We have incorporated changes that Weld County requested. Also enclosed is a CDOT letter regarding access. We contacted the Windsor Fire Department and were told that our access was acceptable, however, the person we spoke to did not have the authority to execute a letter. We were given Mike Davis as the contact person, however, after several attempts, we have been unable to reach Mr. Davis. We will continue our efforts to reach him. Upon completion of the wells the access will then be used daily by a pumper to inspect/maintain the well, approximately bi-weekly by an oil transportation vehicle, and by a water service vehicle. The access must be approved by CDOT. Because this is the condition was agreed to at the Board of County Commissioners hearing, it may not be put off to a later date. Also please contact the Fire District for a confirmation that the access is acceptable to them. I have marked some changes that need to be made to the plat. Unfortunately, plats are not recorded in color so much of your detail will be lost. If you have further questions or concerns please contact me at the above address or phone number. However, it should be noted that an APEN may be required after the first production report is submitted to COGCC. The applicants will submit copies of these Permits to Planning and Health Department if condensate production exceeds 730-bbl per year. At this time this condition is resolved. Condition 2G -AST Information submitted by the applicant has been reviewed and is approved by this Department. This condition is resolved and can be removed. Condition 2H - Stormwater Discharge Permit. Information submitted by the applicant has been reviewed and is approved by this Department. The Water Quality control Commission amended this requirement for a Stormwater Discharge Permit to consider potential economic impacts on June 30th, 2003 A Storm Water Discharge Permit is no longer required for oil and gas facilities, at least until March 10, 2005. This condition is resolved and can be removed. Condition 21 -Waste Handling Plan According to applicant no chemicals will be stored on site. This condition is resolved and can be removed. Please let me know if the information is sufficient so that a mylar plat can be submitted for recording. Listed below are Prima Oil & Gas Company's responses to comments to USR-1462. 1) Windsor/Severance Fire Protection District: The only combustible liquid to be stored will be production oil stored in above ground steel production tank. The road will consist of 1" road base, 20' width, maintained and all season accessible. 2) Weld County Sheriff's Office: Battery, separator and wellhead equipment will be fenced. 3) CDOT: Access will be off Hwy. 257. The drilling contractor will obtain any necessary permits. 4) A.P.E.N.: The only potential source of air emissions anticipated for the Kodak production facilities that would require filing an Air Pollutant Emission Notice (APEN) or air construction permit application are the condensate storage tanks. According to current Colorado Department of Public Health and Environment (CDPHE) Air Pollution Control Division requirements, condensate storage tanks receiving greater than 730-bbl per year must file an APEN and/or construction permit application 30 days after the first production report is submitted to the Colorado Oil and Gas Conservation Commission (COGCC). Prima will provide the Weld County Planning Department with copies of APENs/permit applications as required if condensate production to individual tank batteries exceeds 730-bbl per year. 1099 18'"Street • Suite 400 • Denver, Colorado 80202 Office: 303.2972300 • Fax: 303.297.7708 • www.primaenergy.com Weld County Planning Department Attention: Sheri Lockman April 22, 2004 Page Two 5) The condensate and produced water tanks to be installed at the Kodak production facilities are not subject to the Colorado Department of Labor Oil Inspection Service registration or permitting requirements. Condensate, crude oil, and produced water tanks at oil and gas production facilities are regulated by the COGCC, in compliance with COGCC Rule 604. 6) On March 10, 2003, the US Environmental Protection Agency (EPA) issued a rule to delay by two years the stormwater permit requirements applicable to oil and gas exploration and production sites impacting one to five acres of the land surface. The delay was granted to give EPA additional time to consider the feasibility and economic impact of applying the stormwater rule to typical oil and gas sites. On April 14, 2003, the Colorado Water Quality Control Commission amended Colorado's regulations to include a similar extension. As of June 30, 2003, one to five acre construction sites associated with oil and gas exploration, production, processing, and treatment are not required to obtain a stormwater permit. As a result, stormwater requirements do not apply to the Kodak USR application. 7) A waste handling plan is not needed. No chemicals will be stored on site. Flood Hazard Development Permits for the Kodak 34-31 and 34-32 are currently being reviewed by a water hydrologist and will be forwarded to you upon receipt for your approval.
