SUBJECT: USR-1695, A&W Water Service, Inc.
The Weld County Public Works Department has reviewed this proposal. This project falls under
the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4,
Section 23. Staff comments made during this phase of the Use by Special Review process may
be all-inclusive, as other issues may arise during the remaining application process.
Comments made during this stage of the review process will not be all inclusive, as
revised materials are submitted other concerns or issues may arise. All issues of
concern and critical issues during further review must be resolved with the Public Works
Department.
• CDOT: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses
to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or
970-350-2163) to verify the access permit or for any additional requirements that may be
needed to obtain or upgrade the permit. (State Highway 60)
The State Highway Department is requiring that a northbound to westbound left turn lane be
constructed at the entrance of the site. Permits and planning should be coordinated with CDOT
for this phase of the construction.
Approach Road: In evaluating the traffic flow pattern for the proposed use, the Public Works
Department recommends extending the asphalt paving to the west 300-feet to accommodate
the internal traffic flow pattern to keep the dust down and to use as a track pad. This needs to
be shown on the plat. The remaining portion of the approach road west to the commercial well
operation shall be an all-weather surface capable of handling heavy truck traffic and adequate
dust control at all times.
The new asphalt approach road shall match improvements at your entrance with adequate
turning radiuses in both directions.
Circulation and On-Site Parking: The applicant is identifying traffic flow of large vehicles
through the gate utilizing the facility and the proposed parking adjacent to the office area for
customers and employees. The applicant is identifying parking adjacent to the office with one
ADA spot identified for handicapped accessibility. This shall meet the standards. Wheel guards
or curb stop shall be required for the parking area adjacent to the office. Planning Services will
determine the amount of parking spaces required.

• If truck parking or equipment storage is being proposed on site, identify the location on the plat
drawing. Move the future pipe and equipment storage area on the plat to the same location as
on the drainage plat.
Agreements: The applicant shall enter into an Improvements Agreement According to Policy
Regarding Collateral for Improvements. Please refer to Rich Hastings to finalize this item.
Storm Water Drainage: A final drainage report that was stamped, signed, and dated by Kurt
Rollin, P.E. # 24802, was submitted for review on November 20, 2009. Prior to recording of the
plat, the applicant must provide a final drainage report and final construction drawings that have
addressed all redline comments, been stamped, signed, and dated by a licensed professional
engineer, and have been accepted by Public Works.
Please provide calculations and detail drawings for the 1 foot wide channel shown on the site
plan, the rundown into the pond for the channel, the 18" CMP culvert in the channel, the
spillway, and riprap protecting the spillway on the downstream side.
Please show the topography for 200 feet outside of the USR boundary in all directions. Please
address in the drainage report how offsite runoff from the south will be addressed if it flows onto
the site.
The calculations for the proposed condition are not consistent with the proposed conditions
shown on the site plan, Sheet 2 of 2. Please review and revise the drainage report to be
consistent with the site plan.
• The calculations for the retention pond will likely change once the drainage report is revised to
be consistent with the site plan. Please review and revise the calculations. Please note that
revision of the retention pond size will require the calculations showing the pond draining in 72
hours will have to be redone.
Please ensure that the final drainage report addresses all items on the preliminary and final
drainage report checklists. Copies of the checklists used to review the drainage report have
been attached for your use.
Please include a copy of the variance request, geotechnical report, and all pertinent reference
information in the appendices of the drainage report. Please bind the copies of the drainage
report.
Traffic Study: Weld County Public Works has reviewed the traffic study prepared by Eugene
Coppola, PE for the A&W Water site and finds it acceptable. A northbound left deceleration lane
is warranted based on the projects trip generation. A westbound left turn lane at the site
entrance is also required by Weld County and CDOT. Trucks from the project site accessing
US-85 must use SH 60 south or WCR 40 to access US-85. Trucks should not use WCR 38.5
and 38 to travel east to access US-85. The applicant shall enter an improvements agreement
for the use of WCR 40 and all other onsite and offsite improvements. Please contact Janet
Carter for any questions regarding the traffic study.
Plat Drawing: The applicant needs to place on the plat drawing the improvements at the
intersection, the left turn slot including lane widening, tapers, adequate turning radiuses, the
extension of the pavement to the west gate, all right-of-ways, easements, and haul route sign

Final Drainage Report: A Final Drainage Report was provided. The Report was stamped,
dated, and signed by Kurt R. Rollin, P.E. number 24802.
A discussion needs to be added to the narrative describing how and when the retention pond
will be maintained.
A discussion needs to be added to the narrative describing the changes that occur in the basin
boundaries between the existing and proposed conditions.
Sub-basin A requires a detention or retention pond to contain the 100-year event. The sub-
basin cannot release at a rate greater than the 5-year historic rate of 0.28 cfs. A spillway and
water quality control feature will be required for a detention pond. Preliminary calculations show
that a detention pond would likely be less than 1/3 of an acre-foot.
A spillway needs to be shown on the drawings for the retention pond. Calculations for the
spillway need to be provided in the drainage report.
A note needs to be added to the grading plan stating "Weld County will not be responsible for
the maintenance of drainage related facilities."
The final drainage report shall address the redline comments in report and on the exhibits.
The applicant shall address the comments listed above during this review process.
Comments made during this stage of the review process are not all-inclusive, as revised
materials will have to be submitted and approved by Public Works prior to the recording
of the Final Plat. The review process will continue only when the all application materials
have been submitted.

COLORADO FIELD SERVICE SUPPORT FACILITY
DATE: DECEMBER 16,2009
Environmental Health Services has reviewed this proposal for Use by Special Review Permit
1695 for Oil Field Service Support Facility, consisting of water supply&storage,pot ash mixing
&storage, and a production pipe&storage area. We recommend that the following conditions be
part of any approval:
We recommend that the following requirements be met prior to recording the plat:
I. A fugitive particulate emissions control plan(dust control plan) shall be submitted and
approved by the Weld County Dept. of Public Health&Environment.
• 2. The applicant shall submit a waste handling plan, for approval,to the Weld County
Department of Public Health&Environment.
a) A list of wastes which are expected to be generated on site(this should
include expected volumes and types of waste generated).
b) A list of the type and volume of chemicals expected to be stored on site.
c) The waste handler and facility where the waste will be disposed(including
the facility name,address,and phone number).
3. If applicable, the applicant shall obtain stormwater discharge permit coverage from the
Colorado Department of Public Health&Environment,Water Quality Control Division
for construction activities.
4. A secondary containment structure surrounding each tank or battery of tanks used for
slurry storage or mixing shall be constructed. The volume retained by the structure shall
be 110%greater than the volume of the largest tank inside this structure. The structure
shall prevent any release from the tank system from reaching land or waters outside of
the containment area prior to cleanup. For tanks stored in contact with the ground, a
concrete secondary containment structure(floors and walls) shall be constructed. The
structure shall be designed by a Colorado Registered Professional Engineer. The
Department will consider structures other than those constructed of concrete so long as a

registered professional engineer provides a certification indicating that the proposed
structure meets or exceeds the expected functionality of a concrete structure in regard to
containment, spills, unintended releases, etc.
5. A secondary containment structure surrounding the slurry unloading/truck slurry loading
area shall be constructed unless all connections are made within the structure required in
4 above. The volume retained by the structure shall be sufficient to capture spilled slurry
and prevent spills from reaching land or waters outside of the containment area prior to
cleanup.
6. An individual sewage disposal system(I.S.D.S.)is required to dispose of sewage from
the facility and must be designed by a Colorado Registered Professional Engineer and in
accordance with the I.S.D.S. portion of the Weld County Code.
7. The septic system serving the existing residence,which the applicant intends to use for
office space shall be reviewed by a Colorado Registered Professional Engineer. The
review shall consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be submitted to
the Environmental Health Services Division of the Weld County Department of Public
• Health and Environment. In the event the system is found to be inadequately sized or
constructed, the system shall be brought into compliance with current Regulations.
Development Standards:
I. The facility shall be constructed and operated to ensure that contamination of soil and
groundwater does not occur.
2. Slurry unloading/truck loading operations shall be conducted within the secondary
containment areas. Spill prevention measures shall be employed when making
connections and during loading/unloading operations. Portable containment such as drip
pans shall be available for use.
3. The fresh water storage and loading system shall be operated in a manner to minimize
spills. Fresh water spills should be captured in above ground containment areas and
allowed to infiltrate. There shall be no discharge from this process to surface waters or to
the facility stormwater management system in accordance with the Rules and Regulations
of the Colorado Water Quality Control Commission,and the Environmental Protection
Agency.
4. No permanent disposal of wastes shall be permitted at this site. Any liquid or solid
wastes shall be stored and removed for final disposal in a manner that protects against
surface and groundwater contamination.
5. Fugitive dust shall be controlled on this site. The facility shall comply with their

approved fugitive dust control plan.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Sewage disposal shall be by septic system. Any I.S.D.S. on the property shall be
permitted, installed,maintained and operated in compliance with Weld County Code,
pertaining to I.S.D.S.
8. A permanent adequate water supply shall be provided for drinking and sanitary purposes.
9. Adequate drinking water,hand washing, and toilet facilities shall be provided for
employees and patrons of the facility at all times.
10. Waste materials shall be handled,stored, and disposed in a manner that controls fugitive
dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions. The applicant shall operate in accordance with the approved Waste Handling
Plan.
• 11. All chemicals must be stored secure,on an impervious surface, and in accordance with
manufacturer's recommendations.
12. This facility shall comply with the laws,standards, rules and regulations of the Water
Quality Control Commission, Air Quality Control Commission, Hazardous Materials and
Solid Waste Division, and any other applicable agency.

Upon review of my case files and computer,an active Violation(ZCV0B-00225)was noted. This violation
was issued due to commercial activity in relation to an Oil and Gas Support and Service Facility(water
supply&storage; potash mixing and storage;washout facility;reverse osmosis facility and production pipe
and equipment storage area)taking place in the A(Agricultural)Zone District without having submitted a
Use by Special Review permit.
This case has was initially scheduled to be heard in front of the Board of County Commissioners through a
violation hearing on March 10, 2009 but has been removed from the docket as a USR application has
been completed and submitted to the Department of Planning Services.
This application, if approved, will correct the violation. If for any reason, this application is denied, the
Violation Case will proceed accordingly through a violation hearing and possibly district court.

Special review Permit for a Oil and Gas Support and Service Facility,Case#RE-4797.and offer the following
comments;
New development within the growth areas of towns and cities should be served by municipal/district water and
• sewer systems whenever possible. Any new development within the County should be inside the municipal
boundaries of a Town or City. For those developments that cannot meet this requirement because of distance from
service lines or inability to annex,a requirement for connection to water and sewer at some appropriate time or
when proximate to service lines should be a condition of approval of the application.

Dear Chris:
After submitting comments on behalf of Farmers Independent Ditch Company("FIDCo")on April 2,
2009,A&W Water Service contacted the Company and clarified that the use by special review was
limited to the southwest portion of its property away from the Farmers Independent Ditch ("FIDCo
Ditch"). Based on that clarification, it is now our understanding that none of the proposed new uses or
facilities will have a direct impact on the right of way for the FIDCo Ditch.
FIDCo remains concerned with potential discharge of pollutants to the FIDCo Ditch from runoff into the
• borrow pit along State Highway 60. In addition,since the previous letter,the Ditch Company learned
that a ditch that runs north-south along the western edge of the proposed USR boundary carries
irrigation tailwater directly into the FIDCo Ditch. Such contamination could occur from the potash slurry
storage on the west side of the property,as well as from storage of used production pipe,the washout
area and the storage and mixing of potash and salt,all along the eastern portion of the property near
Weld County Road 60. These uses should be conditioned upon construction of adequate berms to
prevent runoff leaving the areas where these activities occur from entering into the roadside ditch or
into the tailwater ditch.
Based on this new information from A&W Water Service,we request that the County include the
following revised term and condition in A&W Water Service's permit:
Applicant shall not cause discharges and shall take measures to prevent any
discharges into the ditch owned by the Farmer's Independent Ditch Company
("FIDCo Ditch"), including discharges caused by direct discharges into the ditch,
discharges to the borrow ditch on the east side of Highway 60 and then into the
FIDCo Ditch, or discharges into the tailwater ditch that parallels the western USR
boundary and continues north into the FIDCo Ditch ("tailwater ditch") unless
Applicant and FIDCo enter into a written agreement allowing the same. Discharges
to the ditch include stormwater runoff from the land within the USR boundary that
enters the FIDCo Ditch via any of aforementioned routes. In order to prevent
stormwater runoff or other discharge from entering the tailwater ditch, Applicant
shall construct and maintain a berm along the western USR boundary sufficient to
prevent runoff into the tailwater ditch.

Service, Inc., USR-1695
Our firm represents the Farmers Independent Ditch Company ("Ditch Company"), which owns
the Farmers Independent Ditch ("Ditch") and associated right of way. The Ditch Company
recently received a referral for the application of A&W Water Service, Inc. ("A&W")for approval of
a Site Specific Development Plan and Use by Special Review Permit for property owned by A&W
in the Northeast 1/4 of Section 31, T 4 N, R 66W ("A&W Property"). The Ditch Company's Ditch
and right of way are located on the northwest side of the A&W Property.
• The Ditch Company's right of way allows the Ditch Company to operate, maintain, repair and
replace the Ditch. When cleaning and maintenance of the Ditch and right of way, the Ditch
Company may pile muck and debris from the Ditch in the Ditch's right of way and burn
vegetation within the Ditch and right of way. This practice is a normal maintenance activity and
is included as part of the Ditch Company's right of way. According to Bill Schneider, the ditch
rider, the company sprays with herbicide and burns vegetation in the Ditch Company's right of
way that includes the area extending 20 feet out from the southeast edge of the road on the
southeast side of the ditch (see attached aerial photo). The Ditch Company's use of its right of
way and Ditch for these purposes takes precedence over A&W's use of its land, as the Ditch
Company's right of way is the dominant estate in the A&W Property.
The Ditch Company is concerned about the impact A&W's proposed activities on the A&W
Property may have on the Ditch and the Ditch Company right of way. A&W provides support
services for local oil and gas production operations, including cleaning and filling water frac
tanks, mixing and selling potash, and treating contaminated "produced" water, a wash out area
for cleaning oil production equipment, and a production pipe and equipment storage area.
Given the nature of A&W's operations, the Ditch Company is concerned that A&W may store or
place flammable materials within the right of way or cause discharge of pollutants to the ditch
directly or by runoff into the borrow that runs along State Highway 60.
Accordingly, any approval by the County on the A&W Property should include the following term
and condition:

Any alterations of the Farmers Independent Ditch (relocating, sloping or piping),
ditch crossings (over, under, or through this Ditch), encroachments on the right of
way (trees, structures, fences, placement of flammable materials etc.) and
discharges of storm water into this Ditch either directly or by discharging to the
borrow ditch on the east side of Highway 60 and then into the Ditch are
prohibited unless A&W Water Service, Inc. and the Ditch Company enter into a
written agreement allowing the same. For purposes of this approval, the right of
way is assumed to extend approximately 20 feet to the southeast from the
southeast edge of the road that runs along the Ditch's southeast side.

I do. It doesn't have to be a "complete" study. I'll accept a memorandum. They need to
provide me with the volume. It should be an easy task for Gene Coppola. And they still need
a permit, since one has never been pulled for this intersection. I need to establish a
baseline" for the future. I doubt that any improvements will be necessary, but I need to

Gloria,
I just wanted clarification on responses #1 and #2. The applicant provided a traffic impact
study for this site in March 2009. At that time you indicated (upon reviewing the traffic
study) that CDOT was requesting a northbound to westbound left turn lane to be constructed
for the site. Under this proposal the number of trips to the site will be reduced (by
approximately 80 trips per day due to removing the Reverse Osmosis Facility, Equipment
Washout Facility and downsizing the office).

I've reviewed the amendment and offer the following:
1. A traffic impact study should be completed for the site.
2. The WCR 38.5 access will require a new permit because of the increased traffic. If the
AmsTI5 indicates highway improvements are necessary, the applicant would be responsible for
heir construction.
3. The plan sheet indicates an oil/gas and emergency access. This access has not been
permitted. Based on the category of highway, this access should not be allowed. CDOT would

consider an emergency access, but such access will have to gated at ALL times and only used
for emergency services. Any violations will result in the access being removed by CDOT
forces and the applicant billed for our costs.
liThere appears to be another oil/gas access road. I cannot find any evidence of a permit
or this access. This access should be removed.
5. CDOT Hydraulics will review the drainage plan.

Based upon a discussion regarding this site, CDOT is willing to allow the oil/gas and
emergency access to remain. The applicant will need to get a new permit for the access to
allow the emergency use. The permit will state the following:
1. The access is to be locked and gated at all times. However, should this be a violation
of any agreement the property owner has with the oil company, CDOT will consider the removal
of the lock. We would still want the access gated, if at all possible.
2. Any violations of the emergency access by A&W Water will result in the removal of the
emergency use portion of the permit. The access will then function as an oil/gas well access
only.
3. At such time as the oil/gas well use ceases, the access will be required to be locked and
gated. Of course, this would only apply if the lock has been removed as part of the oil
agreement.
I hope this clarifies things a little better.
