Dear Jared: For greater continuity and ease of reference, we have iterated your comments by item in a graphical box, with our comments in blue following: Item #1 Agricultural Area: During the 1996 Technical Revision (TR-02) process, the Operator did request to backfill a large portion of the northern lake with inert material. Part (e) of the inert fill notice states the backfilled lake will create a level surface suitable for agriculture, and the Operator committed to capping the inert backfill with two feet of overburden of which, six inches of this material was designated as soil. Thus, the Operator should have saved enough overburden and growth medium on the site to fulfill their commitment. The Division will not approve the request to leave areas 1 and 3; as delineated on the submitted reclamation plan map, un- topsoiled and not revegetated. Areas 1 and 3 were measured to be about 34 acres total. These areas will need to be capped with an appropriate amount of overburden and growth medium to establish vegetation. Please submit a revised map indicating these areas will be re-soiled and revegetated. As of now, the Operator is required to cap the remaining 34 acres with two feet of material as described above (18 inches of overburden and 6 inches of topsoil). It is unclear if overburden has already been backfilled in portions of these areas. Please indicate which areas have been capped with overburden, if any, and identify the location of any overburden piles located on the site and an estimate of their volume. Please provide an estimate of the amount of overburden and topsoil that will need to be imported into the site to fulfill the Operators commitments. The financial warranty will need to be increased in order to cover the cost of importation of this material. Another option as discussed in the first adequacy review is to withdraw this Technical Revision and submit an amendment to the permit and update the reclamation plan outlining the intended use of these areas. The need, common to agricultural areas, lacked specifics in our original reply. Please consider the attached list of agricultural equipment and stockpiles planned for the area, which will be amended over time as part of the return to A-Agricultural use over this segment of the parcel. One of the filter strips of grass could be moved as well from the south boundary to the north boundary of the storage area, to give a greater separation of an additional 50 feet in width from the planned storage area and St. Vrain Creek. If this is acceptable to the OMLR, we will revise the attending map accordingly. Item #2 Clay liner of the Northwest Pond: Based on our conversations and the Technical Revision narrative, the Office of the State Engineers (SEO) leak test for the clay liner is pending for the northwestern pond. Until the SEO has certified the clay liner, the Division will need to hold a bond to replace the clay liner. Please submit evidence the SEO has certified the clay liner for the northwest pond or submit an estimate of the cost to replace the clay liner for the financial warranty estimate. The operator is blessed with adequate water to assure the Colorado State Engineer Division of Water Resources that it has sufficient water to commit, and will, commit to the complete unlined state of the operations until the basins are lined. As such, the clay liner is simply an option that will benefit the owner by liberating waters set aside for augmentation once the lined pond is certified. The leak test is underway and is anticipated to be finalized near year's end. Results of the leak test and legal standing with the State Engineer will he provided to OMLR as a stipulation to the approved technical revision. Item #3 Bond Estimate: Based on your response to the items above, the Division will conduct a financial warranty estimate for the current level of disturbance and adjust the required warranty accordingly. Acknowledged. Item #4 Hydrologic Balance: Given the proximity of the northwest clay lined pond to the structures located of the pond, the Division believes monitoring the groundwater elevations in that vicinity is warranted. Should a mounding problem arise, monitoring data will be necessary to determine the cause. One piezometer will need to be installed south of the northwest clay lined pond between the pond and the permit boundary. The Operator will need to commit to installing this piezometer and monitoring the groundwater elevations on a quarterly basis until the site is released by the Division. Please commit to supplying the results of the groundwater monitoring data in the annual reclamation report submitted to the Division. On the updated Reclamation Plan map, please indicate where the piezometers will be installed. Please refer to the included map showing piezometers locations as determined by C.G.R.S. Please note that the locations are approximate and will be field fit so as not to interfere with existing obstructions, rights-of-way, easements or related considerations.
