RESOLUTION
RE: ACTION OF THE BOARD REGARDING VIOLATION ZCV#1000042 AGAINST VERNON
KOLDEWAY FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Vernon Koldeway, ZCV#1000042, is allegedly in violation of the Weld County
Code, and
WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not
been corrected, and
WHEREAS, on the 11th day of May, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Vernon Koldeway, property owner, was present and represented by Attorney
Scott Dunn at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to continue the matter
to July 13, 2010, with the conditions that there shall be no new growing operations on the site, all
growing operations currently in process shall be completed before July 13, 2010, and a progress
report regarding the annexation process with the Town of Mead shall be provided to the Department
of Planning Services within thirty (30) days, or before June 11, 2010, and
WHEREAS, if the Board of County Commissioners discovers that the annexation process
with the Town of Mead has not been initiated by the property owner by June 11, 2010, the matter
may be reconsidered by the Board at a date earlier than July 13, 2010, so long as notice of the
proposed hearing date is provided to the property owner and operators on the site at least ten days
prior to the proposed hearing date.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#1000042 be, and hereby is, continued to July 13,2010,at 10:00 a.m.,
or such earlier time and date as detailed in this Resolution.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 11th day of May, A.D., 2010.
