THE DEPARTMENT OF PLANNING SERVICES' STAFF APPROVES THIS APPLICATION FOR THE
FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 27-7-30
of the Weld County Code.
2. The request is in conformance with Section 27-7-40.C of the Weld County Code, as follows:
A. Section 27-7-40.C.1--That the proposal is consistent with Chapters 19, 22, 23, 24 and 26
of this code and any intergovernmental agreement in effect influencing the PUD.
1) Section 22-2-120.A R.Goal 1. Ensure that adequate services and facilities are
currently available or reasonably obtainable to serve the residential development
or district.
The proposed PUD will be serviced by the Little Thompson Water District.
Individual Sewage Disposal Systems will handle the effluent flow.
2) The proposed site is not influenced by any intergovernmental agreements or the
Regional Urbanization Area.
B. Section 27-7-40.C.2--That the uses which would be allowed in the proposed PUD will
conform with the performance standards of the PUD Zone District contained in Article ll,
Chapter 27 of the Weld County Code.
An approved on-site Improvements Agreement will be required prior to recording the plat.
All other Performance Standards have been addressed prior to the Final Plan application
submittal. The applicant has chosen to adhere to the bulk requirements of the E (Estate)
Zone District for the residential lots and the Agricultural zone district for the open space
and outlots. The outlots are non-buildable for residential structures or structures providing
habitable space.

C. Section 27-7-40.C.3--That the uses which would be permitted will be compatible with the
existing or future development of the surrounding area as permitted by the existing
zoning, and with the future development as projected by Chapter 22 of the Weld County
Code or master plans of affected municipalities.
The proposed site is not influenced by an Inter-Governmental Agreement. The proposed
development is located within the three mile referral area of the Town of Berthoud, Town
of Johnstown, and Larimer County. The Weld County Department of Planning Services
has not received a referral from the Towns of Berthoud and Johnstown. Larimer County
has indicated in their email dated December 17, 2009 no conflicts with their interests. The
Department of Planning Services believes that the granting of this PUD Final Plan will
have a minimal impact on the surrounding land uses.
D. Section 27-7-40.C.4 --That adequate water and sewer service will be made available to
the site to serve the uses permitted within the proposed PUD in compliance with the
performance standards in Article I1, Chapter 27 of the Weld County Code.
The residential lots will be serviced by Little Thompson Water District. The Weld County
Attorney's Office has indicated that the water agreement submitted by the applicant was
adequate for the Change of Zone. The Weld County Department of Public Health and
Environment has indicated in a referral response dated January 11, 2010 that the
application has satisfied Chapter 27 of the Weld County Code in regard to water and
sewer service.
E. Section 27-7-40.C.5 -- That street or highway facilities providing access to the property
are adequate in functional classification, width, and structural capacity to meet the traffic
requirements of the uses of the proposed PUD Zone District
The Weld County Public Works Department reviewed this request and indicated the
applicant shall address the drainage, internal roadway, improvements agreements, and
the construction of the road. The applicant will be required to address the requirements/
concerns of the Weld County Department of Public Works as outlined in their referral
dated January 6, 2010.
The Colorado Department of Transportation indicated in their email dated December 10,
2009 that the applicant has obtained an access permit for the development and therefore
their issues have been addressed.
F. Section 27-7-40.C.6— In the event the street or highway facilities are not adequate, the
applicant shall supply information which demonstrates the willingness and financial
capacity to upgrade the street or highway facilities in conformance with the
Transportation Sections of Chapters 22, 24 and 26, if applicable.
The Weld County Department of Public Works has requested the applicant enter into an
Improvements Agreement.
G. Section 27-7-40.C.7-- That there has been compliance with the applicable requirements
contained in Chapter 23 of the Weld County Code regarding overlay districts, commercial
mineral deposits, and soil conditions on the subject site.
The Weld County Department of Public Works stated that a Final Drainage Report and
construction plans, conforming to the drainage report, shall be approved prior to
recording Final Plat.
H. Section 27-7-40.C.8--If compatibility exists between the proposed uses and criteria listed
in the development guide, and the final plan exactly conforms to the development guide.

The proposed PUD Final Plan uses are compatible with the criteria listed in the
developmental guide included in the application materials.
This recommendation is based, in part, upon a review of the application materials submitted by
the applicant, other relevant information regarding the request, and responses from referral
agencies.
The Department of Planning Services' Staff recommendation for approval is conditional upon the
following:
1. Prior to Recording the PUD Final Plat:
A. The Board of County Commissioners shall review and approve the signed and dated
Improvements Agreement According to Policy Regarding Collateral for Improvements
including the form of collateral. The security for the Agreement shall be tendered and
accepted by the Board of County Commissioners. (Departments of Public Works and

B. The applicant shall submit evidence that the Weld County Attorney's Office has reviewed
and approved the Restrictive Covenants and Home Owners Association Incorporation
paperwork for The Meadows Estates PUD. Any changes requested by the Weld County
Attorney's Office and Planning Department shall be incorporated. (Department of

C. The applicant shall submit finalized copies and the appropriate fee ($6 for the first page
and $5 for each additional page) to the Department of Planning Services for recording the
Restrictive Covenants for The Meadows Estates PUD in the Office of the Clerk and
Recorder. (Department of Planning Services)
D. The applicant shall submit deeds to the Department of Planning Services for recording of
the Outlots A, B, and C Deeding them to The Meadows Estates PUD Home Owners
Association. (Department of Planning Services)
The applicant shall address the requirements (concerns) of Weld County Public Works
Department, as stated in the referral responses dated January 6, 2010. Evidence of their
approval shall be submitted in writing to the Weld County Department of Planning

of Wildlife, as stated in the referral response dated January 5, 2010. Evidence of such

be covered by the convents. It should also be modified to say Lots 1-5 are
residential lots with (E) Estate uses.
L. The applicant shall submit a digital file of all drawings associated with the Final Plan
application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format
type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not

M. The Plat shall be amended to include the following:

The Weld County's Right to Farm Statement shall be placed on the plat per
Section 22-2-20 J. A.Goal 10 of the Weld County Code. (Department of Planning

3) The plat shall include a utility service block per section 27-9-40.B of the Weld

6) The Utility Easements shall conform to Section 24-7-60 of the Weld County Code
and adhere to the requirements of the Utility Board hearing (February 11, 2010).

2. The Final Plat is conditional upon the following and that each be placed on the Final Plat as notes
prior to recording:
A. The Planned Unit Development shall consist of five (5) residential lots with (E) Estate
uses and 9.4 acres of common open space. (Department of Planning Services)
B. The Outlots are non-buildable for residential structures or structures providing habitable
space. (Department of Planning Services)
C. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer
system. Sewage disposal shall be by septic systems designed in accordance with the
regulations of the Colorado Department of Public Health and Environment, Water Quality
Control Division and the Weld County Code in effect at the time of construction, repair,
replacement, or modification of the system. (Department of Public Health and

D. Water service shall be provided by the Little Thompson Water District. (Department of
Public Health and Environment)
E. A Stormwater Discharge Permit may be required for a
development/redevelopment/construction site where a contiguous or non-contiguous land
disturbance is greater than, or equal to, one acre in area. The applicant shall contact the
Colorado Department of Public Health and Environment, Water Quality Control Division,
and the Weld County Code in effect at the time of construction, repair, replacement, or

F. During development of the site, all land disturbances shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request of
the Weld County Department of Public Health and Environment, a fugitive dust control

G. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods that are technologically feasible and economically reasonable in order
to minimize dust emissions. (Department of Public Health and Environment)
H. If Land development creates more than a 25-acre contiguous disturbance, or exceeds 6
months in duration, the responsible party shall prepare a fugitive dust control plan, submit
an air pollution emissions notice, and apply for a permit from the Colorado Department of
Public Health and Environment. (Department of Public Health and Environment)
A Homeowner's Association shall be established prior to the sale of any lot. Membership
in the Association is mandatory for each parcel owner. The Association is responsible for
liability insurance, taxes and maintenance of open space, streets, private utilities and
other facilities along with the enforcement of covenants. (Department of Planning

J. The Home Owners Association shall be responsible for replacing all dead or dying plant

that conditions supporting the original approval of the PUD Final Plan have changed or
that the landowner cannot implement the PUD Final Plan, the Board may, after a public
hearing, revoke the PUD Final Plan and order the recorded PUD Plan vacated.
X. Section 27-8-80.A of the Weld County Code - Failure to Comply with the PUD Final Plan
- The Board of County Commissioners may serve written notice upon such organization
or upon the owners or residents of the PUD setting forth that the organization has failed
to comply with the PUD Final Plan. Said notice shall include a demand that such
deficiencies of maintenance be cured within thirty (30) days thereof. A hearing shall be
held by the Board within fifteen (15) days of the issuance of such notice, setting forth the
item, date and place of the hearing. The Board may modify the terms of the original
notice as to deficiencies and may give an extension of time within which they shall be
rectified.
Y. Section 27-8-80.B of the Weld County Code -Any PUD Zone District approved in a Final
Plan shall be considered as being in compliance with Chapter 24 of the Weld County
Code and Section 30-28-101, et seq., CRS.

3. Upon completion of 1 and 2 above, the applicant shall submit three (3) paper copies of the plat for
preliminary approval to the Weld County Department of Planning Services. Upon approval of the
paper copies the applicant shall submit a Mylar plat along with all other documentation required
as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk
and Recorder by Department of Planning Services' Staff. The plat shall be prepared in
accordance with the requirements of Section 27-9-20 of the Weld County Code. The Mylar plat
and additional requirements shall be submitted within thirty (30) days from the date the
Administrative Review was signed. The applicant shall be responsible for paying the recording
fee.
4. Section 27-8-60 of the Weld County Code - Failure to Record a Planned Unit Development Final
Plan - If a Final Plan plat has not been recorded within one (1) year of the date of the approval of
the PUD Final Plan, or within a date specified by the Board of County Commissioners, the Board
may require the landowner to appear before it and present evidence substantiating that the PUD
Final Plan has not been abandoned and that the applicant possesses the willingness and ability
to record the PUD Final Plan plat. The Board may extend the date for recording the plat. If the
Board determines that conditions supporting the original approval of the PUD Final Plan cannot
be met, the Board may, after a public hearing, revoke the PUD Final Plan.

Please find attached, the above-mentioned document which lists items from Exhibit "A" of the
Improvements Agreement that do not require collateral. As indicated in the attachment, deletion of
these amounts results in a new total collateral amount of$144,800. Recognizing the fact that Mr.
Schrage has already had the agreement notarized, Public Works is recommending, not requiring, the
new lower amount for the collateral.
Public Works has reviewed the remainder of the Exhibits which appear to be acceptable.

RE: The Meadows Estates PUD (Schrage Subdivision)

As agreed between you and Mr. Schrage,we have completed a design of the change in access to
your facilities located just south of S.H. 60 and east of the proposed development located
approximately 900 feet east of WCR 3. Please find enclosed a plan sheet and a profile sheet
detail of the crossing of the old ditch that is located between your facilities and the proposed
development. Also included is a copy of the plan and profile sheet of the road leading off of
S.H. 60 to the referenced crossing.
A pavement thickness design of the road was prepared by Landmark Engineering, a copy of
which is included. The designer was requested to design to worst case conditions that would
include the 110,000 lb. loading requirement per the attached agreement letter. We added an
additional two inches of base course to the design amount as a safety factor, and per Weld
County requirements, a final pavement thickness design will be required once the street is
excavated in case there is any reason to change the design due to soil type, moisture present,etc.
The crossing was designed based on the compaction of the full depth of the crossing fill material
to 95% of Standard Proctor,with base course as a driving surface. Although the initial intent
was to use an 18"RCP culvert,the final drainage design only required a 15"RCP given the
outlet control. The down stream side of the crossing has been designed to be covered with a turf
reinforcement mat that will prevent erosion of material from the crossing. The minimum width
of the crossing is 18' at the mid point with minimum 30' radii on the curves to allow access by
the oversized rigs.

Dear Mr. Warner,
Thank you for the information relating to the design parameters required to meet the Magpie Operating
Inc.'s design for improvements on the Schrage PUD. This included the following:
1. 110,000 lb. loading
2. 70 foot long rig
3. Nine(9)foot rig width
As we discussed,the loading information provided above will be used by our engineer to design the
pavement thickness between Highway 60 and the turn off to the access road along Schrage Way to your
facilities to the east as shown on the drawings. The length and width of rig will be used to design the
turning radius onto the access road to insure the rig will not need to drive off the access road in order to
make the turn.
In addition,the access across the existing ditch will be designed to have a culvert under it which will be
designed to accommodate the above loading as well as the overburden required. The overburden will be
compacted to a minimum 95% Standard Proctor to insure against sub-grade failure of this crossing. The
culvert will be designed to a length that will account for the required width of the access surface as well
as the side slopes to the bottom of the ditch.
The above design will be part of the construction documents that are required to be reviewed and
approved by Weld County prior to the recording of the Final Plat. Therefore,Magpie Operating,Inc.can
rely on the above items being incorporated into the project. As you stated,this will satisfy Magpie
Operating,Inc.at this time and therefore can sign off below as an indication to the Weld County Planning
Department that the Change of Zone plat can be completed and accepted.
If you have any concerns regarding the above, or if additional information is required,please do not
hesitate to advise. If not,please sign and return a copy of the letter. In turn,a copy will be filed with
Weld County Planning. This letter is signed by Mr. Schrage as his agreement to insure the above items
will be incorporated into the design of this project.

Dear Mr. Rogstad,
We have reviewed your referral latter in response to the referenced development as requested by
Weld County Planning Services. The property Owner,Mr. Ted Schrage,bas worked with the
DOW in the process of obtaining approval of this P.U.D. over the past six years, and you should
find copies of correspondence in your files relating to same. As a result,he has provided for on
the Final Plat the necessary setback of any future homes from the ditch along the east side of the
property. Although this ditch has been abandoned for many years and only has water in it in the
event of a major storm,Mr. Schrage has tried to maintain it in its"natural" condition for many of
the reasons stated in your referral letter. This included no burning of the ditch.
As part of the requirements of Weld County Public Works for storm water detention,the volume
of the ditch has been incorporated as part of the storm detention for the development,plus an
additional area to be excavated along the west side of the ditch. This detention area has been
designed to minimize the impact on the ditch and the existing trees located within the ditch. One
of the younger trees that has grown up on the top of the west bank will need to be removed and
part of two trees with multiple tree trucks will need to be trimmed,leaving that part that is within
the bottom part of the existing ditch. Otherwise,one larger tree that has blown down into the
ditch may need to be removed. This cottonwood tree has limited foliage on it at this time. The
majority of the existing trees along this ditch will remain as will the area included in Outlot A,
which provides cover for those species that find it suitable habitat. This area will be preserved
forever by the approval of the Final Plat of this P.U.D. Mr. Schrage will plant replacement trees
in the detention pond. Additional trees will typically be planted by future home owners on the
specific lots. A copy of the Plat is included herewith.

The existing access to the property will be abandoned as required by the Colorado Department of
Transportation,requiring a crossing of the ditch be constructed to provide access for an Oil &
Gas operation that has a well on the east side of the property. This crossing will be made in an
area that is treeless, and the crossing will also be used as the dam for the overall detention pond.
Mr. Schrage is willing to work with the DOW in regards to the timing of construction so as to
not impact the potential nesting of raptors on the property.
Control of noxious weeds will be the responsibility of the Homeowners, and is a requirement of
Weld County. Contractors used for the construction process will be required to clean their
equipment before arriving on site, and prior to leaving the site, and be made aware of the
disinfection practices quoted in your referral letter should they have previously worked in an
aquatic area.
Hunting will not be allowed on the open space.

Access to the PUD is off of State Highway 60. The Colorado Department of Transportation (CDOT) has

to obtain or upgrade the permit.
It should be noted that a grading permit will be required prior to the start of any construction activity on the site.

Please submit a final geotechnical report with the calculations for the final pavement design that has been
stamped, signed, and dated by a registered professional engineer licensed to practice in the State of Colorado.
Improvements Agreements
The applicant shall enter into an improvements agreement (on-site and offsite) prior to recording of the Final
Plat. Collateral must be posted for both the on-site and offsite improvements. Please contact Rich Hastings at
970-304-6496 x 3727 to begin work on the improvements agreement.
Drainage Report:
The Final Drainage Report dated September 2009 was submitted by J.L. Walter Consulting. The report was
dated, stamped, and signed by Glenn W. Newton, P.E., #17007.
1. Please address all redlines provided in the Drainage Report and on the Drainage Exhibit Drawings.
2. Please provide 24x36 maps of the historic conditions and the offsite drainage basins. See the redline
comments for the information to be included on the maps.
3. Please provide information regarding ownership of the irrigation ditches that have been abandoned. If
the applicant does not own the abandoned irrigation ditch along the west property line, please explain
what agreements are in place to ensure that the offsite flows do not flow across the property in the
event that the ditch is removed.
4. Please provide drainage easements for all drainage related features (i.e. detention pond, closed basin,
culverts, swales, etc). The drainages easements must be identified with a metes and bounds
description and must be recorded in a separate document.
5. The final drainage report is intended to be a stand-alone document. Therefore, the appropriate pages
from the drainage criteria manual and any other reference materials must be included in the
Appendices.
Drainage Report Exhibits and Construction Drawings
1. Please address all redlines provided on the Drainage Report Exhibits and Construction Drawings.
2. Please add a note to the plat notes that states "Weld County shall not be responsible for the
maintenance of drainage related features."
3. Please show the recorded drainage easements for all drainage related features including but not limited
to: detention ponds, closed basins, ditches, swales, culverts, etc.
4. Please provide a readable drawing of the proposed contours for the subdivision. The contours that
were shown on the construction drawings are not distinguishable from the existing contours especially
around the detention pond. It will likely be necessary to show the detention pond improvements on a
separate sheet.
5. Please provide a seeding mix on the construction drawings.
6. Please ensure that all BMPs and associated details are grouped together instead of scattered
throughout the construction drawings.
7. Please show the hydraulic grade line for all culverts.
8. Please ensure that the elevations show in the construction drawings are consistent with the elevations
used in the drainage report.
9. Please ensure that the details for the pond outlets do not contain extra information such as a riser pipe
that were not included in the design calculations.
10. Please ensure that the asphalt design shown on the plan set is consistent with the asphalt design
shown in the final geotechnical report.
