Dear MK Ogle:
On behalf of Loveland Ready Mix Concrete, Inc. ("LRM"), this letter is to note that LRM d/b/a
Johnstown Ready Mix intends to schedule road improvement work on WCR 13 (County Line
Road) in accordance with AmUSR-1329 (the Green/Croissant Sand and Gravel Mine). The
associated Long-Term Road Maintenance and Improvements Agreement (the "Road
Agreement") states that, to accommodate the approval process in Larimer County (for a sister
operation, which prompted, as you will recall, the USR amendment and new Road Agreement),
LRM "shall have the right to request an extension."
Following action on its proposal in Larimer County, known as the Walters/Bokelman site, the
applicant is prepared to commence work. Through this representative, LRM has worked
extensively with Weld County on the road improvements for AmUSR-1329, most recently in a
phone call with Don Carroll on March 27, 2007, but also including numerous other occasions
involving the draft of construction designs, the road agreement, and other details of the project.
As noted by Mr. Carroll in the March 27 conversation, extension of the timeframe for completion
of road improvements was specifically contemplated in the Road Agreements and is appropriate
at this time given the unavailability of asphalt over the course of the initial period of the
Anreement (e.a_ during the winter). In addition. action on the case in Larimer County is
pending, and extension will allow the zoning case to be resolved prior to the construction of
facilities that assume future use of the Walters/Bokelman site as an aggregate resource.
This letter is intended to serve as a record of the extension of the Road Agreement, as
suggested by Mr. Carroll. Should any questions arise concerning this letter of this project,

Loveland Ready Mix Concrete Company, Inc.; P.O. Box 229, Loveland, CO
80539-0229, (970) 667-2680, has filed an amendment application for a Regular
(112) Construction Materials Operation Reclamation Permit with the Colorado
Mined Land Reclamation Board under provisions of the Colorado Land
Reclamation Act for the Extraction of Construction Materials. The proposed mine
is known as the Bokelman-Walters Pit, and is located at or near Section 24,
Township 5 N, Range 68 W, 6th Prime Meridian.
The proposed date of commencement is Fall 2007, and the proposed date of
completion is 2027. The proposed future use of the land is Developed Water
Resources.
Additional information and tentative decision date may be obtained from the
Division of Reclamation, Mining and Safety, 1313 Sherman Street, Room 215,
Denver, Colorado 80203, (303) 866-3567, or at the Larimer County Clerk and
Recorder's Office at 200 W. Oak St., First Floor, Ft. Collins, CO 80521, or the
above-named applicant.
Comments concerning the application and exhibits must be in writing and must
be received by the Division of Reclamation, Mining and Safety by 4:00 pm on
February 15, 2007.
Please note that under the provisions of C.R.S. 34-32.5-101 et seq. comments
related to noise, truck traffic, hours of operation, visual impacts, effects on
property values and other social or economic concerns are issues not subject to
this Office's jurisdiction. These subjects, and similar ones, are typically

The Weld County Public Works Department will deal with this USR amendment as it comes through the
planning referral system.
WCR 13 is designated on the Weld County Classification Plan (FHU) as a major arterial road which requires a
140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by
Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article Ill, Section
23-3-50, the required setback is measured from the future right-of-way line.
The applicant shall be required to enter into a Long-Term Road Maintenance and Improvements Agreement
associated with gravel pits and plant sites that generate increase in heavy truck traffic hauling. The upgrading
and paving of WCR 13 north of WCR 54 will be required.

Dear Ms. Mika:
This letter is to inform you of a proposal to import sand and gravel to the USR-
1329 (Green/Croissant Sand and Gravel Mine) site. Loveland Ready Mix,
operating in this location as Johnstown Ready Mix, is proposing to use its
existing USR-1329 facilities to process and produce sand and aggregate for sale
and for concrete production using raw materials from a new sand and gravel
resource in the immediate vicinity, the proposed Walters/Bokelman Sand and
Gravel Mine across County Roads 13 and 54 from the site (located in Larimer
County). This proposal will allow for more efficient use of the operator's
equipment while eliminating the need for more processing equipment and a large
concrete plant in close proximity.
We have reviewed the relevant Weld County zoning regulations and have briefly
discussed a USR change of this nature with Weld County Planning Services staff
(Kim Ogle, February 1, 2005). This letter is submitted pursuant to Section 23-2-
280 of the County's zoning code, which provides that the Department of Planning
Services is responsible for determining whether proposed modification of a USR
is a major change subject to new hearings or if an administrative notice of filing is
sufficient.
To assist the Department of Planning Services in its determination, the following
points describe the proposed modification:
• Haul trucks will run between the Walters/Bokelman sand and gravel mine
(approximately 1/4 mile to the north on the west side of County Line Road,
currently being submitted for review by Larimer County and the Division of
Minerals and Geology). Pit run sand and gravel from the Walters/Bokelman
mine will be imported to the USR-1329 site ("Johnstown Ready Mix") for
processing and use in the existing concrete batch plant and for aggregate
sales. The operator estimates that an additional 5 to 6 weekday truck trips per

hour would be generated by the proposed importing. The route of this new
truck haul is depicted on the enclosed map.
• On an annual basis, up to 200,000 tons of additional material would be
imported to the USR-1329 site to meet potential demand for aggregate sales
and concrete products. Aggregate mining at the site would not be affected.
This may result in additional employees at the site, but still within the total
number of 15 to 20 employees estimated at the time of the original Use by
Special Review.
• Additional fines material (typical about 3-5%, up to 10%, of input by weight)
would be generated by importing aggregates. The original USR, and concrete
plants in general, plan to use imported feedstock materials, so it does not
appear that such fines generation is precluded by the existing USR. In any
case, fines will serve as clean, inert fill, and can be incorporated into the current
reclamation plan with minimal to no modification. The total area of the
groundwater lake may be reduced by 0 to 5 acres, reducing the need for
augmentation while maintaining the total area of potential wetland habitat.
• Adjustment to the footprint of the processing area may occur to allow for better
flow of truck traffic, as well as to ensure stockpile capacity in a surge situation
without adding height to stockpiles. Height and location criteria from the
approved Use by Special Review application will continue to apply; for
example, stockpiles will continue to avoid floodplain areas. Stockpiles for
imported construction materials will also remain in the general locations
originally identified, with the intended and necessary flexibility to expand and
contract in accordance with production rates and demand.
• The location of berms, screening fences, and possibly landscape plantings will
be adjusted as necessary to accommodate new truck movements and stockpile
capacity in the processing area. The perimeter of the processing area will
continue to have the same, or greater, linear extent of screening from the
combined berming, fence, and landscape treatment. (Vertical dimensions for
berms were provided in the approved landscape plan while horizontal
dimensions were not. The intent of the landscape plan, as shown in both
cross-section and plan view and according to the findings of the Board of
County Commissioners, is to make the operation compatible with surrounding
land uses by providing a visual barrier between the processing area and other
areas on and off site. This intent is also stated in the application at Section 5.8,
USR Application page 7, noting that topsoil stockpiles serving as landscape
berms are located generally to the west and north of the plant for the purpose
of screening.)

• Additional water will be dedicated to dust suppression as necessary. Available
water supplies and assumptions used in the approved USR provide ample
allowance for dust suppression.
We believe this request involves minor changes that may be appropriately
handled through administrative review under Weld County Code 23-2-280. The
request does not include significant changes from the approved Special Review
plan map or the approved Development Standards, which would require a new
hearing process. In 2001, the zoning review of USR-1329 specifically approved
the land use of a concrete batch plant, and that application process generally
addressed the associated impacts, including stockpiling, processing, and
"hauling to and from the site." The nature of this request is to accommodate the
permitted use in a manner consistent with prior reviews and approvals.
Please also note that the Colorado Division of Minerals and Geology does not
consider an Amendment or Technical Revision of the state 112 permit necessary
to permit the proposed change. The original 112 permit, included as Appendix E
in the Use by Special Review application submitted to Weld County in March
2001, noted that, "Backfill material generated on-site will include waste concrete
that has cured for at least six weeks, silts and clays from the washing operation,
and non-marketable fine material. Inert fill from off-site may also be brought on-
site for use as backfill. This material could include concrete fragments, rock, and
soil and will be inspected for suitability before acceptance to the site."
Based on the facts noted above, as well as comments offered by County staff,
we believe the primary issue raised by the proposed import plan is traffic impact
to WCR 13 (County Line Road). Loveland Ready Mix understands that the
quantity and distribution of truck trips assumed in the original USR application
does not account for a significant volume of trips north of WCR 54 on WCR 13.
New traffic analysis and/or modification of the operator's Improvements
Agreement with the County may be appropriate to account for the impact of the
new traffic pattern on County roads. Another possibility is that, similar to the
original process at Green/Croissant, review of traffic impact will occur as part of
the pending Walters/Bokelman review, to result in a new Improvements
Agreement jointly accounting for impacts in both Weld and Larimer Counties.
In sum, the underlying land use and the associated USR-1329 plans and
development standards (as described by Section 23-2-280 and adopted as USR-
1329 Development Standard 34) are not materially affected by the proposal to
import additional material. An unspecified amount of import haul is anticipated by
the current USR-1329, as importation of materials such as fly ash for use in
concrete production, and truck trips both to and from the site, are contemplated
in the approved USR. Due to the specifically limited nature of the current
proposal and its impacts, we submit that administrative filing and review under
23-2-280 may be sufficient to account for changes to the Special Review permit.
