Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's(CBOE's)decision to the Board of Assessment Appeals(BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals, only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. (Section 39-8-108(10), C.R.S.) (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the CBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. ASSESSOR'S CURRENT VALUE Personal Property $29,042,240 ASSESSOR'S RECOMMENDED VALUE Personal Property $28,594,242 CBOE_PP_010998 Page 1 NARRATIVE The value on this account was originally derived from an asset listing supplied by the petitioner with their 2010 Personal Property Declaration. The declaration was sent electronically to our office by the taxpayer and it was reviewed and valued by our appraiser. The declaration was signed by the owner/agent declaring that the information provided on the declaration included a full and complete list of property and that no attempt had been made to mislead the Assessor as to its age, quality, quantity or value. Prior to this hearing, a revised asset listing was provided. The revised listing corrected the original cost of some equipment and identified set-top boxes with a cost less than $250. As a result of the 2007 published Colorado Court of Appeals case, EchoStar Satellite, L.L.C., and BAA v. Arapahoe County BOE and PTA, 05CA2584, those items with an original installed cost under $250 are exempt. The assessor has considered the three approaches to value in determining an actual value estimate for taxable Personal Property as required by§§ 39-1-103(5) and 104(12.3)(a)(I), C.R.S. COST APPROACH The recommended actual value of$28,594,242 was determined by classifying the assets reported on the declaration by the type of equipment, the year they were purchased and the original installed cost. The appropriate replacement cost new factors and depreciation tables were applied as mandated by the Colorado Department of Property Taxation. All set-top boxes with an original installed cost under $250 were exempted. COST APPROACH VALUE $28,594,242 CBOE_PP_010998 Page 2 MARKET APPROACH Pursuant to the Colorado Revised Statutes the Assessor has considered the Market Approach to value on Personal Property. Due to the insufficient sales comparables for this type of personal property, the Weld County Assessor has not utilized the Market Approach. INCOME APPROACH Pursuant to the Colorado Revised Statutes the Assessor has considered the Income Approach to value on Personal Property. Due to the insufficient rental rates for this type of Personal Property, the Weld County Assessor has not utilized the Income Approach. CONCLUSION The subject property has been classified as Personal Property for property tax purposes and was valued based on the revised asset listing provided by the taxpayer. The Assessor reviewed the Cost, Market and Income approach to value and selected the Cost Approach as the most accurate method for determining the value. All equipment on the asset listing was classified based on its use and was trended and depreciated in accordance with the procedures published in the Division of Property Taxation manuals. The Weld County Assessor recommends an adjustment from the original value of$29,042,240 to the revised value of$28,594,242. Comcast also has a new Senior VP of Tax as well. As directed by management, Pam began comprehensively reviewing the reporting practices, fixed assets and general ledger of the company. As this review was undertaken,one of her first priorities was determining why reported cost amounts did not tie directly to the GL. It became apparent that for some property types,the"book"or GL cost balances could be significantly overstated when compared to the actual property used in the various cable systems. Comcast is just beginning to understand the causes, nature and details surrounding the differences and will continue to quantify them as time goes on and make adjustments to their reporting where appropriate. Pam made the decision to report the costs from General Ledger to be in compliance with accounting standards and have a consistent base for reporting throughout the country.The following are some of the reasons that Comcast's GL can be overstated. • As cable networks were replaced and old technology removed, costs were deleted from the network but not always from general ledger. Therefore,ghost assets often remain on the books. For example,over$10 million in electronics was removed from Palm Beach county hubs over the years,yet those costs were still on the books. This problem is being investigated throughout the network. No assets from the Electronics portion of the fixed asset list have been deleted on the Colorado Returns, unless specifically falling under the$250 exemption. We are still investigating this issue and will report as information becomes available, possibly on next year's filing. • A few quick calculations have been done to get a sense of the overstatement of the general ledger. Based on the amount of entry in GI for set top boxes compared to box inventory,the GL cost is over$750 per box. The actual cost for a typical box is about $250 or less. These set top boxes have been removed due to the Colorado Exemption. I hope you can see that the costs on the returns are vastly inflated. Pam and her tax group adopted the policy to report the GL because these costs reflect the current books of Comcast. This final fixed asset listing has been carefully reviewed and a new revision is attached for your consideration. I hope this information has been helpful.
