Approved with Conditions The Weld County Department of Planning Services has determined through an administrative review that the standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of Weld County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2010-2075 41) 2. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 1313-22-3 RE-5013 All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for 8284 County Road 7. Any existing septic system which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. ' Cl The applicant shall submit a sketch of the existing septic system in relation to the proposed lot line to the Weld County Department of Public Health and Environment. Evidence of approval shall be submitted to the Department of Planning Services. The applicant shall submit documentation from Left Hand Water District indicating that water service is available for proposed Lot A, a copy of a water bill is sufficient. E. Lot A shall use the existing residential access point and the existing agricultural access that accesses the rear outbuildings on Lot A, the access must be delineated, as no additional accesses shall be granted. F. Lot B shall use the existing residential / agricultural access. No additional private residential accesses shall be allowed onto roadways classified as arterial. G. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is Weld Countyas minimum size. If the applicant chooses to place a larger culvert please contact the Weld County Department of Public Works to adequately size the culvert. H. County Road 7 is designated on the Weld County Road Classification Plan as a major arterial road, which requires 140 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. An additional 40 feet shall be delineated on the plat as future County Road 7 right-of-way. All setbacks shall be measured from the edge of future right-of-way. The applicant shall verify the existing right-of-way and the documents creating the right-of- way. If the right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. The applicant shall attempt to address the requirements (concerns) of the Town of Frederick, as stated in the referral response dated April 8, 2010. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. GThe applicant shall address the requirements of Weld County School District RE-1J as stated in the referral response dated March 16, 2010. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. K. All vehicles located on the property must be operational with current license plates, or be screened from all adjacent properties and public rights of way, or be removed from the property. All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. • L. Lot A shall comply with the one (1) acre net minimum lot size required by Section 24-8-401 of the Weld County Code. Net acreage calculations should not include reserved road right- of-way. M. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. N. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, F,H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-3-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Lot A is not eligible for a future land exemption in accordance with Section 24-8- 20.C.1 of the Weld County Code. 4) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 5) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot A and Lot B have an adequate water supply of sufficient quality, quantity and dependability. 6) Prior to the release of building permit, the applicant shall submit evidence of approval from the Frederick-Firestone Fire Protection District to the Weld County Building Department. 7) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 8) Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29- 1-20 and Section 29-3-20.B.13 of the Weld County Code do not need building permits, however, a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 9) Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) 10) Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) 11) Prior to the release of building permits on Lot A or B, the Lot owner shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sanitary sewer line. In accordance with the Weld County Code, if a sewer line exists within four hundred (400) feet of the property line and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 12) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement S is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood.. 3. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services* Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. 4. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date the Administrative Review was signed a $50.00 recording continuance charge may be added for each additional 3 month period. 5. The parcel to the north also owned by the sandlin's and that parcel is illegal and non-buildable. The two parcels needs to be deeded back together to make this parcel legal and buildable. To do this a new deed will need to be created and recorded deeding both parcels into one lot described as N2 sw4. Unfortunately I am unable to process this Recorded Exemption until this has been done. The Recorded Exemption will also need to be updated to reflect the changes. Proof $1000 Application Fee was Paid • • Sandlin Recorded Exemption Questionnaire The purpose of this proposal is to create two lots on a parcel of land located in the North half of the Southwest Quarter of Section 22, Township 2 North, Range 68 West of the 6th P.M., in Weld County, Colorado. The current and proposed configuration is identified on the attached exemption sketch map and is consistent with current property uses. The resulting parcels will be approximately 5 +/-and 74 +/- acres in size for Lots A and B respectively. Acreages are approximate and will be finalized by the plat after review. The proposal is consistent with the surrounding uses, which include rural residential and agricultural uses. Each lot will remain in agricultural zoning consistent with the surrounding properties. 1. Water supply statements addressing the following: a. Domestic use. Statement and evidence that a water supply of sufficient quality, quantity and dependability will be available to serve all proposed lots. There is a water tap serving the existing residence. Domestic water for proposed Lot B will be provided by Left Hand Water District and support documentation provided by the District is included in the application material. There is also an existing well located on the property(well permit number 276522)which is currently being used to irrigated approximately 4500 square feet of yard/garden. A copy of the well permit has been included in the submittal documentation. b. Irrigation water. Type and quantity of irrigation water to the site, whether irrigation water has been removed form the site and, if so, when. The ditch and water rights appertaining to the property include six (6)shares of capital stock of The Base Line Land and Reservoir Company and one(1) share of the capital stock of the Boulder and Weld County Ditch Company. 2. A Statement explaining that the proposed lots will have an adequate means for the disposal of sewage in compliance with the requirements of the underlying zone district and the Weld County Department of Public Health and Environment. A copy of the septic permit or a letter from the sewage disposal facility must accompany the application. The existing residence (proposed Lot A)currently utilizes an individual sewage disposal system (ISDS). The proposed Lot B will also utilize a septic system as permitted through the Weld County Department of Environmental Health and Environment at such time as needed. 3. A description of how the property is being used. When the parcel(s) is located in the agricultural zone district, the number and types of livestock and any existing improvements such as the principal residence, labor home, mobile home, manufactured home, barn, outbuildings, and oil/gas well production facilities on the property. If the property is farmed, the location of any pivot sprinklers and irrigation ditches as well as types of crops being produced. A single-family residence and two outbuildings are located in the southwest corner of the property while the remainder of the land is being used for agricultural uses. The large agricultural parcel is used to grow grass hay and alfalfa. There are no livestock on the property and no buildings. The property also contains oil and wells. Refer to the exemption map for the location of these wells. Sandlin Recorded Exemption Questionnaire 1 • • 4. A description of the location, size, present and future use of the area where the proposed new lot(s) will be created. The proposed Lot A will be approximately 5.00 acres in size and is located at the southwest portion of the property adjacent to Weld County Road 7 and the south boundary of the property. Lot A will be used for a single-family dwelling and those uses allowed in the agricultural zone district. Lot B will be approximately 74+/- acres in size and is in the remaining north and east portion of the property. Lot B will be used for a single-family dwelling and those uses allowed by the existing agricultural zone district. 5. A statement describing any unique physical characteristics on the site, if applicable such as rock outcroppings, hills, ditches. There are several ditches running north and south across the property. 6. A statement indicating where a primary building envelope and/or alternative building envelope will be designated on any of the lots. Building envelopes may not be necessary on lots that are smaller than 35 acres. The Department of Planning Services reserves the right to recommend building envelopes on smaller acreage. The landowners do not wish to build on Lot B at this time. The existing residents and structures are shown on Lot A. 7. Is there a Business or Use by Special Review permit on the property? If so, will it be vacated or remain on the Recorded Exemption lot(s)? Currently, no special land use permits are associated with either lot. A recorded exemption application shall comply with the standards listed in Section 24-8.40 of the Weld County Code. The following addresses those standards: 24-8-40. A The water supply for all proposed lots is adequate in terms of quality, quantity and dependability. Lots A and B will be served by the Left Hand Water District. 24-8-40. B An adequate sewer service is available to serve the uses permitted on all proposed lots. Both lots will utilize Individual Sewage Disposal Systems, consistent with Weld County Department of Public Health and Environment standards. 24-8-40. C An access is, or can be made, available that provides for safe ingress and egress to a public road. All accesses shall be in accordance with Chapter 8, Article II of this Code. Safe access is available to the proposed lots. Access to Lots A will be via the existing residential access from Weld County Road 7 near the southwest corner of the property. Access to Lot B will also come from Weld County Road 7 at the existing access at the northwest corner of the property. Refer to the Weld County Road Access Information Form for details. Sandlin Recorded Exemption Questionnaire 2 28-8-40. D The proposed recorded exemption will comply with Chapter 23, Article V of the Weld County Code. The lots comply with Article V, Chapter 23 of the Weld County Code. This section of the Weld County Code stipulates regulations for development in overlay district areas. This proposal is not in the Geologic Hazard Overlay District, the 1.25 Mixed Use Development District or the Flood Hazard Overlay District. The property is within the Intergovernmental Agreement Boundary with the Town of Frederick but is not within the Urban Growth Boundary area as determined by review of current maps located in Chapter 19 of the Weld County Code. 24-8-40. E The proposal is consistent with the policies and goals of Chapter 22 of this Code. This proposal is consistent with the goals and policies outlined in the Weld County Comprehensive Plan, Chapter 22 of the Weld County Code. This proposal considers the current and future use of the property in determining the proposed lot configuration and existing access points,therefore conforming to the underlying principles of orderly development. A. This application is consistent with Goal 3 in Section 22-2.60.C,which states, "Provide mechanisms for the division of land which is agriculturally zoned." Further, A.Policy 3.3.3 in Section 22.2.60.C.3.c states that safe and adequate access onto County roads shall be evaluated. This proposal illustrates that safe access to the proposed lots is available. R. Policy 2.4 in Section 22-2-190.6.4 stipulates, "Conservation of natural site features such as topography,vegetation and water courses should be considered in the project design." The project design considers conservation of natural site features on both Lots A and B. Lot A was designed to contain the existing residence, outbuildings and associated landscaping. Lot B will continue in agricultural uses. 24-8-40. F The proposal is consistent with any adopted intergovernmental agreement, if applicable. Not applicable, the IGA between Frederick, Firestone, Dacono and Weld County contains baseline development standards and no development is being proposed at this time. 24-8-40. G The proposal has taken into consideration master plans of affected municipalities. The property is not within an Urban Growth Boundary area as determined by review of current maps located in Chapter 19 of the Weld County Code. 24-8-40. H The proposal is consistent with existing surrounding land uses. Existing surrounding land uses include agricultural and residential. This proposal is consistent with surrounding land uses. 24-8-40. I The proposal is consistent with the intent of the zone district the exemption is located within as expressed in Chapter 23 of the Code. The proposed property use will be residential and uses allowed by the Agricultural zone district. Sandlin Recorded Exemption Questionnaire 3 24-8-40. J The proposal is consistent with sound land use planning practices. This proposal has considered: the current and future land use of the property to determine proposed property boundaries, the impact on adjacent land uses, preservation of existing site features, and safe transportation access, all of which are sound land use planning practices. 24-8-30. K The proposal is consistent with the Statement of Purpose as expressed in Section 24-1-30 of this Chapter. The Statement of Purpose of Section 24.1.30 details eighteen criteria used to achieve orderly and efficient development in Weld County. This application meets, exceeds or does not impact the following criteria: • 24-1-30. A Assisting orderly and integrated development. This proposal is merely to create a lot to separate the existing residential improvements from the farmland. • 24-1-30. B Promoting the health, safety and general welfare of the residents of the County Water service and sewage disposal will be accomplished by safe means as stated previously in this application. • 24-1-30. C Ensuring conformance of land subdivision plans with the public improvement plans of the County and its various municipalities. The resulting parcel sizes are compatible with surrounding parcels and consistent with existing development in the area. The uses allowed on these parcels shall be those allowed by right in the agricultural zone district. • 24-1-30. D Ensuring coordination with public municipal improvement plans and programs. This proposal should not affect municipalities in the area, as it is not located within an Intergovernmental Agreement Urban Growth Boundary per Chapter 19 of the Weld County Code. • 24-1-30. E Encouraging well-planned subdivisions by establishing adequate standards for design and improvement. Not applicable, the purpose of this subdivision is to split the existing residential property from the farmland. • 24-1-30. F Improving land survey monuments and records by establishing standards for surveys and plats. A surveyor will prepare final documents in accordance with Weld County standards. • 24-1-30. G Safeguarding the interests of the public, the homeowner and the subdivider. • 24-1-30. H Securing equitable handling of all subdivision plans by providing uniform procedures and standards. Proposed lot A will consist of 5 acres and proposed lot B will consist of 51.49 acres. There is an existing residence on proposed lot A which is served by Left Hand Water District however, evidence of existing water service was not included with our application. An individual sewage disposal system provides sewer to the existing residence however it appears the system is not permitted. A statement of existing and an I.S.D.S. inspection is required. In 2012 the District will bring the new Frederick High School online and the existing high school maybe converted to accommodate elementary and middle school students. If the existing High School is converted capacity may be created and therefore the District could support this application, at that time. Should this development be approved. the options for managing the short and long term overcrowding in these schools may include adding modular classrooms and implementing split or staggered schedules as needed Other options may include, but not be limited to, implementing year-round schools or asking voters to approve new bonds for additional school facilities or a mill levy for additional operating funds.
