691 RESOLUTION RE: APPROVE ZONING PERMIT FOR A COMMERCIAL VEHICLE,ZPCV#0060-MARLON OGDEN AND SHEILA ENGLISH-OGDEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners of Weld County, Colorado, on the 3rd day of May, 2010, considered the request of Marlon Ogden and Sheila English-Ogden, 5025 44th Avenue, Greeley, Colorado 80634, for a Zoning Permit for a Commercial Vehicle, and WHEREAS,said commercial vehicle is to be located in the A(Agricultural)Zone District on a parcel of land being more particularly described as follows: Lot 15 of Indian Hills Subdivision; located in Section 35, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing Marlon Ogden and Sheila English-Ogden *were/were nor present, and WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The zoning permit shall not be transferable by the applicant and/or owner to any successor. The zoning permit shall terminate automatically upon conveyance or lease of the property. 2. The property is in violation of Chapter 23 of the Weld County Code (Violation #ZCV10-00025). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer to ensure compliance of the property. 3. Approval of this application for a zoning permit application shall not be considered to release the applicant from complying with any private covenants in place. 4. The commercial vehicle permitted must be operational with current license plates at all times. 5. There shall be no parking or staging of commercial vehicles on the County Roads or rights-of-way. The applicant shall utilize on-site parking only. 6. The applicant shall maintain compliance with Section 23-4-950 of the Weld County Code at all times. 7. The term "Commercial Vehicle," as used herein, shall be limited to one (1) semi-tractor only. LEGAL DESCRIPTION Lot 15, of Indian Hills Subdivision, located in Section 35, T5N, R66W of the 6th P.M., Weld County, Colorado PARCEL NUMBER: 0959 35 202005 PARCEL SIZE: 1.74+/- ZONE DISTRICT: A (Agricultural) This case comes before the Board of County Commissioners as it does not meet the requirements of Section 23-4-960.B. as 50% of surrounding property owners have objected to the request. The Department of Planning Services'staff has reviewed this request and recommends this case be denied for the following reasons: Sec. 23-3-10. Intent in the A (Agricultural) Zone District Agriculture in the COUNTY is considered a valuable resource which must be protected from adverse impacts resulting from uncontrolled and undirected business, industrial and residential land USES. The A (Agricultural) Zone District is established to maintain and promote agriculture as an essential feature of the COUNTY. The A (Agricultural) Zone District is intended to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land USES. The A (Agricultural) Zone District is also intended to provide areas for the conduct of USES by Special Review which have been determined to be more intense or to have a potentially greater impact than USES Allowed by Right. The A (Agricultural) Zone District regulations are established to promote the health, safety and general welfare of the present and future residents of the COUNTY. (Weld County Codification Ordinance 2000-1) The Department of Planning Staff has concerns that although this is an Agricultural subdivision, it is surrounded by the City of Evans and is mostly residential. The Department of Planning has received opposition from fifty percent surrounding property owners, and staff concurred that the proposal compromises the safety and welfare of surrounding property owners. 2010-0924 Should the Board of County Commissioners approve this request, the following conditions shall apply: 1. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): 44`" Avenue within Indian Hill Subdivision is a local gravel road and requires an 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. REQUIREMENTS: Road Access Policy: (Policy Established Sec. 8-2-10) Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within the unincorporated areas of the County. Properties within municipalities or other counties which access County roads are subject to this policy.(44th Avenue access) A 60' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A minimum effective turning radius of forty (60) feet shall be used for accesses intended to accommodate truck traffic. We have several concerns regarding this request. • The commercial vehicle transports flammable, hazardous products causing concerns regarding potential leakage from the vehicle's connectors or seams. If any product were to leak or spill out it could contaminate the surrounding soil, groundwater, and vegetation. • There may exist health risks associated with the leakage of this type of product to local wildlife, domesticated animals, and nearby residents. • The emission of toxic, carcinogenic vapors into the area immediately surrounding my home. • By definition, the products this tanker transports are FLAMMABLE. The application makes no concessions for prevention of incineration or ignition from "Acts of God" or manmade sources (i.e. lightning, grass fires, or any man-made threats like cigarettes being thrown out a moving vehicle, lighters or matches being struck). • The permit application makes no provision for reconstruction of the certain road destruction, erosion, and ruts that the tanker owner is already illegally creating in the area and would surely increase in scope, frequency, and nature if the owner was allowed to park the tanker here legally. Some of the issues created by the roadway destruction include but are not limited to: possible danger to smaller vehicles, extensive under-carriage and/or tire and wheel damage to lightweight vehicles, and damage to property values due to impassable roads. • The proposed parking area is inappropriate for a tanker of this nature based on the road conditions and the entrance slopes on a grade consistent with a hill. The hazards of parking a fuel tanker on an incline grade on a permanent or semi-permanent basis cannot be understated. As the property slopes south/southeast on an incline,the transport could slip into a ditch or other residential property when trying to maneuver. The slope and road conditions could also cause the tanker to inadvertently slide when trying to be parked in its storage area increasing the odds of a spill. Is there a mitigation plan for these hazards to the neighbors? What are the fire safety provisions to protect the neighborhood?What prevention/protect plan is there to minimize the threat and concern for the neighborhood,wildlife, O-zone, humans, or domesticated animals along with the road issue? How will the mitigation plan, fire safety provision, and the prevention/ protect plan be enforced? s For all of the reasons and concerns, I would ask that the Planning and Zoning Board continue to enforce the existing codes and deny this petition for an exception to those codes. The Planning and Zoning Board created the rules for the safety of the citizens and we feel that it is in the best interest of the tanker owner to continue to park the equipment at a site suited for its very special safety needs. We would also ask that the Board enforce the current no-parking regulations on this tanker owner as he is disregarding the current zoning regulations. By getting a zoning permit for the commercial vehicle does not change any zoning on the property, it just is allowing a commercial vehicle in the agricultural zone district and should not affect taxes. 3. As far as hazardous material, we do not have a separate permit, but the applicants have indicated that the truck would be empty when on site as they have those same concerns and do not want that liability. This is unheard of and here is why. Our tractor never exceeds 5 mph as my husband doesn't want to damage painted fenders on his truck with rocks from the gravel road or get his truck dirty. Tractors such as this are a large investment and he takes great pride in it. More importantly he travels slowly for the safety of not only himself, but the surrounding public. We applied after being made aware by Ann Siron that we need a permit. It was not a violation. The only road damage that has EVER made roads impassable is that when it rains the Harris' s have their roping arena "engineered" as such as the water drains into the road and washes out right in front of our driveway causing the roads to be impassable. It is very clear where the origination of the water is coming from as there is a leach pipe sticking out from under their fence. Normal run off is one thing but this is forced. Please note in the picture above that it appears there is a birm of dirt at the fence line . This is horse manure that they placed there because of the water runoff from 49th street. Their concerns were with the fact that the "Vehicle transports flammable, hazardous products". It is not the tractor that transports these materials it is the trailer that the tractor pulls. As was previously stated the trailer is not parked on the premises very often and when it is, is empty. There were also concerns about "Leakage from connectors or seams". I assure you that we have had no leakage and that we are in 100% compliance on a Federal, State, and Local level with regards to all testing that has to be completed on an annual basis for not only "leakage" but additionally "vapors". This tractor and trailer are safer than the gas tank on the neighborhood vehicles. These two pieces of equipment are also approved for transit in the state of California in which has the toughest EPA standards in the nation. The road damage that was referred to by the Carmin's was previously addressed. There comment on parking is almost laughable. These pieces of equipment are not cheaply made and are late model and well maintained for a reason. We do not park at an incline. WE may back up on an incline which pales in comparison with the inclines that these trucks travel in the mountains. It was implied that we could slip into a ditch . . .we have no ditches in our neighborhood. A mitigation plan was also mentioned. Mitigation for what? We are unloaded if we have the trailer. Fire safety was mentioned and as far as fire safety goes, the Carmin's are the greatest hazard to the neighborhood. We have several concerns regarding this request. • The commercial vehicle transports flammable, hazardous products causing concerns regarding potential leakage from the vehicle's connectors or seams. If any product were to leak or spill out it could contaminate the surrounding soil, groundwater, and vegetation. • There may exist health risks associated with the leakage of this type of product to local wildlife, domesticated animals, and nearby residents. • The emission of toxic, carcinogenic vapors into the area immediately surrounding my home. • By definition,the products this tanker transports are FLAMMABLE. The application makes no concessions for prevention of incineration or ignition from "Acts of God" or manmade sources (i.e. lightning, grass fires, or any man-made threats like cigarettes being thrown out a moving vehicle, lighters or matches being struck). • The permit application makes no provision for reconstruction of the certain road destruction, erosion, and ruts that the tanker owner is already illegally creating in the area and would surely increase in scope, frequency, and nature if the owner was allowed to park the tanker here legally. Some of the issues created by the roadway destruction include but are not limited to: possible danger to smaller vehicles, extensive under-carriage and/or tire and wheel damage to lightweight vehicles, and damage to property values due to impassable roads. • The proposed parking area is inappropriate for a tanker of this nature based on the road conditions and the entrance slopes on a grade consistent with a hill. The hazards of parking a fuel tanker on an incline grade on a permanent or semi-permanent basis cannot be understated. As the property slopes south /southeast on an incline, the transport could slip into a ditch or other residential property when trying to maneuver. The slope and road conditions could also cause the tanker to inadvertently slide when trying to be parked in its storage area increasing the odds of a spill. Is there a mitigation plan for these hazards to the neighbors? What are the fire safety provisions to protect the neighborhood? What prevention/protect plan is there to minimize the threat and concern for the neighborhood,wildlife, O-zone, humans, or domesticated animals along with the road issue? How will the mitigation plan, fire safety provision, and the prevention/ protect plan be enforced? For all of the reasons and concerns, I would ask that the Planning and Zoning Board continue to enforce the existing codes and deny this petition for an exception to those codes. The Planning and Zoning Board created the rules for the safety of the citizens and we feel that it is in the best interest of the tanker owner to continue to park the equipment at a site suited for its very special safety needs. We would also ask that the Board enforce the current no-parking regulations on this tanker owner as he is disregarding the current zoning regulations.
