HART.
WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, at a public meeting
held on the 4th day of October, 1976, in the Chambers of the
Board of County Commissioners, Weld County, Colorado, that
a certain parcel of land, being the property of Robert D.
Hart and Rose M. Hart, 11142 Rd. 19, Fort Lupton, Colorado,
80621, described as a portion of the West Half of the South-
west Quarter of Section 3 , Township 2 North, Range 67 West of
the 6th P.M. , Weld County, Colorado, more particularly de-
scribed as follows :
Total Parcel
Beginning at the Southwest corner of said Section 3; thence along the South line of the
Southwest Quarter of said Section 3 North 90°00'00" East 850.45 feet; thence on a line
parallel to the East line of the West Half of the Southwest Quarter North 00°12'15" East
a distance of 330.00 feet; thence parallel to the South line of the Southwest Quarter

terms "subdivison" and "subdivided land" as set forth in
Section 30-28-101 (10) , CRS, 1973, as amended, and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS, 1973, as amended, and Section 2-lA(3) of the Weld County
Subdivision Regulations ;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the hereinabove
described parcel of land owned by Robert D. Hart and Rose M.
Hart be exempt from the definition of the terms "subdivision"
and "subdivided land" as provided for in Section 30-28-101 (10)
(d) , CRS, 1973, as amended, and Section 2-lA(3) of the Weld
County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 6th
day of October, A.D. , 1976.

Dear Commissioners:
The attached application, plat and related materials are in reference
to a request by Robert D. Hart for a Recorded Exemption. The subject
property is described as part of the W1 of the SW4 of Section 3, T2N,
R67W of the 6th P.M. , Weld County, Colorado. Said parcel is located
three miles south and three miles west of Platteville, north east of
the intersection of County Road 24 and 19. The subject property contains
approximately 20 irrigated acres. The request is to split the property
into parcels of 11 .8 and 8.2 acres. Each resulting parcel would have
an existing residence and an existing garage-shop building. The proposed
division line follows an irrigation ditch which flows through the property
in a northwesterly direction.
On May 12, 1976, the Board of County Commissioners approved a request by
Mr. Hart for a lot size variance so that he could make application for this
Recorded Exemption. At the time the Board made a decision on that request,
the Planning Staff submitted a letter of recommendation to the Board. A
copy of that letter of recommendation is included in the attached packet.
Nothing has been received by our office which would change our recommendation
of approval for this request.

RE: Request for a Lot Size Variance
Dear Commissioners:
The attached materials are in reference to a request, by Robert D. Hart,
for a lot size variance on a parcel of land described as part of the
W' of the SWa of Section 3, Township 2 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado. Said parcel is located three miles south and three
miles west of Platteville northeast of the intersection of County roads
24 and 19. The subject property contains approximately 20 irrigated acres.
The request is to split the property into parcels of 12 and 8 acres .
Each resulting parcel would have a residence and a garage shop building.
The proposed division line follows an irrigation ditch which flows through
the property in a northwesterly direction.
Based upon the information submitted, the Planning Commission staff recommends
approval for the following reasons:
1 . The proposed split conforms with the intent clause (Section 9-2)
of the Weld County Subdivision Regulations, the intent clause for
the Agricultural District (Section 3-3(A) of the Weld County
Zoning Regulations), and the Weld County Comprehensive Plan in that
each resulting parcel would have an existing set of improvements.
The use would be compatible with surrounding agricultural uses .
