Dear Glenn:
In order to keep the members of the Board of County Commissioners advised as to
the current status of the above entitled proceedings which are now pending in the
Weld County District Court before the Honorable Robert A. Behrman, I am submitting
herewith the following information.
Following the recent conference by the attorneys representing the various Defendants
involved in the above entitled proceedings , we attempted to contact Mr. Liss con-
cerning the matters relating to continuance. We were unable to contact Mr. Liss
and in due course of time the attorneys representing the Defendants filed a motion
for extension of time within which to file pleadings and also a motion for continuance
for the purpose of determining what action the Colorado State Legislature is going
to take during its present session in connection with the County Functional Home
Rule Charter Bill.
Mr. Liss did not respond to our previous telephone contacts and filed a request
for setting of the motion. The hearing in connection with the matters pertaining
to the motion for continuance has now been scheduled for Tuesday, April 13, 1976.
The Judge has also entered an order extending the period of time for our filing
responsive pleadings in connection with the above until the matters relating to
the motion for continuance is determined.
I have recently been advised that the Functional Home Rule Charter Bill has been
reported out of committee in the House favorably and is supposed to shortly be
presented to the House for consideration. As soon as I receive any further in-
formation, I will advise you accordingly. Likewise, should you receive any
information concerning the status of the Functional Home Rule Charter Bill in
the State Legislature or matters relating thereto, I would appreciate your contacting
me and advising me accordingly.
