I. BY THE COMMISSION
I. On June 29, 2010, the Colorado Department of Public Health and Environment
(CDPHE) filed a Notice of Withdrawal of its Petition to Intervene (Notice) in this matter. The
CDPHE states that it will participate in the House Bill-1365 proceedings in the manner
prescribed by the statute, but that it can fulfill this role without being a party in the proceeding.
2. The Commission granted CDPHE's Petition to Intervene in this matter by
Decision No. C 10-0545, mailed June 3, 2010.
3. We find that it is appropriate to allow responses to this Notice as the withdrawal
may affect parties' positions and testimony in this case. However, we realize that this decision
should be made in an expedited manner. Therefore, we shorten response time to this pleading on
our own motion. Responses shall be due on July 8, 2010 by 4:00 p.m.

II. ORDER
A. The Commission Orders That:
1. The response time to the Notice of the Colorado Department of Public Health and
Environment of Withdrawal of its Petition for Intervention is shortened to July 8, 2010 at
4:00 p.m.
2. This Order is effective upon its Mailed Date.
