RE: ACTION OF THE BOARD CONCERNING AUTHORIZATION FOR THE WELD COUNTY
ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ALBERTO'S FOR
VIOLATIONS OF THE COLORADO RETAIL FOOD ESTABLISHMENT RULES AND
REGULATIONS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Alberto's, operated/owned by Becky Morales and Brian Morales, located at
2605 West 11th Street Road, Greeley, Colorado 80634, is allegedly in violation of the Colorado
Retail Food Establishment Rules and Regulations, and
WHEREAS, despite efforts by the Weld County Department of Public Health and
Environment staff to resolve said matter, the violations were not been corrected, and
WHEREAS, on the 8th day of February, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violations, and
WHEREAS, Becky Morales and Brian Morales, property owner/manager, were present at
said hearing and requested a continuance to allow them adequate time to retain legal counsel to
present their evidence, and
WHEREAS, after hearing testimony from the Department of Public Health and Environment,
and the lack of a response from the property owner/manager to dispute staff's evidence, the Board
of County Commissioners deemed it advisable to issue a two-day suspension of the Retail Food
Establishment License held by Alberto's for violation of the Colorado Retail Food Establishment
Rules and Regulations, effective immediately, and to set a new hearing for Wednesday,
February 10, 2010, at 9:00 a.m., to allow the operator/property owner adequate time to retain legal
counsel and prepare a response, and to make further determination of whether to assess the
$750.00 civil penalty, extend the suspension of operations, revoke the license, or dismiss the
hearing based upon evidence of an agreed upon Stipulation Agreement, and
WHEREAS, on February 10, 2010, after hearing testimony from all present, the Board of
County Commissioners deemed it advisable to continue the matter to the following Board meeting
on Wednesday, February 17, 2010,with the understanding that Alberto's will be closed until the next
hearing under a voluntary suspension and is directed to present the Board with a Stipulation
Agreement for consideration, and
WHEREAS, on February 17, 2010, after hearing testimony from all present, the Board of
County Commissioners deems it advisable to approve the proposed Stipulation Agreement and
dismiss the Violation hearing.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Stipulation Agreement, dated February 17, 2010, be and hereby is
approved.
BE IT FURTHER RESOLVED by the Board that the Hearing concerning Alberto's,
operated/owned by Becky Morales, located at 2605 West 11th Street Road, Greeley, Colorado
80634, for violation of the Colorado Retail Food Establishment Rules and Regulations, be, and
hereby is, dismissed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 17th day of February, A.D., 2010.

SUBJECT: Alberto's
Alberto's Restaurant, located at 2605 W. 11th Street Road, in Greeley, Colorado has failed
to maintain compliance with the Colorado Retail Food Establishment Rules and
Regulations (please see attached time line). The Weld County Department of Public Health
and Environment has given the facility all opportunities to come into compliance as
afforded to them in the Colorado Revised Statutes. Unfortunately, staff continues to
observe violations that have the potential to directly result in illnesses of patrons dining at
the establishment.
The Weld County Department of Public Health and Environment recommends the Board
of County Commissioners (BOCC) to revoke or suspend Alberto's Restaurant Retail Food
Establishment License. In the event the facility's Retail Food Establishment license is not
revoked or suspended, the Department recommends that the BOCC direct the facility pay
the assessed civil penalty as a condition of continued operation.

History of Violations 2005 - 2010
SUMMARY
Since 2005 the Department has performed 30 inspections where 174 violations were cited
for an average of 5.8 per inspection. Since 2008 we have conduct 15 inspections (50%) and
violation per inspection have been 6.8 per inspection (102 violations). This means that the
number of violations is increasing.
If you just look at regular inspection since 2005 (12 inspections), 94 violations were cited
for an average of 7.8 per inspection. We currently cite 2.4 violations per regular inspection
(average of all facilities). This is more than 3 times the average for all facilities.
16 of the inspections conducted from 2005 have had 6 or more violations and food was
disposed of on 13 inspections.
Of the 174 violations cited, 122 were critical violations (70%). Of those critical violations,
68 (56%)were food borne illness risk factors.
In addition this facility had a confirmed food borne illness outbreak in 2006 where there
were at least 18, but most likely more, people who were sickened.

This Stipulation in Resolution of Failure to Maintain Compliance("Stipulation") is
entered into between Weld County, Colorado, through its Board of Commissioners ("County")
and Alberto's ("Restaurant") in resolution and satisfaction of all issues that are the subject of the
above-referenced Failure to Maintain Compliance hearing, it being agreed as follows:
Restaurant Obligations:
A. The Restaurant shall provide additional onsite training within 10 days of approval of
this Stipulation by the County. This training shall be in addition to training conducted
by staff of the Weld County Department of Public Health and Environment
(Department). Such training session shall be attended by all members of the
Restaurant's staff who are responsible for the preparation and service of food,
including all members of the management team, wait staff, and kitchen personnel.
The training-anti shall include instruction regarding cross contamination, improper
hand washing, bare hand contact with ready to eat foods, cooling, proper use of
thermometers, and cold holding of potentially hazardous food. The Restaurant shall
provide written verification that all members of its staff, including management, have
been trained in these subjects.
B. Within 45 days following approval of this Stipulation, the Restaurant's management
staff shall complete additional training regarding the subjects listed in paragraph I(A)
above and provide proof of completion of such training to the County upon request.
The "Serve Safe for Managers" class shall be sufficient training; however, alternative
training may be sufficient upon approval by the County.
C. The Restaurant shall pay a civil penalty of$750.00 to the County upon the date of
approval of this Stipulation.
D. The Restaurant shall keep temperature logs to record the temperature of food
materials to which temperature regulations apply (logs shall be kept for hot holding,
cold holding, cooling and reheating). Such logs shall note the time of the
measurement and the temperature of the materials and shall be updated every three
hours the facility is in operation. The Restaurant shall designate one member of its
staff as the person responsible for the maintenance of the temperature log during each

period of time the Restaurant is in operation. Copies of logs shall be submitted to the
Department at a frequency of once per week for a time period of three months. After
the three month period logs shall be submitted once every two weeks for three
additional months. (Are members of the Health Department_oingto stop in

E. The Restaurant shall designate a staff person to be "in charge" of all operations
during periods when the owner/manager is not present. Can it he more than one

F. The Restaurant shall adhere to the short term strategy and strategies for opening
documents submitted to the Department on February 10, 2010. A copy of that
document is attached hereto and made a part of this Stipulation.
G. The Restaurant shall provide a long term strategy to maintain compliance to the
Department within 10 days of approval of this Stipulation.
H. The Department shall conduct an inspection prior to the re-opening of the Restaurant
to ensure that the facility is in compliance with the Colorado Retail Food
Establishment Rules and Regulations. If the Department feels that the facility is not
in compliance, the Restaurant understands that it may be required to close for a period
of time longer than agreed upon with the Board of County Commissioners during the
February 10, 2010, hearing.
II. EFFECT OF APPROVAL
A. The Restaurant's obligations as outlined in this Stipulation are contingent upon
approval by the Board of Count Commissioners of Weld County, Colorado. County.
B. If the Department asserts that the Restaurant has not complied with the obligations
and terms and conditions of this Stipulation, the Department shall provide written
notice to the Restaurant of the alleged violation and may take appropriate action,
including,if the Department deems appropriate, bringing the matter back before the
Board for hearing upon the allegation of noncompliance, and appropriate action by
the Board if the allegation if found to be true. If the Department does not pursue any
action against the Restaurant by April 30, 2010, the then terms of this Stipulation
shall be deemed to have been complied with and fully satisfied by the Restaurant.
