Oak Street) and South of and adjacent to County Road 16 Section Line Size of Parcel: 248 +/- acres Parcel Number: 1307-36-0-00-018 • THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-2-220 of the Weld County Code as follows: A. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinance in effect. Section 22-2-20.B.3 A.Policy 2.3, states, "Encourage development of agriculture and agriculturally related businesses and industries.... Agricultural businesses and industries include those related to ... agri- tainment or agri-tourism uses." Further, Section 22-2-20.F.4 A.Policy 6.4 states "Encourage agri-tourism; and Section 22-2-70.A TR.Goal 1 states "Recognize the importance of cultural and heritage tourism and recreation to local, regional and agricultural economies, including events and sites such as corn mazes, County fairs, farm implement museums, etc. Encourage the provision of adequate support services and facilities necessary for the continuation and expansion of these activities, consistent with other goals and policies of the Comprehensive Plan." (Weld County Code Ordinance 2002-6; Weld County Code Ordinance 2008-13) B. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A (Agricultural) Zone District. Section 23-3-40.C.8 of the Weld County Code provides for a Recreational Facility with uses similar to those seen at guest farms and fairgrounds as a • W-SPUR PRODUCTIONS WILLARD-OSTRAND USR-1754 PAGE 3 • Use by Special Review in the A(Agricultural) Zone District. Summer events occur from July 1 through mid-late September, and include events such as: Outdoor Concerts, Paintball Courses & Competitions, Family Movie Nights, Educational Agricultural Demonstrations (draft horse pulling, horse training, sheep dog illustrations and mutton busting) & a possible Farmers Market. Autumnal events commence mid-September through October 31. The Fall events consist of the Corn Maze, Concerts, Paintball Courses, Zip Lines, Pumpkin Patch, Trail Rides, Hayrack Rides, Helicopter Rides, Barn Animal Petting Zoo, Family Movie Nights, Farmers Market, Inflatable Jumping Pillow, Laser Tag & Various Educational Agricultural Demonstrations. These events will take place Thursday through Sunday during the afternoon. Depending on interest drawn from local area youth & schools the corn maze, youth activities & educational demonstrations may be available on Tuesday & Wednesday during daylight hours during all days of operation. Summer events will occur on Friday evenings, Saturday afternoons or Saturday evenings. A concert or movie night would generally always take place in late afternoon going into the evening. The agricultural demonstrations, paintball course & the farmers market would generally take place on Saturday & Sunday afternoons. C. Section 23-2-220.A.3--The uses which will be permitted will be compatible with the existing surrounding land uses. The surrounding land uses include a variety of agricultural activities. Directly to the west of the property there is an egg farm that houses 1.6 million egg laying chickens [Sparboe Farms, 3rd AmUSR-655]. Adjacent properties in all directions are farmed for alfalfa hay, grain crops & several produce crops. Northwest of the proposed corn maze is a long-term correctional facility within the corporate limits to the Town of Hudson, and south of Interstate 76 is an Industrial Manufacturing Facility[DPC Industries, USR-909] and to the southeast is a natural gas powered power plant[Rocky Mountain Energy Center, USR-1339]. There are three single family residences in the near vicinity, the first residence is south of and adjacent to the Sparboe Facility, the second is in the Northwest corner of the site (Kevin and Heather Willard's residence) on a Recorded Exemption lot. and the third is on an outparcel within the proposed Guest Farm property. D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The facility is within the three mile referral areas for the Town of Hudson and Town of Keenesburg. The proposed site is within the Intergovernmental Agreement area for the Town of Hudson. The Town of Hudson in their referral dated August 19, 2010 had reviewed the proposal and were in support of the request with concerns of traffic management at the intersection State Highway 52, the west bound off ramp and the 1-76 Frontage road. The Town cites poor sight distance and conflicting turning movements at this intersection. Further stating, all development that contributes traffic to an already bad intersection should be responsible for participating in the solution. The Town also provided comment from the Hudson Correctional Facility, specific to the utilization of airspace and overflight of the proposed helicopter ride near the facility. The Town of Keenesburg in their referral dated August 10, 2010 indicated no conflict with their interests. E. Section 23-2-220.A.5 -- The application complies with Section 23-5 of the Weld County Code. • W-SPUR PRODUCTIONS WILLARD-OSTRAND USR-1754 PAGE 4 • Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/ Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) F. Section 23-2-220.A.5 -- The site does lie within the Flood Hazard Overlay District. Boxelder Creek influences the east side of the property. In a memorandum from Public Works to Building Inspection dated August 23, 2010, Public Works indicates that any future development of structures within the floodplain will require an amendment to the existing Flood Hazard Development Permit, FHDP-386. G. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve prime agricultural land for the proposed use. The site is predominately designated as "Prime" and "Prime if Irrigated" by the USDA Soil Conservation Service map dated 1979. The proposed use will not remove any additional agricultural land from production. The agricultural activities on the property are an important part of the proposed use. H. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request. and responses from referral entities. • The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Prior to recording the plat: A. The plat shall be amended to delineate the following: 1) All sheets of the plat shall be labeled USR-1754 (Department of Planning Services) 2) The plat shall be prepared per Section 23-2-260.D of the Weld County Code. (Department of Planning Services) 3) The attached Development Standards. (Department of Planning Services) 4) County Road 47 is designated on the Weld County Road Classification Plan as a local paved road, which requires a 60-foot right-of-way at full build out. There is presently sixty feet of right-of-way. A total of 30 feet from the centerline of County Road 47 shall be delineated on the plat. This road is maintained by the Town of Hudson. (Department of Planning Services) 7) A graphic key and or symbol serving to identify each component that is located within the USR Boundary. The key and corresponding component shall be summarized in tabular format and be clearly delineated on the plat. (Department of Planning Services) 8) The applicant must delineate the locations of the Stop sign at the point of ingress /egress and Oak Street. (Department of Public Works) 9) The applicant must delineate the boundaries of the Box Elder Floodplain on the USR Plat. Please delineate all existing and new structures such as buildings, whether temporary or permanent, and towers that are located within the floodplain on the Plat. (Department of Public Works) 10) The applicant must delineate the approved access permit configuration from the Town of Hudson or from the Colorado Department of Transportation, as applicable, and delineate any additional requirements to obtain the permit. (Department of Public Works) 12) The applicant must delineate the location of the advertising sign placed on the trailer segment of a tractor trailer adjacent to (Interstate 76) CDOT right-of-way. (Department of Public Works) • 13) The applicant must delineate the location of the Ticket /Parking Booth for the event. This Booth should be located at the end of the access road adjacent to the parking lot to accommodate vehicles from stacking up or parking off the 1-76 Frontage or County Road 47 waiting to enter the facility. (Department of Public Works) 14) The applicant shall accurately delineate the FEMA recognized floodplain and reference the FIRM Community panel map and map date. The correct panel map is number 080266 0900 C dated September 28, 1982. (Department of Public Works) 15) The applicant shall delineate a parking and circulation layout plan for the overflow parking component. The plan shall be dimensioned and demonstrate that there is adequate turning radii, internal circulation and adequate access for emergency ingress and egress. (Department of Planning Services) 16) The applicant shall delineate parking and drop off spaces for non-ambulatory persons visiting the facility. These drop-off and parking spaces shall meet all Local, State and Federal guidelines and requirements as adopted by Weld County. (Department of Planning Services) 17) The overflow (secondary) parking area shall place the single point of ingress and egress at the curve in the road before heading North into the facility. The applicant shall submit evidence that a building permit has been reviewed, approved and obtained for the existing structure utilized for hay storage and for this application utilized for habitable occupancy space. The applicant shall submit evidence that a building permit has been reviewed, approved and obtained for the proposed tractor trailer banner sign utilized for advertising the corn maze for this application. The applicant shall furnish a Traffic Control Plan for the facility on any given day for review and approval by the Department of Public Works, Colorado Department of Transportation and Town of Hudson. Written evidence of acceptance to be submitted to the Department of Planning Services. (Department of Public Works) E. The applicant shall provide evidence of an access permit for the first year of operation from the Colorado Department of Transportation (CDOT)for 2010. (Department of Public Works) F. The applicant shall provide evidence of an access permit from the Town of Hudson and meet any additional requirements needed to obtain or upgrade the permit. The Town of Hudson has jurisdiction over all accesses. (Department of Public Works) G. The applicant must submit an Amended Flood Hazard Development Permit(AmFHDP) to the Department of Public Works for any structures or buildings that will be constructed within the FEMA defined floodplain. Please show new structures such as building or towers that are located within the floodplain on the Final Plat. (Department of Public Works) • H. The applicant must submit a Traffic Management Plan for traffic control for the Corn Maze operation for review and approval from the Colorado Department of Transportation (CDOT), the Town of Hudson and Weld County Department of Public Works. Written evidence of approval shall be submitted in writing to the Department of Planning Services. (Department of Planning Services) The applicant shall submit in writing, evidence that the existing domestic water tap has been re-permitted for a commercial water tap. Further, the applicant shall submit written evidence that the concerns raised in the referral from the State of Colorado Division of Water Resources, dated August 9, 2010 have been addressed to their satisfaction. Written evidence of approval shall be submitted in writing to the Department of Planning Services. (State of Colorado Division of Water Resources) J. The applicant shall address the requirements of the Department of Building Inspection. as stated in their referral response dated July 30, 2010. Evidence of approval with all conditions met or mitigated shall be submitted in writing to the Department of Planning Services. (Department of Building Inspection) K. The applicant shall submit a Lighting Plan for all on-site lighting. This information must include cut sheets describing the lighting fixtures, including permanent and temporary fixtures. The plan must also include the locations of all lighting fixtures. (Department of Planning Services) L. The applicant shall submit to the Weld County Department of Planning Services a recorded copy of any agreement signed by all of the owners of the property crossed by the emergency access. The emergency access shall be for ingress and egress and shall . The applicant shall submit for review by the Department of Planning Services a method of documentation for the daily visitor numbers to the Wild Wild West Corn Maze facility. (Department of Planning Services) N. The applicant shall complete an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all required materials. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the Amended USR plat; or, the applicant may submit evidence that all the work has been completed and approved by County staff. (Department of Planning Services) 2 Two months prior to the time of the second year of operation, the applicant must submit to the Department of Planning Services evidence of an approved Access Permit from CDOT and an approved Traffic Control Plan. (Department of Planning Services) 3. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. (Department of Planning Services) 4. The Department of Planning Services respectively requests the surveyor provide a digital copy of • this Recorded Exemption/Subdivision Exemption/Use by Special Review/. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date of the Board of County Commissioners resolution a $50.00 recording continuance charge shall be added for each additional 3 month period. The Site Specific Development Plan and a Special Review Permit for a Recreational Facility with uses similar to those seen at guest farms and fairgrounds A (Agricultural) Zone District as indicated in the application materials on file and subject to the Development Standards stated hereon. (Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health and Environment) 4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. (Department of Public Health and Environment) 5 Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. • (Department of Public Health and Environment) 6 The applicant shall operate in accordance with the approved "waste handling plan". There shall be no open burning conducted on the site, with exception to burning defined as "agricultural open burning" as defined by Regulation No. 9 of the Colorado Air Quality Control Commission Regulations, (Department of Public Health and Environment) 9. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code (Department of Public Health and Environment) 10 Adequate drinking, handwashing and toilet facilities shall be provided for employees, vendors and patrons of the facility, at all times. (Department of Public Health and Environment) 12. The Stanford Event and Labor Services portable toilet chart shall be adhered to as a minimum guideline. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment,Water Quality Control Division. None of these streets are designed for this type of traffic. And the CR12.5/Hwy 52 intersection is inadequate, in my opinion, for heavy traffic, even for short periods of time. It is on a curve with no lighting and intersecting 65 mph traffic. Se did not receive an IGA referral for annexation from the County, only the USR referral for comment. Mr. Willard has never petitioned for annexation. I did not believe that use of the site for a corn maze, without any physical improvements to the property, in itself should require annexation. However, if there was to be any physical development on the site, that would invoke the IGA terms. We were told that there was nothing proposed that would require building permits. If is any development proposed, then the applicant should be referred for annexation per the IGA as the County has done in the past on other sites. Sparboe and the prison may have been advised of the corn maze. But the road closure was only a recent surprise that came up late last week, AFTER the referrals. (I don't know if the gas plant was ever notified.) As I indicated before, these businesses should represent their own concerns. I just want to be sure that they are in the loop. Gloria at CDOT told me that she did email referral comments back to the County during the referral period. I understand that the corn maze is only open for a part of the year. But that does not negate the need for reasonable mitigation to avoid unsafe conditions during those days of operation. Hopefully the meeting on the 17th will yield some reasonable solutions. Oe Town's primary concern from the beginning has been traffic impact. I appreciate being included in the meeting on the 17th. Please let me know if you have questions. Any closure of the frontage 4oad will divert traffic onto a combination of gravel county and town eets. The new proposed intersection for this traffic at Highway 52 is at R12.5, an intersection that is on a curve with incoming 65 mph traffic, as opposed to the 25/35 mph traffic at the current frontage road intersection. And the approximately 3/4 miles of CR12.5/10th Avenue is a little-used section of gravel washboard that is not suited to high levels of traffic, even for short periods of time. And there was no discussion of the concerns expressed by the Town at the county planning hearing. I spoke with Larry Haas from CDOT today. While he agrees that there does not seem to be a good solution, but he believes that directing traffic to the CR12.5/Hwy 52 intersection is preferable to the current frontage road intersection. Neither Larry nor I are sure what Janet Carter meant by a "soft" closure that I was told she mentioned at the County planning hearing last Tuesday. We are certainly dealing with an unknown set of circumstances, but I believe that there is potential for serious problems, not to mention impacts on other established businesses that will have their access diverted. I'm not in a position, however, to speak for those businesses. I only hope that the correctional facility, Sparboe Farms and the gas plant folks have been consulted. didn't hear about the proposed frontage road closure until the Thursday fore Labor Day Weekend, and the County Planning Commission approved the permit the Tuesday following Labor day. Hardly enough time for us to react. And 1 understand that earlier proposals to have traffic control personnel, a 3 specific recommendation of the Town, have been changed, again without consultation with the Town. The applicant has indicated that he is not happy about the proposed traffic diversion, but that they do not have the sources to implement a proper solution. I presented an update to the Town Planning Commission yesterday in view of the fact that representations at the time of the earlier meeting to consider the county referral have been changed. The Commission asked that I discuss this with the Board of Trustees at next week's meeting and prepare written comments from both boards for the County Commissioners. It is possible through a few different avenues of protcol so that we're not breaking any laws. For instance we can use water that has already been allocated to the well from Central Colorado Conservation District, if it is not used for crop irrigation, or if we were to purchase additional water shares for that well. Due to the timing of the USR & time needed for completing that water permit through the state, we have decided to use A&W Water Service as a location to purchase the water needed for dust control. We will utilize their well location on SH 52 west of Ft Lupton. We currently have a water truck that we can use for transport & application. This should clear up the issue with the Department of Water Resources, but if there are any further questions please let me know. However, as part of a recent application for expansion of the Hudson Correctional Facility a traffic study, including existing traffic counts was prepared by the applicant. The analysis found that there was 450 ADT along the 1-76 Frontage Road. (The entire study is attached). There are virtually no land uses along the frontage road between State Highway 52 and the intersection with Oak Street that would contribute to the traffic volume. Thus, it is reasonable to assume that most, if not all of the traffic along the frontage road would also be using Oak Street (WCR 47). Let me know if you need anything else. The only thing is we are continually bringing large trucks, semis, large implements, etc in/out of the property on a day to day basis with our 'year round operation', so I would not want to permanently relocate the access point. It would be virtually impossible to route our heavy equipment through the changed access with the turns involved. I don't think light passenger car traffic for the temporary event would be a concern though. Would it be feasible to route exiting traffic over to the 'revised access' location via traffic cones, which would route them to the location of our stop sign that public works is requiring? Ingress could enter the property on the existing location of the access, but egress would be directed over to a perpendicular angle to Oak Street like you indicated on the 'revised map drawing'. First is the new sewer line that we hope to have under construction this fall. It would obviously be easier for us to have the ROW for the entire route of the line, including the pieces of 12.5 and the frontage road north of 12.5. Second is the frontage road realignment. The realignment is dependent partly on the timing of the second phase of the prison. That is unknown at this time. However,the frontage road should be realigned regardless of the prison's plans, so it will be dependent on when the three parties(town, county and CDOT) come together on the plan of action. The second phase of the prison will trigger CDOT's requirement to realign the frontage road. But,there is a safety problem today that should be addressed sooner rather than later. So, if the second phase of the prison does not move forward, I would still suggest getting the project done in late 2011 to mid 2012. Love's is on board with the project and will pay the costs associated with modifying their accesses to accommodate the new road configuration. The project will benefit the prison, Sparboe Farms,Willard and other property owners who depend on the frontage road for access. They stated that the permit should typically designate such activity to be allowed, but periodic dust control use on the owner's property would be acceptable. I made them aware of the fact that we wilt be holding a corn maze this fall&they said that using water from the irrigation well (permit#11725-F),on the 1/2 mile driveway would not be a concern. The applicants are proposing to provide a corn maze, paintball course, concerts, pumpkin patch, kids activities, etc. The applicants are proposing to have a potential indoor paintball course in the two-sided, enclosed barn (building #3 indicated on the site map) as well as an outdoor course (indicated as#2 on the site map). The barn may also serve other multiple uses (movies, etc.). The applicants are proposing to operate between the months of July and October mainly on Fridays, Saturdays and Sundays. According to the applicants estimation, up to 10,000 people per day may be expected. The applicant also indicated that the facility may be open to school aged children who may visit the premises mid-week. Building Department A building permit will be required for the change of use from agricultural to a commercial use (Building #3). The applicants indicated that there is a bathroom and office in the barn; however it would only be used for the applicant's agriculture business. Staff stated that the primary parking area will need to be hard surfaced for accessibility reasons. Health Department 1111 A waste handling plan will be required. The contact information for the waste handler will need to be provided. An onsite dust control plan will also be required. The existing domestic well will not be allowed to be used for watering the parking areas. • • Staff suggested pointing the concerts towards the highway so it doesn't travel to neighboring properties. Prepackaged food items and licensed mobile units are allowed. No paintballs are allowed to enter the waters of the State. Staff indicated that the ditch company may have some comments. Portable toilets are allowed for six (6) months or less according to staff policy. Bottled water and handwashing units will be provided. Public Works The access is proposed from CR 47 (Oak Street). The Town of Hudson has jurisdiction over this access;therefore staff recommended that the applicants visit with the Town of Hudson regarding the access. No staging of vehicles on public roads is allowed. Staff recommended that the applicants prepare a plan on how to bring the people in, internal circulation and an access plan for emergency responders. Staff directed the applicant to contact David Bressler with Weld County. Staff will review the traffic circulation in and out of the property. The applicants indicated that they would like to have a two-lane access. Staff stated that the road must be a minimum of 20 feet; however 24 feet is recommended. According to the proposed site map, #5 is where the primary parking will be located. This area needs to be an all-weather surface material. As a rule, staff informed the applicant that 100 vehicles • equals 1 acre. Overflow parking is located in area #6; this area can be in grass, however it must stay undisturbed so no dust blows onto 1-76.
