HomeMy WebLinkAbout20100973.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING VI#0500210 AGAINST RUDOLFO AND MARIA VASQUEZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rudolfo and Maria Vasquez,VI#0500210, are allegedly in violation of the Weld County Code, and WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not been corrected, and WHEREAS, on the 11th day of May, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Rudolfo Vasquez, property owner, was present and represented by Jimmy Dominguez at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 11, 2010, to allow adequate time for the property owner(s) to bring the subject property into compliance through the removal of miscellaneous items located on the property, and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that VI #0500210 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Rudolfo and Maria Vasquez to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties,with an instruction for delay of action upon such referral until July 11, 2010, to allow adequate time for the property owner(s)to bring the subject property into compliance by removing the miscellaneous items located on the property. No pictures were taken during this inspection. 02/16/2010 Phone Call Rudolfo Vasqeuz (720-234-1394) called and left a voice mail advising he wanted to schedule an appointment to meet and discuss the violations mentioned in my letter. 02/18/2010 Phone Call 10:09 AM - I attempted to return Rudolfo Vasqeuz's (720-234-1394) phone call. The response said "I am sorry but the voice mail box has not been set up for this number. Goodbye" 02/18/2010 Phone Call 1403 PM - I attempted to return Rudolfo Vasqeuz's (720-234-1394) phone call. The response said "I am sorry but the voice mail box has not been set up for this number. Goodbye" 02/19/2010 Phone Call I was able to reach Rudolfo Vasquez. He scheduled an office visit for Wednesday, 02/24/10 @ 1300. I added Michelle Martin (as a Planner) to the appointment request. 02/25/2010 Property Inspected Upon a visual inspection of the property, the following items were noted: South lot-commercial vehicles and apparent derelict vehicles. On the North lot- I noted a large pile of pallets, some appliances, derelict vehicles, a camper/trailer-that has been skirted and appears connected to utilities and miscellaneous debris. No pictures were taken during this inspection. 02/26/2010 Office Visit Rudolfo Vasquez Sr. & Jimmy Dominguez came to the Greeley Planning Office. They met with Michelle Martin and Ito discuss the Pre-Application Request form. Michelle and I helped them fill 2 (two) separate forms out- 1 for each lot. They said they would finish them and send them back into us. I advised them that my next step was a Violation Notification letter which would grant 30 days for them to submit the Pre-Application Request paperwork. 04/14/2010 Phone Call Jimmy called (720-234-1394) and left a voice mail. He indicated that he had already mailed the application. 04/14/2010 Phone Call I called Rodolfo (720-234-1394) back. He said that he is still working on cleaning the property. He said he would be leaving the state for a while on April 23rd. I explained that my next step in this violation process was to schedule a Violation Hearing for May 11th. He would need to request additional time from the Board at that hearing. He asked if there would still be a hearing if they already sent us the application. I asked what application they sent-the Pre-Application Request application or the actual Site Plan Review application or what. He said that Jimmy and he would call me again the next morning.
