Upon review of my case files and computer, an active Zoning Violation (ZCV09-00143)was noted. This
violation was initiated due to the presence of a large accumulation of commercial equipment and materials
and for adding an addition to a 2nd Dwelling Unit without first submitting and completing the necessary
Weld County Zoning Permits. This case has not yet been presented to the Board of County
Commissioners through the Violation Hearing process; therefore no Investigation Fee is required.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied,the commercial equipment and materials and the 2nd Dwelling Unit shall be removed
from the property within 30 (thirty) days. Additionally, if denied by the Board of County Commissioners
please request this violation case be referred to the County Attorney's Office with a delay of legal action
for the 30 (thirty) days mentioned above.

To the extent that the proposed use is limited to the 15 acre tract shown below, it does not appear that the use will

The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of the
Weld County Code. In addition to these requirements, the plat scale shall be 1" = 20 feet or 1" =
40 feet. The Vicinity Map scale of 1" = 2000 feet scale accurately be delineated on the plat.
This application shall be in compliance with Section 23-3-250 A. and B and is address in the
following comments.
• Section 23-3-250.A.5.A
Required Landscaped Areas
No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall not
be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by
decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There was a schematic
Landscape Plan submitted with the application materials. The applicant shall provide additional
documentation including all proposed fencing, lighting, adjacent property screening and
landscape treatment to meet this section of the Weld County Code.
Section 23-3-250.A.5.B
That portion of a lot which abuts a public or private street right-of-way shall be landscaped for a
distance of ten (10) feet, measured at a right angle from the lot line towards the interior of the lot.
Driveways may pass through the required landscaped areas. Additional information is requested
as to the proposed plantings on the berm fronting County Road 17, the topsoil stockpile and all
other disturbed areas. Staff requests information on, the method of the installing the seed on all
disturbed areas. Further, staff requests information on the proposed seed mix, installation
methods of the seed and irrigation provided to ensure good initial year growth the newly installed
plant materials. It is uncertain how this is accomplished. Please provide additional comment.
Section 23-3-250.A.6
Areas used for trash collection shall be screened from public rights-of-way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind- or
animal-scattered trash. The application materials did not identify the location of the dumpster on
the plat. Future submittals shall address this issue as outlined in this Section of the Code.

Outside Storage. Uses involving outdoor of materials shall be screened from public rights-of-way
and all adjacent properties. The applicant shall submit documentation as to how the outside
storage will be screened during the construction period, and for periods thereafter, as applicable.
The undocumented mobile home per the Assessor's Property profile and utilized for storage per
the application materials must be removed from the property. Section 23-1-90 of the Weld
County Code defines a Mobile Home as:
MOBILE HOME:A transportable STRUCTURE which as originally built exceeds either
eight(8) feet in width or thirty-two (32) feet in length, was originally built on a chassis and
was originally designed to be used as a year-round DWELLING UNIT with or without a
permanent foundation.
A SINGLE-FAMILY DWELLING which is certified pursuant to the "National Manufactured
Housing Construction and Safety Standards Act of 1974," 42 U.S.C. 5401, et seq., as
amended, but does not meet all of the other provisions of the definition of
MANUFACTURED HOME, is considered to be a MOBILE HOME.
A MOBILE HOME or MANUFACTURED HOME shall not be converted to any USE other
than a SINGLE-FAMILY DWELLING and shall not be allowed to deteriorate to the
condition of a DERELICT MOBILE HOME.
A MOBILE HOME or manufactured home, converted or in its original condition, shall not
be used as an AGRICULTURALLY EXEMPT BUILDING or as a TEMPORARY
STRUCTURE for storage.
• The transient mobile home (Fifth Wheel) does not meet the intent of this Section of the Weld
County Code, and therefore must be removed from the property.
Section 23-3-250.B.
Operation Standards. Uses shall demonstrate conformance with the following operation
standards to the extent that they are affected by location, layout and design prior to construction
and operation.
Section 23-2-250.B.6
Light. Any lighting, including light from high temperature processes such as welding or
combustion, shall be designed, located and operated in such as manner as to meet the following
standards: sources of light shall be shielded so that beams or rays of light will not shine directly
onto adjacent properties; neither the direct nor reflected light from any light source may create a
traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may
be used which may be confused with or construed as traffic control devices. The application
materials did not include a Lighting Plan. Should exterior lighting be a part of this facility, all light
standards shall be delineated on the USR Plat.

Property Maintenance. Property shall be maintained in such a manner that grasses and weeds
are not permitted to grow taller than twelve (12) inches. In no event shall the property owners
allow the growth of noxious weeds. The application materials do not address property
maintenance. Future correspondence shall identify how the property will be in compliance with
this Section of the County Code.

Section 23-4-20
• Off-Street Parking. The applicant shall delineate on the plat the location of the parking area that
is in compliance with this Section of the Code, and demonstrate compliance with Section 23-4-30,
Design and Construction of parking spaces. Future correspondence shall identify how the
property will be in compliance with these Sections of the County Code.
Section 23-4-50.
Off Street Loading. The applicant shall delineate on the plat the location of the loading area that
is in compliance with this Section of the Code. There shall be no parking or staging of trucks
within the public rights-of way. Further, the applicant shall meet all requirements of the
Department of Public Works concerning access and internal circulation of vehicles for this
proposed facility.
Division 2 — Signs
Section 23-4-90
Signs. The application materials did not address the issue of on-site signs. The applicant shall
provide written evidence that all proposed signs are in compliance with this Section of the Code.
Sixteen (16) square feet is the allowable size of a sign in the Agricultural Zone District
End Memorandum.

1. Building permits shall be obtained prior to the change of use of all structures and for all
existing structures on the property that have not been permitted which require permits.
• Certificate of Compliance permits for pole structures which meet the requirements as Ag-
Exempt under Weld County definitions are required for all proposed new structures and any
existing structure which permits were not obtained.
2. A plan review is required for each building or structure for which a building permit is required.
Two complete sets of plans are required when applying for each permit. Include a Code
Analysis Data sheet for the Weld County Building Department for each structure that requires a
permit. Submittal plans shall include a floor plan showing the specific uses of each area for the
building. Plans shall bear the wet stamp of a Colorado Licensed Architect or Engineer.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2006 International Residential Code; 2006 International Mechanical Code; 2006
International Plumbing Code; 2006 International Fuel Gas Code; 2006 International Energy
Code; 2003 ICC ANSI 117.1 Accessibility Code; 2008 National Electrical Code and Chapter 29
of the Weld County Code.
4. All building plans shall be submitted to the Platteville Fire Department for review and
approval prior to issue of building permits.

The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process. All issues of concern and critical issues
during further review must be resolved with the Public Works Department.
COMMENTS:
Weld County Road Classification Plan (FHU): WCR 17 is a local gravel road and requires a 60-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required
setback is measured from the future right-of-way line.
Our most recent AADT count reflects 70 vehicles per day taken in June 2006.
• Site Plan: The applicant shall utilize the existing accesses to this parcel, no additional access will be
granted.
1. Parking areas and the access drive shall be surfaced with gravel, recycled asphalt or the
equivalent and shall be graded to prevent drainage problems.
2. The dirt berm should 3 '/s' high or less near the access drives to allow for adequate site distance
in both directions.
3. The berm width as shown on the site plan is likely not adequate for the berm to be stable. The
berm may need to be much wider than shown and the propane tank and power pole may need to
be moved.
4. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other
than grasses, needs to be maintained at a maximum height of 12 inches until the area is
completely developed.
Storm Water Drainage: A water quality capture feature to control run-off from your property is required.
The area provided for the water quality capture feature is acceptable.
5. The area for the water quality feature shall be called out as "Reserved Drainage Area, No Build"
on the USR site plan.
6. The roadside ditch shall be kept free of debris and fill from the berm. The applicant must take into
• consideration storm water capture/quantity and provide accordingly for best management
practices.

7. The historical flow patterns and run-off amounts will be maintained on site in such a manner that

it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.
Flood Hazard Development Standards: A portion of the Cogburn property is in a Special Flood Hazard
Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA) but the boundary of
this USR is outside of the SFHA.

Environmental Health Services has reviewed this proposal for a home excavating
business and vehicle parking. There are no employees associated with this request.
There are two residences located on the property; the north two bedroom home is used
for the property owner's residence and the south two bedroom home is used for the
applicant's residence and business office.
Water is provided by Central Weld County Water District (Account Nos.101630 and
102181) and the homes are served by individual sewage disposal systems (Permit SE-
0900050 for the north 2 bedroom home and SE-0900051 for the south 2 bedroom
• home). Both septic permits are "Statement of Existing" and are based on information
provided by the owner. These existing septic systems were evaluated for adequate size
and capacity on December 2, 2009. The results of that evaluation found that the septic
tanks are of sufficient size and capacity to handle the flow for the two bedroom homes
but not enough information was available to determine if the field sizes are adequate.
Septic Policy 2.2.D.3 was adopted December 7, 2009 and requires evaluation of any
septic system that is changing from residential to commercial use. Since the south
home will be used for the business, the applicant is required to provide an accurate
drawing, which depicts sizing and location of the existing septic system to this
Department. If the absorption field is undersized by more than 20 percent, this
Department requires that the absorption field be brought into compliance with current
ISDS Regulations. On December 4, 2009, Mr. Collins contacted the Environmental
Health Division to inform that he planned to install a new septic field for each of the two
homes. To date, the applicant has not applied for septic repair permits for the two
homes.
Various vehicles and equipment will be stored on-site. Also, there are two trailers on the
property used for storage of construction tools and supplies. The application indicates
that maintenance will be performed on the vehicles and equipment. Waste oil from
maintenance of the vehicles and equipment will be stored in 55 gallon drums for
removal by a recycling company, Tri-State Oil Reclaimer. According to the site plan
• provided by the applicant, there is also a 1000 gallon aboveground fuel tank located in a
• plastic lined, bermed area on the property. However, according to pictures provided by
the Weld County Planning Department, there are additional aboveground storage tanks
and numerous drums on the property. Mr. Collins informed that he plans to only keep
2-1000 gallon aboveground tanks to store diesel fuel and 2-55 gallon drums to store
waste oil. These aboveground storage tanks and drums will be located in the bermed
area on the property. Any of the aboveground storage tanks and 55 gallon drums not
recorded on the plat must be removed and properly disposed.
A waste handling plan is required and should include the name, address and phone
number of the waste removal and disposal companies. The plan should indicate how
any waste associated with the business, such as waste oil, tires, batteries, garbage, ect.
is disposed of.
A dust abatement plan, for on-site dust, is required. The dust abatement plan shall
include control of dust from the handling and stockpiling of soil. Noise will be restricted
to the level allowed in the residential zone district.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
• 1. The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
2. An accurate drawing, which depicts sizing and location, of the existing septic
system for the south two bedroom home (Permits SE-0900051) shall be provided
to the Environmental Health Services Division of the Weld County Department of
Public Health and Environment for review. If the absorption field is undersized by
more than 20 percent, the septic field shall be brought into compliance with
current ISDS Regulations.
3. Alternately to item #2 above, the applicant shall install individual sewage disposal
system in accordance to the Weld County Individual Sewage Disposal
Regulations.
4. In the event washing of vehicles will occur on site the applicant shall ensure that
any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.

• 5. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
6. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment. In accordance with Section 3-6-1 of
the Colorado Department of Labor and Employment Division of Oil and Public
Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations
(40 CFR Part 112).
7. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
• 3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
8. Any aboveground storage tanks and 55 gallon drums not recorded on the plat
must be removed and properly disposed.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.

• 4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
6. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from drum washing and the washing of vehicles in accordance with the Rules
and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in Section 14-9-30 of the Weld County Code.
9. Adequate drinking, hand washing and toilet facilities shall be provided at all
times.
10.Sewage disposal for the facility shall be by septic system. Any septic system
• located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing public water supply. (Central Weld
County Water District)
12.The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.
13.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
14.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
15.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

provided by the owner. These existing septic systems were evaluated for adequate size
and capacity on December 2, 2009. The results of that evaluation found that the septic
tanks are of sufficient size and capacity to handle the flow for the two bedroom homes
but not enough information was available to determine if the field sizes are adequate.
Septic Policy 2.2.D.3 was adopted December 7, 2009 and requires evaluation of any
septic system that is changing from residential to commercial use. Since the south
home will be used for the business, the applicant is required to provide an accurate
drawing, which depicts sizing and location of the existing septic system to this
Department. If the absorption field is undersized by more than 20 percent, this
Department requires that the absorption field be brought into compliance with current
ISDS Regulations. On December 4, 2009, Mr. Collins contacted the Environmental
Health Division to inform that he planned to install a new septic field for each of the two
homes. To date, the applicant has not applied for septic repair permits for the two
homes.
Various vehicles and equipment will be stored on-site. Also, there are two trailers on the
property used for storage of construction tools and supplies. The application indicates
that maintenance will be performed on the vehicles and equipment. Waste oil from
maintenance of the vehicles and equipment will be stored in 55 gallon drums for
removal by a recycle company, Tri-State Oil Reclaimer. There is also a 1000 gallon
•
• aboveground fuel tank located in a bermed area on the property. The application also
indicates that soil will be stockpiled on the property.
A waste handling plan is required and should include the name, address and phone
number of the waste removal and disposal companies. The plan should indicate how
any waste associated with the business, such as waste oil, tires, batteries, garbage, ect.
is disposed of.
A dust abatement plan, for on-site dust, is required. The dust abatement plan shall
include control of dust from the handling and stockpiling of soil. Noise will be restricted
to the level allowed in the residential zone district.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
2. An accurate drawing, which depicts sizing and location, of the existing septic

system for the south two bedroom home (Permits SE-0900051) shall be provided
to the Environmental Health Services Division of the Weld County Department of
Public Health and Environment for review. If the absorption field is undersized by
more than 20 percent, the septic field shall be brought into compliance with
current ISDS Regulations.
3. Alternately to item #2 above, the applicant shall install individual sewage disposal
system in accordance to the Weld County Individual Sewage Disposal
Regulations.
4. In the event washing of vehicles will occur on site the applicant shall ensure that
any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
5. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.

6. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
•
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment. In accordance with Section 3-6-1 of
the Colorado Department of Labor and Employment Division of Oil and Public
Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations
(40 CFR Part 112).
7. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
• Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
6. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from drum washing and the washing of vehicles in accordance with the Rules
and Regulations of the Water Quality Control Commission, and the

Environmental Protection Agency.

7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in Section 14-9-30 of the Weld County Code.
9. Adequate drinking, hand washing and toilet facilities shall be provided at all
times.
10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing public water supply. (Central Weld
County Water District)
12.The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.
13.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
14.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.
