Long Date of signature: 3///0 2010-0313 HL0037 reicit,--6.,4- Memorandum I C. TO: Board of County Commissioners From: Dan Joseph COLORADO DATE: February 8,2010 SUBJECT: Alberto's Alberto's Restaurant, located at 2605 W. 11th Street Road, in Greeley, Colorado has failed to maintain compliance with the Colorado Retail Food Establishment Rules and Regulations (please see attached time line). The Weld County Department of Public Health and Environment has given the facility all opportunities to come into compliance as afforded to them in the Colorado Revised Statutes. Unfortunately, staff continues to observe violations that have the potential to directly result in illnesses of patrons dining at the establishment. The Weld County Department of Public Health and Environment recommends the Board of County Commissioners (BOCC) to revoke or suspend Alberto's Restaurant Retail Food Establishment License. In the event the facility's Retail Food Establishment license is not revoked or suspended, the Department recommends that the BOCC direct the facility pay the assessed civil penalty as a condition of continued operation. Note: Power point presentation is prepared. 2010-0313 Alberto's History of Violations 2005 - 2010 SUMMARY Since 2005 the Department has performed 30 inspections where 174 violations were cited for an average of 5.8 per inspection. Since 2008 we have conduct 15 inspections (50%) and violation per inspection have been 6.8 per inspection (102 violations). This means that the number of violations is increasing. If you just look at regular inspection since 2005 (12 inspections), 94 violations were cited for an average of 7.8 per inspection. We currently cite 2.4 violations per regular inspection (average of all facilities). This is more than 3 times the average for all facilities. 16 of the inspections conducted from 2005 have had 6 or more violations and food was disposed of on 13 inspections. Of the 174 violations cited, 122 were critical violations (70%). Of those critical violations, 68 (56%)were food borne illness risk factors. In addition this facility had a confirmed food borne illness outbreak in 2006 where there were at least 18, but most likely more, people who were sickened. CRITICAL ITEMS Critical items are related directly to foodborne illness. Food Borne Illness risk factors identified by the Centers for Disease Control most commonly contributing to foodborne illness. lb Dented Can/Food Product Un-wholesome Cited on May 10, 2006 Cited on October 12, 2007 Cited on December 18, 2008 Cited on March 20, 2009 Cited on May 28, 2009 Cited on September 30, 2009 lc Cross contamination Cited on May 10, 2006 Cited on May 22, 2006 2c Improper hand washing Cited on July 12, 2005 Cited on December 6, 2005 Cited on May 10, 2006 Cited on May 22, 2006 Cited on May 28, 2009 Cited on September 30, 2009 (twice) Cited on December 4, 2009 2d Improper hygienic practices Cited on December 6, 2005 Cited on May 10, 2006 (twice) Cited on May 22, 2006 Cited on April 1, 2008 Cited on October 21, 2008 (twice) Cited on March 20, 2009 Cited on April 21, 2009 Cited on September 30, 2009 (twice) Cited on October 22, 2009 Cited on November 20, 2009 2e Improper drink storage Cited on May 10, 2006 Cited on June 15, 2007 Cited on October 12, 2007 Cited on May 28, 2009 Cited on September 30, 2009 Cited on November 20, 2009 2f Demonstration of Knowledge (unable to demonstrate) Cited on July 12, 2005 Cited on May 10, 2006 Cited on May 22, 2006 Cited on June 20, 2006 Cited on October 22, 2009 Cited on November 20, 2009 Cited on December 4, 2009 Cited on January 13, 2010 2g Bare hand contact of ready to eat foods Cited on October 12, 2007 Cited on April 1, 2008 Cited on May 28, 2009 Cited on December 4, 2009 (twice) 3a Improper cooling Cited on July 12, 2005 Cited on July 21, 2005 Cited on December 6, 2005 Cited on May 10, 2006 Cited on May 22, 2006 Cited on June 20, 2006 Cited on October 27, 2006 Cited on December 28, 2006 Cited on May 28, 2009 Cited on September 30, 2009 Cited on October 22, 2009 3b Improper reheating Cited on December 6, 2005 Cited on December 4, 2009 3c Improper hot holding Cited on October 27, 2006 Cited on June 15, 2007 Cited on October 21, 2008 Cited on November 18, 2008 Cited on May 28, 2009 Cited on October 22, 2009 Cited on December 4, 2009 Cited on January 13, 2010 3e Improper cold holding Cited on July 12, 2005 Cited on July 21, 2005 Cited on May 10, 2006 Cited on June 20, 2006 Cited on October 27, 2006 Cited on June 15, 2007 Cited on March 20, 2009 Cited on April 21, 2009 Cited on May 28, 2009 Cited on June 19, 2009 Cited on January 13, 2010 3f Food thermometer not calibrated Cited on March 20, 2009 4a Improper concentration of sanitizer in 3 compartment sink Cited on June 20, 2006 Cited on December 28, 2006 Cited on December 4, 2009 Cited on January 13, 2010 5b No hot water at hand sink Cited on June 20, 2006 6c No soap or paper towels Cited on May 10, 2006 Cited on May 22, 2006 Cited on April 1, 2008 Cited on October 21, 2008 Cited on November 18, 2008 Cited on March 20, 2009 Cited on December 4, 2009 Cited on January 13, 2010 8a Poisonous items improperly stored Cited on June 15, 2007 Cited on November 18, 2008 8b Poisonous items improperly labeled Cited on May 10, 2006 Cited on May 22, 2006 Cited on October 12, 2007 Cited on April 1, 2008 Cited on October 21, 2008 Cited on December 18, 2008 Cited on March 20, 2009 Cited on April 21, 2009 Cited on January 13, 2010 8c Chemicals used at incorrect levels (toxic) Cited on December 6, 2005 Cited on May 10, 2006 Cited on May 22, 2006 Cited on June 20, 2006 Cited on October 27, 2006 Cited on December 18, 2008 Cited on March 20, 2009 Cited on April 21, 2009 Cited on May 28, 2009 Cited on June 19, 2009 Cited on October 22, 2009 Cited on November 20, 2009 Cited on January 13, 2010 LETTERS ISSUED May 16, 2006: First Notification of Non-Compliance (2c, 2d, 3a, 8c) May 31, 2006: Notice of Civil Penalty($250.00) for 3a June 27, 2006: Informal Hearing held and Second Notice of Civil Penalty Issued ($500.00) for 3a.
