RE: APPROVAL OF PRELIMINARY PLAN - I-25 SUBDIVISION, HAROLD
AND FRED REESE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 23rd day of April, 1979, the Preliminary
Plan of I-25 Subdivision, Harold and Fred Reese, was submitted
to the Board of County Commissioners of Weld County, Colorado
for approval in accordance with the Subdivision Regulations of
Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all of
the testimony and statements of those present, and
WHEREAS, the Board of County Commissioners had evidence
presented in support of approval of said Preliminary Plan, and
no evidence was presented in opposition to the approval of the
Preliminary Plan for the following described real estate, to-wit :
That part of the East one-half Southeast one-quarter
of Section 10, and that part of the Northeast one-
quarter Northeast one-quarter of Section 15, Town-
ship 2 North, Range 68 West of the 6th Principal
Meridian, Weld County, Colorado, described as:
Beginning at the Northeast corner of said East one-
half Southeast one-quarter; thence N89°51'57"W on
an assumed bearing along the North line of said
East one-half Southeast one-quarter a distance of
50.20 feet to a point on the Westerly R.O.W. line
of Interstate 25, said point being the true point
of beginning; thence continuing N89°51'57"W along
said North line, a distance of 1274.04 feet to the
Northwest corner of said East one-half Southeast
one-quarter; thence S00°27'38"W along the West
line of said East one-half Southeast one-quarter
a distance of 2695.47 feet to a point 30.00 feet
South of the Southwest corner of said East one-half
Southeast one-quarter; thence S89°46'03"E, parallel
with the South line of said East one-half Southeast
one-quarter, a distance of 1076.78 feet to a point
on said Westerly R.O.W. line of Interstate 25; thence
Northerly along said Westerly R.O.W. line as follows:
N00°03'30"W, 210.50 feet;
N05°41'40'E, 2182.24 feet;
N00°28'00"E, 314.80 feet to the true
point of beginning.
Contains 72.94 Acres more or less.
WHEREAS , the petitioner was present , and

WHEREAS, the Board of County Commissioners has studied the
request as submitted, and having been fully informed, is satis-
fied that the submitted Preliminary Plan conforms in all respects
with the requirements of Section 5 of the Weld County Subdivision
Regulations, and that approval of said Preliminary Plan would
be in the best interest of Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Preliminary Plan
of I-25 Subdivision, Harold and Fred Reese, located in Part of
the East Half, Southeast Quarter of Section 10 and Part of the
Northeast Quarter, Northeast Quarter of Section 15, Township 2
North, Range 68 West of the 6th P.M. , Weld County, Colorado be,
and hereby is , approved provided that:
1. The applicant addressing the problems of the high ground
water-table, the potential of swelling soils and the
sewage disposal systems in the application for the final
plat. These problems were identified by the Colorado
Geological Survey and the Weld County Health Department.
These items should be addressed to show the mitigation
of any potential adverse effects on the property, adja-
cent property and the immediate area.
2. The following statements being drafted on the final plat :
A. No vehicular access shall be permitted to or from
the east side of Lots 1 , 3, 5, 7 , 9, 11, 12 , 13 & 14, Block 1.
B. No trees, shrubbery and other perennials which creates
a restriction to drainage and/or interference with
the maintenance, repair and replacement of any utilities
within utility easements shall be permitted.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the reasons for approval contained in the Department of
Planning Services recommendations dated April 17, 1979 be, and
hereby are, incorporated as the findings of fact of the Board
of County Commissioners in this matter.
The above and foregoing Resolution was, on moiton duly made
and seconded, adopted by the following vote on the 23rd day of
April, A.D. , 1979.

passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the Subdivision
PlatPrel. Plan — I-25 Subdivision located on the following described pro-
perty in Weld County, Colorado, to-wit:

be recommended (favorably) ( & Ni) to the Board of County Commissioners
for the following reasons:
1 . It is the opinion of the Planning Commission that the preliminary
plan conforms with the requirements of Section 5-4A of the Weld
County Subdivision Regulations . The preliminary plan as proposed
does not appear to be detrimental to the public health , safety
or general welfare .
2 . The Longmont Soil Conservation District has set forth no objections
to this request .
3 . The Weld County Utilities Review Advisory Committee on April 5 , 1979
approved the Utility Plan for the preliminary plan as presented.

PLANNING COMMISSION RECOMMENDATION
April 17 , 1979
4 . The Colorado Division of Highways has set forth no objections
to this request provided the applicant complies with its
recommendations contained in the letter dated March 14 , 1979
prior to approval of the final plat .
The Planning Commission recommendation for approval is conditional
upon :
1 . The applicant addressing the problems of high ground water-
table , the potential of swelling soils and the sewage disposal
systems in the application for the final plat . These problems
were identified by the Colorado Geological Survey and the
Weld County Health Department . These items should be addressed
to show the mitigation of any potential adverse effects on the
property, adjacent property and the immediate area.

Comments :
1. The Tri-Area Planning Commission and the Longmont Fire
Protection District did not respond to the referrals sent to
them. Section 5-3C of the Weld County Subdivision Regulations ,
states that : "the failure of any agency to respond within
twenty-four days or within the period of an extension may for
the purpose of the hearing on the plan be deemed an approval
of such plan . . . "
2 . To date , our office has not received any written opposition
to the proposed preliminary plan.
