RE: APPROVE PETITION AND ANNEXATION AGREEMENT FOR ANNEXATIONS #1
THROUGH#4 OF PORTIONS OF COUNTY ROAD 26 AND AUTHORIZE CHAIR TO SIGN
NECESSARY DOCUMENTS -TOWN OF FIRESTONE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Petition for Annexations No. 1 through
No. 4 of Portions of County Road 26 from the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, to the Town of Firestone, Colorado, and
WHEREAS,a hearing before the Board was held on the 1st day of February, 2010,at which
time the Board deemed it advisable to continue said matter until February 22, 2010, to allow
adequate time for the Town of Firestone to obtain written approval from the gravel operators, and
WHEREAS,the Board has reviewed the Annexation Agreement with the Town of Firestone,
which addresses the annexation of these sections of road, and finds the same to be acceptable and
appropriate, and
WHEREAS, at said hearing on February 22, 2010, after review, the Board deems it
advisable to approve said petition and said agreement, copies of which are attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Petition for Annexations No.1 through No.4 of Portions of County
Road 26 from the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, to the Town of Firestone, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that said Annexation Agreement with the Town
of Firestone, for the annexations of said roadway be, and hereby is, approved, and the Chair is
authorized to sign any necessary documents.

PETITION FOR ANNEXATION TO THE TOWN OF FIRESTONE
DATE: September 19, 2009
TO: THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO.
I, Douglas Rademacher, serving as Chair of the Weld County Board of County
Commissioners, on behalf of Weld County, in accordance with Colorado law, hereby petition
the Town of Firestone and its Board of Trustees for annexation to the Town of Firestone of the
following described unincorporated territory located in the County of Weld and State of
Colorado, to-wit:
See legal description in Exhibit A, attached hereto and
incorporated herein by this reference.
This annexation shall be known as the Weld County Road 26 Annexation No. 1 —No. 4.
As part of this petition, your petitioner further states to the Board of Trustees of
Firestone, Colorado, that:
1. It is desirable and necessary that the territory described in Exhibit A be annexed
to the Town of Firestone.
2. The requirements of C.R.S. sections 31-12-104 and 31-12-105, as amended, exist
or have been met in that:
a. Not less than one-sixth of the perimeter of the area proposed to be
annexed is contiguous with the Town of Firestone or will be contiguous
with the Town of Firestone within such time as required by 31-12-104.
b. A community of interest exists between the area proposed to be annexed
and the Town of Firestone.
c. The area proposed to be annexed is urban or will be urbanized in the near
future.
d. The area proposed to be annexed is integrated with or is capable of being
integrated with the Town of Firestone.
e. No land within the boundary of the territory proposed to be annexed which
is held in identical ownership, whether consisting of one tract or parcel of
real estate or two or more contiguous tracts or parcels of real estate, has
been divided into separate parts or parcels without the written consent of

the landowner or landowners thereof, unless such tracts or parcels were
separated by a dedicated street, road or other public way.
f. No land within the boundary of the area proposed to be annexed which is
held in identical ownership, comprises twenty acres or more, and which,
together with the buildings and improvements situated thereon has an
assessed value in excess of two hundred thousand dollars ($200,000.00)
for ad valorem tax purposes for the year next preceding the annexation,
has been included within the area proposed to be annexed without the
written consent of the landowner or landowners.
g. No annexation proceedings have been commenced for any portion of the
territory proposed to be annexed for the annexation of such territory to
another municipality.
h. The annexation of the territory proposed to be annexed will not result in
the detachment of area from any school district.
The annexation of the territory proposed to be annexed will not have the
effect of extending the boundary of the Town of Firestone more than three
miles in any direction from any point of the boundary of the Town of
Firestone in any one year.
j. The territory to be annexed is 9.05 acres, more or less, in total area.
k. Prior to completion of the annexation of the territory proposed to be
annexed, the Town of Firestone will, pursuant to the provisions of C.R.S.
§ 31-12-105(1)(e), have in place a plan for that area, which generally
describes the proposed: Location, character, and extent of streets,
subways, bridges, waterways, waterfronts, parkways, playgrounds,
squares, parks, aviation fields, other public ways, grounds, open spaces,
public utilities, and terminals for water, light, sanitation, transportation,
and power to be provided by the Town of Firestone; and the proposed land
uses for the area; such plan to be updated at least once annually.
1. In establishing the boundary of the territory proposed to be annexed, if a
portion of a platted street or alley is to be annexed, the entire width of the
street or alley has been included within the territory to be annexed. The
Town of Firestone will not deny reasonable access to any landowners,
owners of any easement, or the owners of any franchise adjoining any
platted street or alley which has been annexed by the Town of Firestone
but which is not bounded on both sides by the Town of Firestone.
m. The Board of County Commissioners agrees that an impact report
pursuant to Section 31-12-108.5, C.R.S. is not required because the total

area of territory proposed to be annexed is less than ten acres and, further,
that any requirement for preparation thereof, is waived.
3. The owners of more than fifty percent of the area proposed to be annexed,
exclusive of dedicated streets and alleys, have signed this petition and hereby
petition for annexation of such territory.
4. Accompanying this petition are four copies of an annexation map containing the
following information:
a. A written legal description of the boundaries of the area proposed to be
annexed;
b. A map showing the boundary of the area proposed to be annexed, said
map prepared by and containing the seal of a registered engineer;
c. Within the annexation boundary map, a showing of the location of each
ownership tract in unplatted land and, if part or all of the area is platted,
the boundaries and the plat numbers of plots or of lots and blocks;
d. Next to the boundary of the area proposed to be annexed, a drawing of the
contiguous boundary of the Town of Firestone and the contiguous
boundary of any other municipality abutting the area proposed to be
annexed, and a showing of the dimensions of such contiguous boundaries.
5. Upon the Annexation Ordinance becoming effective, all lands within the area
proposed to be annexed will become subject to all ordinances, rules and
regulations of the Town of Firestone, except for general property taxes of the
Town of Firestone which shall become effective as the January 1 next ensuing, if
applicable.
6. The zoning classifications requested for the area proposed to be annexed are RR1
Residential District.
Petitioner agrees that the annexed land shall be brought under the provisions of
Chapter 17 of the Firestone Municipal Code within ninety (90) days of the
effective date of the annexation ordinance.
7. There shall be no duty or obligation upon the Town of Firestone to furnish water
or sanitary sewer facilities to the area proposed to be annexed. Such services will
be provided at such time, in the sole discretion of the Town, when such services
for water and sanitary sewer can be economically and reasonably installed to
service a sufficient number of inhabitants within the area so as to make the
construction and establishment of such services feasible and at no additional cost
for the same or similar type of services provided to inhabitants within the existing
corporate limits of the Town.

8. Petitioner and the Town specifically acknowledge the execution of an Annexation
Agreement contemporaneously with the execution of this Petition, and both
parties expressly consent to the terms and conditions set forth therein, which
include but are not limited to the following:
(a) The Town, except as hereinafter provided, will be responsible for
prospective maintenance of said real property.
(b) The Town will not impose any weight limitation applicable to vehicles
using said real property, other than those imposed generally along CR 26
(Zinnia Avenue), which the Town has previously annexed.
(c) The Town will not impose any limitation on vehicular access or use of
said real property so as to exclude farm or agricultural vehicles and
equipment, other than those imposed generally along CR 26 (Zinnia
Avenue), which Town has previously annexed.
(d) Current ingress and egress to the real property described in Exhibit A for
current uses will continue to be allowed for such purposes, the intent being
that annexation shall not impair or affect current access.
(e) The Town shall accept assignment of Annexor's active road maintenance
agreements with three gravel pit operators for portions of WCR 26
between WCR 13 and WCR 15 and shall enforce/administer those
agreements in order to maintain said portions of the road for the benefit of
the travelling public and the gravel pit operators, and agrees to insure that,
pursuant to the agreement being assigned to the Town by Annexor, the
gravel operators take steps to prevent the tracking of mud onto the roads..
(0 The road, consisting of both paved and unpaved portions, shall be
maintained by the Town in a fashion suitable for a gravel pit haul route
including but not limited to the following measures: paving repairs; crack-
fill; frequent grading, prevention of the development of rutting and
washboards; filling of potholes; and repair and fill of washouts.
(g) The Town shall initiate dust suppression practices to protect the public
health and to provide un-obscured driving conditions through the use of
water or magnesium chloride, in accordance with Annexor's policy which
is to perform dust suppression for 150 feet either side of any residential
driveway on gravel roads once daily traffic volumes, as determined by
traffic counts, exceeds 200 ADT.
(h) The Town shall consider an unpaved road as a candidate for paving when
the traffic count exceeds 300 ADT.

(i) The Town will implement weed control consistent with the standards of
Annexor and the State of Colorado.
(j) The Town will initiate timely removal of snow from the annexed road
segments.
9. Petitioner expressly reserves the right to withdraw this Petition for Annexation at
any time prior to the adoption of the ordinance annexing the property to the Town
of Firestone.
WHEREFORE, the following petitioner, a non-resident landowner of the area proposed
to be annexed, (as more particularly described in the attached Exhibit A) respectfully
requests that the Town of Firestone, acting through its Board of Trustees, approve the
annexation of the area proposed to be annexed. By this acknowledgment, the

(hereinafter referred to as "Annexor' ) and the TOWN OF FIRESTONE. COLORADO
(hereinafter referred to as "Town"). for the annexation of a right of way parcel adjacent to Weld
County Road 26 a/k/a Zinnia Avenue.
W ITNESSETEI:
WI IEREAS. Annexor is the governmental entity which owns and controls certain real
property which is part of various Weld County Roads located adjacent to Town and more
particularly described in Exhibit A. which is attached hereto and incorporated herein by
reference. and
WHEREAS. Annexor has been requested to file a petition with the Town for the purpose
of annexing to the boundaries of the Town the real property described in Exhibit A. and
WHEREAS. Annexor desires to impose upon the Town certain conditions relating to the
proposed annexation and to the effectiveness of the referenced petition. and
WHEREAS. Weld County Road (WCR) 26 is asphalt paved between WCR 13 and
WCR 15. and is a graded gravel road between WCR 15 and WCR 17. and
WI IEREAS. Weld County has active road maintenance agreements with three gravel pit
operators for portions of WCR 26 between WCR 13 and WCR 15. and
WIIEREAS, Weld County wishes to transfer the rights to enforce/administer those
agreements to the Town of Firestone as part of the proposed annexation of WCR 26. and
WHEREAS. following annexation to the Town of the property described in Exhibit A.
said property must be maintained in good condition for the use and safety of the travelling public
and the gravel pit operators. and
WHEREAS, the Mown has reviewed and approved the conditions requested by Annexor
and desires to make the proposed annexation subject to the conditions set forth hereinafter.
NOW THEREFORE, in consideration of the foregoing premises and the covenants.
promises and agreements of each of the parties hereto, to be kept and performed by each of them.
it is agreed by and between the parties hereto as follows:
1. Submission of Annexation Petition: Contemporaneously with the execution of
this Agreement, Annexor is submitting a certain annexation petition for the annexation of the
real property described in Exhibit A, to the Town for its consideration. Said petition, (hereinafter
the --Annexation Petition"). is incorporated herein by reference. The Annexation Petition is
submitted on the express condition that it will be approved by the Town and the real property
described in Exhibit A will be annexed to the Town under and pursuant to the conditions set
forth in Paragraph 2. hereunder.

2. Conditions Applicable to Annexation. It is expressly understood by the Town
that certain requirements are being imposed by Annexor as a condition precedent to the Town's
annexation of the real property described in Exhibit A. These conditions are that. from and after
annexation of the real property described in Exhibit A:
(a) The Town, except as hereinafter provided, will be responsible for prospective
maintenance of said real property.
(b) The Town will not impose any weight limitation applicable to vehicles using said
real property. other than those imposed generally along CR 26 (Zinnia Avenue). which
the Town has previously annexed.
(c) The Town will not impose any limitation on vehicular access or use of said real
property so as to exclude farm or agricultural vehicles and equipment. other than those
imposed generally along CR 26 (Zinnia Avenue). which Town has previously annexed.
(d) Current ingress and egress to the real property described in Exhibit A for current
uses will continue to be allowed for such purposes. the intent being that annexation shall
not impair or affect current access.
(e) The Town shall accept assignment of Annexor's active road maintenance
agreements with three gravel pit operators for portions of WCR 26 between WCR 13 and
WCR 15 and shall enforce/administer those agreements in order to maintain said portions
of the road for the benefit of the travelling public and the gravel pit operators. and agrees
to insure that, pursuant to the agreements being assigned to the Town by Annexor, the
gravel operators take steps to prevent the tracking or mud onto the roads.
(f) The road. consisting of both paved and unpaved portions. shall be maintained by
the Town in a fashion suitable for a gravel pit haul route including but not limited to the
following measures: paving repairs: crack-fill; frequent grading. prevention of the
development of rutting and washboards: filling of potholes: and repair and fill of
washouts.
(g) The "town shall initiate dust suppression practices to protect the public health and
to provide un-obscured driving conditions through the use of water or magnesium
chloride, in accordance with Annexor's policy which is to perform dust suppression for
15O feet either side of any residential driveway on gravel roads once daily traffic
volumes, as determined by traffic counts, exceeds 2OO ADT.
(h) The Town shall consider an unpaved road as a candidate for paving when the
traffic count exceeds 3OO ADT.
(i) The Town will implement weed control consistent with the standards of Annexor
and the State of Colorado.
(j) The Town will initiate timely removal of snow from the annexed road segments.

3. Town's Consent to Conditions. By execution hereof. the Town shall be deemed
to agree to each and every condition stated in Paragraph 2 hereof and the use and maintenance of
the real property described in Exhibit A shall thereafter be in accordance with the provisions
therein.
4. Other Specific Requirements of Annexation. N/A
5. Entire Agreement. This instrument embodies the entire agreement of the parties
with respect to the subject matter hereof There are no promises. terms, conditions. or
obligations other than those contained herein: and this Agreement shall supersede all previous
communications. representations. or agreements. either verbal or written, between the parties
hereto. No modification to this Agreement shall be valid unless agreed to in writing by the
parties hereto.
6. Binding Effect. This Agreement shall inure to the benefit of and be binding upon
the parties hereto and their successors in interest.
7. No Third-Party Enforcement. It is expressly understood and agreed that the
enforcement of the terms and conditions of this Agreement. and all rights of action relating to
such enforcement, shall be strictly reserved to the undersigned parties and nothing in this
Agreement shall give or allow any claim or right of action whatsoever by any other person not
included in this Agreement. It is the express intention of the undersigned parties that any entity
other than the undersigned parties receiving services or benefits under this Agreement shall be an
incidental beneficiary only.
8. No Waiver of Immunities. No portion of this Agreement shall be deemed to
constitute a waiver of any immunities the parties or their officers or employees may possess. nor
shall any portion of this Agreement be deemed to have created a duty of care which did not
previously exist with respect to any person not a party to this Agreement.
9. Severability. If any term or condition of this Agreement shall be held to be
invalid, illegal or unenforceable. this agreement shall be construed and enforced without such a
provision, to the extent this Agreement is then capable of execution within the original intent of
the parties.

I left you a phone message regarding the attached documents.
At the Work Session we had with the Board yesterday, the Board requested that the agreement be altered.
I was not aware that there were three (3) road improvements agreements which the County will need to assign to
Firestone when this annexation is complete.Therefore, that issue is addressed. In addition,the Board wanted to impose
certain minimum conditions for road maintenance by the Town.
I have highlighted the additions to the Agreement and to the Petition. If you have questions as to the basis of the
maintenance requirements,you may call Dave Bauer or Don Carroll.—I will be out of the office tomorrow, but will
return on Friday.
And,just to remind you,this matter is scheduled to go before the Board on Monday February 1, 2010 at 9:00.—(That
was the date set in the letters which we sent out.)You had indicated that you may wish to attend.

I sure will Stephanie. We are expecting a resubmittal from the development that is triggering all of this in the next two
weeks. Once we have that reviewed I can give you better idea of when we will be ready to make our
application/request to the Commissioners. I have already sent the developer (Varra Sand and Gravel)the requirements
based on our WCR 22 annexation and they are supposed to get the package together for us. Firestone will be the
applicant to you but we are having Varra prepare everything for us.
