Iii 1 RESOLUTION RE: REVOCATION OF SPECIAL USE PERMIT NO. 348 FOR AN OIL FIELD DISPOSAL SITE ISSUED TO STAN RECH, BOX 303 , FT. LUPTON, COLORADO 80620 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on December 18 , 1978 , the Board of County Com- missioners of Weld County, Colorado granted Special Use Permit No. 348 to Stan Rech for an oil field disposal site on a tract of land described as follows : That part of the West one-half of the Southwest one-quarter of Section 22 , -Township 2 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, described as: Beginning at the Northeast corner said West one-half Southwest one-quarter; Thence South 00°04 ' 13" West on an assumed bearing along the East line said West one-half Southwest one-quarter, a dis- tance of 792 . 00 feet; Thence South 89°49 '25" West parallel with the North line said West one-half Southwest one-quarter a distance of 330 . 00 feet; Thence North 00°04 '13" East a distance of 792 . 00 feet to a point on the North line said West one-half Southwest one- quarter; Thence North 89°49 ' 25" East along said North line a distance of 330 .00 feet to the point of beginning. WHEREAS, after hearing testimony and evidence presented in this matter, the Board of County Commissioners finds that the operation of said oil field disposal system has created adverse effects on surrounding property, namely direct damage to surrounding property, and WHEREAS , the Board finds that it would be in the best interests of Weld County, Colorado to revoke said Special Use Permit No. 348 . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Special Use Permit No . 348 for an oil field disposal site issued to Stan Rech be, and hereby is, revoked. Mr. Honn reviewed what has transpired to date. John Hall reviewed the Health Department reports. Wayne Smyth commented on the status of County Road #31 . Sam Oldenburg, legal counsel for for Mr. Stan Rech, testified, and stressed that Mr. Rech has discontinued the operation. Mr. Oldenburg requested that the injunction be held up, allow the land to dry up, allow time to modify the operation, and that Mr. Rech will not begin the operation without the County Commissioners consent. Mrs . Kathern Sprague, an adjacent landowner, commented on the oilsaturated condition of her property. Kenneth Lind, legal counsel for Mr. & Mrs . Adolph Anderson, disagreed with the proposed temporary suspension as requested by Mr. Oldenburg and recommened that the operation be shut down. After discussion, Commissioner Kirby made a motion to revoked Special Use Permit #348 :77 : 22 because of the property damage to the adjacent landowners . Commissioner Dunbar seconded the motion and it carried unanimously. The facility is no longer being used as intended. The leach- fiel-d area is now inundated with dumped wastewater and is not being leached into the soil. -Also, a large dike has been con- structed along the western edge of the leach area to hold this wastewater over the leaching area. 2. The area soils appear ro be oversaturated with -the disposed wastewater. Two sump areas have appeared on Weld County Road 31 and one area is fed by wastewater coming out of the ground near the facility entrance road. We feel that these adverse conditions have appeared slue to misuse and complete system oversaturation. If you have any questions, please contact this office. The purpose of the hearing is to discuss the operation and to determine if the development standards for said SUP are being complied with and/or if adverse conditions have been created as a result of the operation. The Weld County Health Department , ' in correspondence dated April 12, 1979 addressed to the Director of the Department of Planning Services, indicated two primary concerns. One is that the leach field area is apparently no longer functioning as intended, as evidenced by inundation of and diking around the intended leach area. The second is that disposed water appears at locations off the site. If in the opinion of the Weld County Board of Commissioners adverse conditions exist, the Board will consider revocation of Special Use Permit No. 348 :77 :22. Large amounts of water are flowing downhill to the west with Weld County Road 31 closed because of deep mud. I saw one disposal truck unloading. Then leaving the area to the south through the house area of Stan Rech. This is my second visit in the last 6 months and I could see the area where the leachfield is located under water and apparently the top soil has collapsed with the white vent pipes remaining above the water level. My estimate is the area under water is 100 x 300 feet. He stated that he felt he was partially to blame for the problems on County Road 31 , but he did not feel that he was entirely to blame . Because this occu the water immediately froze in the ground, and now is beginning to thaw. Mr. Rech said the water standing over the leach field is very shallow. He kept referring to this leach field as a pond which leaches . him because of this problem. Said above-mentioned track exited the private road turning South on County Road 31 , thus ignoring the "Road Closed" sign. It did not appeal to me that Lire flowing water surfacing appox. 30 ' west of the dyked leach field has subsided much at all since my April E3 , 1979 inspection. The leach field ponding still has a lot of water existing. At the intersection of County Road 31 and the private east/west road, the flowing water is submerging causing a drastically muddy large area L the immediate northeast of said intersection. It was not visible where the xixcsmxmi east/west flow stops . It appears to re-enter the ground at said intersection and with a good spring rain, will again cause the road to be unpassable, in my opini-an emain closed, in my opinion because if anyone drove over 5 miles an hour through these low spots that are very baddly rutted, danger does exist onin Inspector Note: Attach this sheet to the complaint report pertaining to this zoning violation.
