HomeMy WebLinkAbout20101294.tiff RESOLUTION RE: APPROVE PETITION FOR ABATEMENT OR REFUND OF TAXES - KENNETH AND RANA BACHMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a hearing before the Board was held on the 26th day of May, 2010, at which time the Board deemed it advisable to continue said matter to June 16, 2010, to allow adequate time to for the Assessor to prepare, and WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, at a duly and lawfully called regular meeting held on the 16th day of June, 2010, at which meeting there were present the following members: Chair Douglas Rademacher, and Commissioners Sean P. Conway, William F. Garcia, Barbara Kirkmeyer, David E. During our conversation you indicated that if we provided documentation that this parcel was being used in an agricultural manner that this assessment could be reversed/corrected back to agricultural in nature. Attached to this letter I submit a letter signed by Daniel S Wolford, the manager of Parks, Open Space and Forestry stating that our parcel is being farmed by Mr. Paul Schlagel and has been since we purchased this parcel in 2007. Additionally I attach Form 4835 (Farm Rental Income and Expenses) for tax years 2008 and 2009 reflecting the expenses we pay for this parcel. Mr. Schlagel has historically had a lease with the City of Longmont to farm their open space property and in the process a portion of our parcel has been and is being farmed by Mr. Schlagel. Upon purchasing this parcel we saw no reason to change this arrangement and he has continued to farm our parcel even though we receive no compensation. Additionally, Mr. Schlagel uses our parcel for access to the City's property he is farming and on occasion stores his equipment on our parcel. In summation this parcel has always been used and is currently being used in a farming activity and therefore should be taxed as agricultural property.
