HomeMy WebLinkAbout20100481.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION ZCV#0900158 AGAINST JYJY, LLC, C/O JAMES YOUNGER, FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, JYJY, LLC, c/o James Younger, ZCV #0900158, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of March, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, James Younger, property owner, was present at said hearing, and WHEREAS, the Board deems it advisable to refer said matter back to the Department of Planning Services, in order to allow staff to work with the property owner to resolve the matter. He had a couple questions about the RE application. He thought he could apply for up to 4 lots through the RE application. Chris explained that his property was only eligible for a 2 lot RE. He asked about the waiver referrenced in the RE application, Chris explained that it did not apply since they did not have more than 120 acres. He then brought up that Wendi had discussed the medical hardship with Sam and that option wasn't going to work. He kept saying are you guys really going to kick out the old guy. I explained that the mobile home just either needed to be permitted or removed. I told him I would check with Wendi. My wife and I where formally divorced in March of last year and she continued to reside in the principle residence until February of this year while I gained financing to buy out her share of the property. For my own personal reasons I could not see myself back in the home we had shared for so many years and left the house empty. I was subsequently informed by my insurance company that they would not cover the home if it was left empty. I have rented out the principle residence and with the current downturn in the economy, appears to be a blessing in disguise as right now my only way of keeping the property is with die added income. The farm is still operating and doing well, but the electrical business that used to help support is as I'm sure you know, almost non-existent. I believe the property is dividable under a recorded exemption and will use that means as a last resort to satisfy my obligations to the county if that's what it takes, but it has never been my intention to develop the parcel and believe it fits into the surrounding community as a working farm. I'm asking that you allow the current situation on a temporary basis until something happens with the current economy.
