all residents and will be in charge of handling any concerns that arise in association to the festival. Longview Gatekeepers The Longview gatekeepers will be in charge of first posting the proper signage on all entrance into the community.The gatekeepers will then be posted at every entrance of the community to make sure that no festival participants enter or park in the community. Longview Clean-Up The clean-up team will be in charge of cleaning up all trash and refuse associated with Heaven Fest both on the aligning streets, neighborhood streets and any other area where a complaint may arise. Policies, Protocols and Procedures: Trash Control All trash and refuse must be picked up and properly disposed of in the community. Periodic walkthrough with trash bags will be done in the surrounding streets and entrances with trash bags to dispose of any waste. Separate bags for trash and recyclables must be carried. The trash must then be transported and disposed of properly in the roll-off container. Parking Parking of festival attendees is strictly forbidden on the side streets and community of Longview. All cars must park on the property of the festival. Any cars in violation of the premise will be immediately towed at the owner's expense. Any complaint received from Longview residents must be adhered to immediately and the correct action followed-up on! Amplified Sound All outside amplified sound will be shut off at Midnight on the day of the festival. 69 Traffic: Police Officers will be placed at critical places to make sure that the safety of everyone driving around the festival is ensured and the flow of traffic is not a complete inconvenience. We have systemized the parking procedures that so cars entering the property of Heaven Fest will be able to do so in a very efficient manner and minimizing the ingress and egress time. Furthermore, "Longview Gatekeepers" will be placed at all Longview Community entrances with signage to make sure that no Heaven Fest traffic will enter. A total of 22,880 people attended the festival. This is an all inclusive number including general attendees, staff, volunteers, bands and workers. Heaven Fest overall was a very smooth and stress free event. There were no major incidents reported. We have received very positive feedback from attendees, volunteers, bands and government agencies involved. The following is a summery of the festival. 75 2009 FEEDBACK FROM LOCAL GOVERNMENT North Metro Fire "We didn't even need to have someone to come and oversee the event that is how confident we are with your operations. We didn't have any problems with your organization and it was very professional. I thought it went quite well." - Monte Deatrich 1/ mdeatric@tchd.org POSITIVE EFFECT ON LOCAL BUSINSESSES Heaven Fest brought people from all over Colorado and the United States. It was no surprise that every business at the festival and even businesses located in the surrounding areas had an above average to incredible sales day. Heaven Fest estimates it brought in over a half a million dollars in revenue to Adams County. Businesses like Papa Johns and Chick-Fil-A reported the highest sales days of the year. Area hotel reported room sell-outs at their establishments. BENEVOLENCE IMPACT 76 Heaven Fest at its core was to be a platform for raising awareness and funds for various benevolent non-profit organizations. These are a few of the positive effects. $30,000+given to Home of Refuge Orphanage Because of Heaven Fest, we were able to give over $30,000 to the Home of Refuge Orphanage in Honduras. $3000 given to Denver Mayor Hickenlooper's Road Home Campaign The cardboard Campout for the Homeless generated over $3000 to help end homelessness in Denver PARKING Parking did max out on the day of the event. If future events we're to happen at this location, then additional land for parking must added, or a shuttling system from other parking areas must be utilized. WATER / HYDRATION We gave away the equivalent of more than 30,000 cups of FREE water. We also sold bottled water throughout the festival. We also put up posters around the festival reminding people to keep hydrated. Our stage MCs also periodically reminded people to keep hydration. Dehydration as expected was an issue, but no serious cases were reported. More info below in the "Health" section. SHADE / MISTING TUNNEL Many large and small tents we're constructed just for the event. The Northern Hills building was also open all day for people to get out of the sun. We also created a large overhead misting tunnel so that people could walk through it to get some quick shade and a misting spray to cool off from the heat. The building turned out to be a good place to get out of the sun, but since we turned off the AC, the temperature inside was no different than the outside. We had ONLY 4 off-site transports during the day. Given there was almost 23,000 people this is an outstanding number. PORT-PODIS / RESTROOMS We had 200 Regular and Handi-Capped Port-O-Podis located around the festival grounds. These were way more than sufficient to meet the needs of the festival go-ers. Based on our experience the previous year, we felt like the placement of the port-o- podis was excellent and they were proportionally used. No changes recommended for future years. 77 FOOD PERMITS / FOOD VENDORS Every single vendor serving food at Heaven Fest was inspected and approved by Tri- County health. No food incidents were reported. We had over 30 food/concession vendors. The lines never got too long during the day so we felt that it was an adequate number to serve our attendees. SECURITY / SAFETY About 10 sheriffs and 50 people on our security team created a safe atmosphere for everyone. There was NOT ONE criminal incident the entire day. This is was due in part to a great team, lack of alcohol being served, and a primary Conservative Christian Family demographic in attendance. SOUND / NOISE The carry of sound and noise into the eastern community of Eagle Shadow was minimal and according to the Sound Expert that we hired to come and take decibel readings, the sound never even went above the normal sound ordinances, with the exception of one reading on the stage facing west, where there is only a few homes for a couple miles. Please see the Decibel Readings attached to this document. HEALTH / PARAMEDICS Stadium Medical along with the help of volunteer RNs manned a First-Aid trailer. Overall there was not an above average amount of incidents per the amount of people present. During the day, four people were transported to hospital. The two most common calls/patient complaints were Dehydration related and Allergy/asthma related. WASTE MANAGEMENT All waste was sanitarily collected in waste bins located around the festival. All trash was collected into 4 Roll-Off containers. All trash from the festival was picked up and carried off the appropriate dump. No complaints received. TRAFFIC Thornton Police handled the traffic control on HWY 7 and Holly St. CDOT placed 2 large message boards the day before the festival on both Eastbound and westbound HWY 7 warning of the event and higher traffic expected. The Thornton Police did a great job. 78 The traffic lines did get long at one point in the day. We believe this is because of the increased traffic due to the Adams County Fair that was happening on the same day, as well as the we had a more than expected attendance. We believe this can easily be remedied by hosting the event on a different day than the Adams County Fair, as well as adding more ingress locations and parking attendants. ALTERNATE ROUTE In an effort to keep as many cars off of HWY 7, we created an alternate route that drove traffic north into Weld County along country back roads. This tactic diverted at least 35% of traffic off of HWY 7 and was very successful. In response to the request from the Weld County Commissioners, we moved our alternate route to only run on paved roads. We would continue to use this alternate route in the future. COMMUNCATION Heaven Fest utilized 2-way Motorola Walkie-Talkies to communicate during the day. The communication between the team members of Heaven Fest was very successful. We felt like the communication between the Heaven Fest leadership team could have been handled better on the Thornton Police side. They we're never given our in-house radios. This would have been nice so that they could communicate with the Adams County Sheriffs. There were not any major issues during the day. MATERIALS STAGING AREA One of the biggest improvements this year is we implemented the Materials Staging area. This are centralized all of the different components needed on the spot on the day of the festival like Golf Carts, Water, Tools, Fencing etc. We brought in 3 large storage containers, and a materials trailer. Valeria L Skitt, City Clerk This permit is Non-Transferable and must be presented upon request LICENSE AGREEMENT (Supplement to a City of Longmont Use of Public Places Permit) This License Agreement ("Agreement") is made and entered into as of the qt>'day nr\CKACY\ 2010 by and between the City of Longmont, Colorado, a municipal corporation (City), and Worship and the Word Movement, Inc. (Licensee), a Colorado nonprofit corporation, having a principal place of business at 611 Pheasant View Dr., Frederick, Colorado 80530. WITNESSETH: WHEREAS the City leases certain park land known as Union Reservoir (Parcel 131306000051 (Union), located in Weld County on County Road 26 and owns adjoining farm land consisting of the Koester property (Parcel 131306000024) and the Pietzrak property(Parcel # 131305000056); and WHEREAS Licensee desires to use Union and the adjoining farm land to stage a Christian music event on July 31, 2010 (Event); and WHEREAS the City is willing to provide a license to Licensee to allow Licensee to use Union and the adjoining farm land for the Event under the terms and conditions set forth herein. NOW THEREFORE in consideration of the mutual covenants, terms and conditions, it is agreed as follows: 1) The recitals set forth above are incorporated herein by reference. 2) The City grants Licensee a license to use Union (campground, picnic, parking and beach facilities) and the adjoining farm land for the Event pursuant to the terms and conditions set forth herein. The interest of the Licensee in Union and the adjoining farm land shall not constitute a lease, tenancy or other real property right, but rather shall be a mere license personal to the Licensee and revocable pursuant to Chapter 13.37 of the Longmont Municipal Code, as amended. 3) Licensee has inspected Union and the adjoining farm land and accepts Union and the adjoining farm land in an "as is" condition and shall not request or require the City to remove any structures or construct or install any new structures or improvements or provide maintenance. 4) Licensee has applied for a permit pursuant to Chapters 13.20 and 13.37 of the Longmont Municipal Code(Permit). This Agreement shall supplement the Permit,and this Agreement shall be subject to all provisions of Chapters 13.20 and 13.37 of the Longmont Municipal Code. If Licensee's application for the Permit is denied for any reason whatsoever, this Agreement shall be null and void and neither party shall have any further obligations hereunder. Any expenses incurred by Licensee in furtherance of its application for a Permit shall be at Licensee's sole risk and expense, and the City shall have no obligation to reimburse Licensee for such expenses. Anal t2\profiles\Yosses\MyDocuments\HF LICENSE AGREEMENT final.doc 3/8/10 10:57 AM 5) Licensee shall be responsible at its sole cost and expense for obtaining and complying with all other permits or approvals it may need. 6)The Event shall be held on July 31, 2010. • 7) Licensee shall have exclusive use of the Koester(Parcel#131306000024), the Pietzrak(Parcel #131305000056) and the public access areas of Union Reservoir (Parcel #131306000051) properties for the use of HeavenFest 2010. Licensee shall have exclusive use of the public access areas of Union from 6 a.m. July 30, 2010 through 9 p.m. August 1, 2010. Licensee shall have access to the adjoining farm land from 6 a.m. July 26, 2010 through 10 p.m. July 29, 2010 and to Union starting 6 a.m. July 30, 2010 for set up. Licensee shall have access to the Swim Beach from 10 a.m. to 8 p.m. July 30 through August 1, 2010. The following uses are included: a) set-up for the event from July 26, 2010 to July 30, 2010 including property modifications; b) any and all general festival activities July 30,2010, July 31, 2010 and August 1, 2010; c) temporary hardship exception for loud noise for July 30, 2010 from noon to 8 p.m. for sound checking and July 31,2010 from 10 a.m. to midnight for the Event; d) overnight camping on the nights of July 30,2010 and July 31, 2010; e) tear-down for the Event through August 1, 2010 for Union and through August 6, 2010 for the adjoining farm land. 8) Lifeguards will monitor the capacity of the swim area and limit access if necessary. Licensee will pay an additional $360 to City to increase the life guard staff by 2 people, for a total of 6 lifeguards on July 31, 2010 from 10 a.m. to 8 p.m. and to extend the swim time on July 30, 2010 to 8 p.m. 9) Licensee shall provide no fewer than 200 portable restrooms. City will lock its vault toilets not later than 6 p.m. July 30, 2010 and reopen them at noon August 1, 2010. 10) Licensee may remove a 30-40 foot section of the wire fence north of WCR 26 from the ditch east to the agricultural gate entrance and install a culvert and crossing immediately north of WCR 26 to provide safe public access to the food court. Licensee shall: a) install temporary fencing along the outlet from Union to run parallel at a distance of - 150 feet to minimize impact to the riparian area. Licensee shall install temporary fencing on the Koester property along the Oligarchy ditch to limit access to the Ditch. Licensee may elect to tie this fencing into the stage area to reduce the required length of fencing, so long as it acts as a barrier as intended by the City, and b)monitor the bather to ensure it is not being violated, and c) provide temporary fencing in Union where City deems necessary to ensure the safety of the attendees and to restrict attendees from entering areas off limits, and d) station volunteers at strategic locations to prevent access to areas off limits, and e) not later than 9 p.m. August 1, 2010, return the wire fencing to its original condition if Licensee has removed the 30-40 feet of wire fencing, or install new fencing if provided by City not later than July 30,2010, and 2 \\nalf2\profiles\Yosses\MyDocuments\HF LICENSE AGREEMENT final.doc 3/8/10 10:57 AM • f)remove the culvert(if installed) so that the property is returned to its original condition, and g) return Union to its original condition by 9 p.m. August 1,2010. If City chooses to make the installed culvert and crossing permanent, City shall pay Licensee the cost of the culvert not later than 90 days after the Event and licensee will leave it in place after the Event. Licensee will provide the labor and installation at no cost to City. Licensee is not responsible for the purchase or installation of a new agriculture gate. 11) Licensee shall provide a staff liaison to act as a point person to the rangers on duty in monitoring activities from July 30,2010 through noon,August 1, 2010. The staff liaison will not be exclusive to the rangers. Licensee shall provide one radio to the Park Rangers to be used to communicate suggested corrective action in real time to the point person. Licensee will have fmal authority over the placement and execution of its equipment, materials, attendees, staff and volunteers. If problems arise, the Park Rangers can contact the staff liaison with suggested corrective action. 12) City will designate the Union campground for Event staff and for their use as needed, within the reservoir rules. Open fires are only permitted in designated park fire pits. Fire pits are limited to the"Camping Area"in Union as designated on Attachment A. 13) Licensee shall be responsible for the additional wages, including overtime for all City employees required to monitor and manage Union during the Event including set-up and clean- up. Licensee shall not be charged in excess of$200.00 for these expenses. 14)After the Event,but no later than 9 p.m. August 1, 2010 for Union and 9 p.m. August 6, 2010 for the adjoining farm land, Licensee shall remove all trash and any of the temporary facilities set up by Licensee pursuant to this Agreement and restore Union and the adjoining farm land to their original conditions as they existed immediately before 8 a.m. July 26, 2010, normal wear and tear excepted. 15) City will relocate the Emergency Helicopter landing to the Longmont Electric Aircraft Flyers. 16) Licensee shall prepare and submit a Traffic Control Plan for approval by Weld County, the Colorado Department of Transportation, the Colorado State Patrol and City for their collective comments. City and Licensee shall agree to a final Traffic Control Plan not later than June 1, 2010.The Traffic Control Plan shall include: (a) a map showing location of devices, (b)written description of devices to be installed, (c)traffic control to be installed in different phases, such as weekdays during event setup, July 30, 2010-during arrival of overnight campers, July 31, 2010-main event and August 1, 2010-tear down and cleanup, (d) coordination and communication between Licensee's staff, City police and State police,and d)volunteer and officer placement. 3 Anal t2\profiles\Yosses\MyDocuments\HF LICENSE AGREEMENT final.doc 3/8/10 10:57 AM In addition, Licensee shall hire a barricade/traffic control company to supply, install, and remove all temporary traffic control devices during each phase. Unless otherwise noted on the Traffic Control Plan, all traffic control devices must meet MUTCD standard that can be enforced by State and local police. 17)In consideration of the license granted herein, Licensee shall pay the City: (a) $8,000.00 as the fee for use of Union, $2,000.00 of which Licensee shall pay July 1, 2010 and the balance of$6,000.00 July 26,2010, and (b) $2,750.00 as a security-damage deposit for use of the Koester property, $687.00 of which Licensee shall pay July 1,2010 and the balance of$2,063.00 July 26, 2010. 18) Licensee shall advise all of its vendors that: (a) a Longmont Sales and Use Tax License is required to sell items during the Event and(b) all Longmont sales tax must be paid on all sales. 19) Licensee shall timely notify residents in the area of (a) the Event and (b) a neighborhood meeting to be held during the month of April 2010. In addition, between July 12, 2010 and July 16, 2010, Licensee shall provide a second notice to area residents of the Event. In each case, the cost shall be borne by Licensee. Persons to be notified are those who reside west of County Line Road in neighborhoods designated by City, Longview subdivision, along County Line Road and all rural residences within a 3/4 mile radius of the Event site. City will provide Licensee with the addresses of the residents to be notified. 20) Licensee shall be entitled to raw water for dust control from the City at prevailing raw water rental rates. If Licensee's contractor desires bulk treated water, a bulk water permit will be required. City will bill Licensee for the total amount of metered raw and treated water accrued due to the Event. Licensee shall pay within 30 days of receipt of the bill from City. Licensee shall be entitled to use the existing treated water tap on the Koester parcel during the Event. The City will read the meter before the Event on July 26, 2010 and after the Event on August 2, 2010. Licensee will pay prevailing rates for water used. 21) Licensee shall hire an independent company to do periodic sound decibel readings at the northwest corner of the Longview subdivision, the northem shore of Union and the beach at Union. A summary of this information will be provided to the City for use in evaluating future requests for this event. Decibel readings will be taken at 4 p.m., 8 p.m. and 10 p.m. July 31, 2010. At no time shall the decibel level exceed 85 at the northwest corner of the Longview subdivision. 22) a) Licensee and the City shall identify the portions of the Koester property that vehicular traffic will be allowed on. All other areas will be posted and closed to vehicular traffic. b)Vehicular traffic will be allowed on a maximum of 10 acres. c) If the existing tenant farmer on the Koester property elects to lease the property for the period August 15, 2010 to July 15, 2011 after the tenant farmer on the Koester property performs the second cutting, the tenant farmer must submit, in writing, the total amount of bails that were harvested. Licensee shall pay said amount within 7 days of receipt of the invoice from City. e) City and Licensee will walk the Koester property in September 2010 and mutually agree on areas that will require chemical fallowing, fertilizer or weed spraying as a result of the grass hay crop not adequately re-establishing. f) Licensee shall pay a set fee of$20 for every acre deemed to need remediation. g) At the direction of City, Licensee shall use plywood or planking to access the Koester field in the event of significant rainfall either before or after the Event. City and Licensee shall in good-faith mutually determine if there has been significant rainfall. h) Licensee shall pay City $400.00 for the removal and reinstallation of the irrigation pipe. 23) a) On July 26, 2010, City and Licensee shall walk Union and the adjoining farm land to determine current condition and take pictures and video to serve as documentation. b) On August 4,2010, City and Licensee staff shall walk Union again and adjoining farm land and mutually agree on a"punchlist" of items that need to be restored. c) Licensee shall restore any portions of any of these properties damaged by the Event. d) After the walk through, if the damage to the property is less than the deposit, City will return the difference to Licensee not later than October 1, 2010. e) If the damage to the property is greater than any applicable deposit, Licensee shall pay the damage amount no later than 7 days after receipt of an invoice from City. The damages are to be determined by the City Public Works/Utilities Department according to the terms in this License agreement. 24)Not later than June 1, 2010 Licensee shall provide to the City Clerk a letter or lease from the owners of the property that will be utilized for parking other than the property covered by this License, indicating Licensee has permission to use their property for the Event. In addition, not later than June I, 2010, Licensee shall provide to the City Clerk a letter from the Great Western Railroad indicating: (a) it will move the railroad cars currently located between the primary parking area and the Event site to create an opening for pedestrian access to the Event and (b) Licensee has permission to use its property for the Event. In the event the Great Western Railroad does not commit to moving its railroad cars, Licensee shall provide a contingency plan, acceptable to the City that allows attendees to travel from the primary parking area to the Event site without allowing pedestrians to cross between rail cars. 25) Licensee shall pay$375 as reimbursement to the tenant farmer for work performed to date and$500 for the annual rent and fallowing of the Pietzrak property. 26) a) In addition to any other fees and deposits required herein, Licensee shall pay to City the cost of providing one off-duty sergeant and 4 off-duty sworn police officers to assist Licensee, the cost of which is estimated to be $5,140.00. Licensee shall at all times maintain at its sole cost and expense adequate Workers' Compensation Insurance with an authorized insurance company insuring the payment of compensation to all Licensee employees engaged in the operation of the facility and event. a) The City, the Union Reservoir Company and the Oligarchy Ditch Company shall be listed as additional insureds in any required liability insurance policy. Such policies shall state that this coverage is to function as the "primary" insurance coverage for the Licensee. b) Certified copies of the above policies, or a certificate evidencing the existence thereof, or a binder shall be delivered to the City Clerk's Office not later than June 1, 2010. In the event a binder is delivered, it shall be replaced within ten days by a certificate of insurance. Failure to deliver the certificate of insurance by 5 p.m., June 1, 2010 may result in termination of this contract and constitute default. Each such policy or certificate shall contain a valid provision or endorsement that the policy may not be canceled, terminated, changed or modified without giving thirty days written notice thereof to the City. Any party besides City or the Licensee receiving services or benefits under this Agreement is only an incidental beneficiary. 34) The Licensee shall perform all obligations under this license in strict compliance with all applicable federal, state, county and City laws, rules, statutes, charter provisions, ordinances, and regulations. 35) This license completely integrates all understandings between the parties. No prior or contemporaneous addition, deletion, or other amendment shall have any force or effect unless part of this license. No later novation, renewal, addition, deletion, or other amendment shall have any force or effect except in a written supplemental document the parties duly sign. Except as specifically stated in this license, no representations, agreements, covenants, warranties, or certifications, express or implied, exist between the parties. 36)No waiver of any breach or default under this license shall be a waiver of any other breach or default. 37) Invalidation of any specific provisions of this license shall not affect the validity of any other provision of this license. 38) Any tribunal enforcing this license shall apply and construe it according to the laws of the State of Colorado.
