The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may be all-inclusive, as other
issues may arise during the remaining application process.
COMMENTS:
Weld County Road Classification Plan (FHU):
Lamb Avenue is a local gravel road and requires a 60-foot right-of-way at full build out. There is
presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of
SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-
of-way line.
Access:
• The applicant shall utilize the existing residential access to this parcel.
The existing access, circulation, and gravel driveway shall be graded and drained to provide an all-
weather access to the facility.
Onsite parking has been identified and appropriate curb blocks are in place.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property
or become established as a result of the proposed development, the applicant/landowner shall be
responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained
at a maximum height of 12 inches until the area is completely developed.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of
storm run-off.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).

Subject: USR-1733 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV09-00283)was noted. This
violation was initiated due to the operation of kennel without first submitting and completing the necessary
Weld County Zoning Permits. This case was presented to the Board of County Commissioners through
the Violation Hearing process on December 8, 2009. At that Violation Hearing, the Board of County
Commissioners referred this case to the County Attorney's Office, but delayed legal action for 30 days
(01/08/10). This application was submitted prior to January 8, 2010 and therefore no Investigation Fee is
required.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied,the number of dogs shall be reduced to not exceed 4(four)at any given time and all
commercial activities shall be removed from the property within 30(thirty)days or the Violation case will
proceed accordingly through the Court process.

Environmental Health Services has reviewed this proposal for a dog kennel for up to 40
dogs and a grooming shop for dogs and cats. All structures are in place and no new
construction is proposed. Water is supplied by Aristocrat Water Project and they have
no objection to this request.
The facility will have a part time employee, if needed, for the grooming shop. There will
also be clients who come to the site and they must have access to potable water,
restroom and hand washing facilities. Either a septic system will need to be installed for
• kennel/grooming usage or the existing restroom must be made available for use.
Portable toilets are not allowed as this is not a temporary use. There was also no
mention if any water will be used in the daily sanitation of the kennel and/or supplies
(bowls, bedding ect). No information was provided regarding how the water from the
grooming shop is disposed of. All liquid waste from the kennel and grooming operation
must be contained.
There is an existing septic system (permit SP-0400011) that was permitted for a 4
bedroom residence (8 people) and will require an engineer's review to ensure there is
sufficient capacity to serve the proposed kennel/grooming operations.
The application indicates that waste is cleaned from the kennel on a daily or weekly
basis and placed in a dumpster which is picked up weekly. A waste handling plan is
required which states the name, address and phone number of the facility that will be
picking up the waste.
A dust abatement plan is required for on site dust.
Noise will be restricted to the level allowed in the commercial zone district.
A copy of the Pet Animal Care Facilities Act license was provided, however it expires
February 28, 2010. A copy of the new license is required.

We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
The following requirements are recommended to be met prior to allowing the plat to be
recorded:
1. In the event the applicant intends to utilize the septic system at the existing home
for visitor, employee, patron and/or kennel and grooming sanitation needs, the
septic system shall be reviewed by a Colorado Registered Professional
Engineer. The review shall consist of observation of the system and a technical
review describing the systems ability to handle the proposed hydraulic load. The
review shall be submitted to the Environmental Health Services Division of the
Weld County Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed the system shall be
brought into compliance with current Regulations.
2. Alternately to item #1 above, the applicant shall install an individual sewage
disposal system for visitor, patrons and kennel and grooming sanitation needs
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
• Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
3. The applicant shall provide a copy of the new license from the Pet Animal Care
Facilities Act (PACFA) to the Weld County Department of Public Health and
Environment.
4. The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
• nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
6. The applicant shall comply with the Colorado Department of Agriculture (CDA),
Division of Animal Industry.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. .
9. Adequate drinking, handwashing and toilet facilities shall be provided for
employees, visitors and patrons of the facility, at all times.
10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.

• 11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing public water supply. (Aristocrat
Water Project)
12.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

1. Building permits shall be obtained prior to the change of use of all structures and for all
existing storage sheds on property over 120 square feet that have not been permitted.
2. A plan review is required for each building or structure for which a building permit is required.
Two complete sets of plans are required when applying for each permit. Include a Code
Analysis Data sheet for the Weld County Building Department for each structure that requires a
permit. Submittal plans shall include a floor plan showing the specific uses of each area for the
building. Plans shall bear the wet stamp of a Colorado Licensed Architect or Engineer. The
Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code: 2006 International Energy Code; 2003 ICC ANSI 117.1
Accessibility Code; 2008 National Electrical Code and Chapter 29 of the Weld County Code.
4. All building plans shall be submitted to the Fort Lupton Fire Protection District for review and
approval prior to issue of building permits.
