TO HATE AHD TO HOLD the same with all the privileges and appurtenances, and all the estate,
right, title or interest of the said party of the first part, either in law or equity, to the only
proper use and benefit of the said party of the second part, his heirs and assigns forever.
PROVIDED, HOWEVER, that this deed is made upon the express convenant, agreement and under-
standing by and between the parties hereto, their heirs, assigns, successors and legal representatives,
that no intoxicating liquors shall ever be manufactured, sold or otherwise disposed of as a beverage in
any place of public resort in or upon the premises hereby granted, or 1n any part thereof; and that in
the event of the breach of this covenant and agreement by the said party of the second part, his heirs,
assigns or legal representatives, this deed shall become null and void, and all the right, title, interest
and right of possession of, in and to the premises hereby conveyed, shall revert to and become vested in
the said party of the first part, his heirs and assigns and legal representatives.
And the said party of the first part further covenants with the said party of the second part,
that at the time of the ensealing and delivery of these presents he is sell seised of the premises above
conveyed as of good, sure, perfect, absolute and indefeasible estate of inheritance, in law and fee simple,

and has good right, full power and lawful authority to GRANT, BARGAIN, LL AND CONVEY the same, in manner
and form aforesaid, and that the same are free and clear from all former and other grants, bargains, sales,
liens, taxes, assessments and incwnbranees of whatever kind and nature soever; and the above bargained
premises in the quiet and peaceable possession of the said party of the second part, his heirs and assigns,
against all and every person lawfully claiming to or claim the whole or any part thereof, the said party
of the first part shall and will forever warrant and defend.

THIS DEED, Bade this 14th day of February, A. D. 1928, between Grant EcFerson, State Bank Com-
missioner of the State of Colorado, of the City and County of Denver, party of the first part, and Weld
County, Colorado, party of the second part, WITNESSES.
THAT, WHEREAS, the District Court of the Eighth Judicial District, in and for the County of Weld,
State of Colorado,did, on the 18th day of January, A. D. 1928, enter its certain order and Judgment in
the words and figures following, to—wits

This cause coming on to be beard in open Court this 10th day of January, A. D. 1928, upon the
petition of Grant MOFerson, as State Bank Commissioner of the State of Colorado, for lace to offer for
sale and sell at public sale, the following described real estate, situated in the Town of Grover, County
of Weld and State of Colorado, to-wits
Lots Twenty- (20), Twenty-one (21), Twenty-two (22) and Twenty-three (25), Block
Eight (8) in The Town of Grover, Colorado, with improvements thereon.

and the Court having heard the said petition and the evidence introduced in support thereof, and
being now sufficiently advised in the premises, finds the matters and things set forth therein
are true, and that it is for the best interest of said bank, its creditors, stockholders and
depositors that said property be offered for sale and sold at public auction upon the terms and
conditions hereinafter set forth;
And the Court further finds that an offer of Two Thousand Dollars (12,000.00) in cash has d further tofore findsthatntwode or generalll be officers ofde or saidibank have heretoforey upon dulyic signed, and the and filed Ci t
this Court their waiver in writing of notice of hearing of said petition;
WHEREFORE, IT IS ORDERED, ADJUDGED AND DECREED by the Court that the said Grant McFerson,
as State Bank Commissioner of the State of Colorado, be, and he hereby is, authorized, empowered
and directed to advertise the hereinabove described property for public sale on a date to be by him
specified, and that public notice of such sale be given by publication thereof in two regular
weekly issues of a newspaper printed and published in the Town of Grover, Weld County, Colorado,
such sale to be made not less than ten days after the making of said publications.
That such property shall be sold for a sum of not less than Two Thousand Dollars (C2,000.00),
or for such greater sum as may be obtained therefor at said sale; that said property shall be sold
for cash in hand at the time of said sale or for such reasonable deposit as said Commissioner may
require be paid at said sale, and the balance to be paid in cash at the time of execution and de-
livery of a proper deed of conveyance of said property to purchaser thereof, provided that said
Commissioner may at said sale reject any and all bids offered for said property, if in his judgment
the interest of said bank, its creditors and depositors shall so require.
Upon making such sale and upon payment of this full purchase price, said Commissioner is
authorized and directed to make, execute and deliver to said purchaser a good and sufficient deed
of conveyance without covenants of warranty, conveying to the purchaser all the right, title and
interest of said Grant McFerson, €s such State Bank Commissioner, and of the said The Grover State
Bank, Grover, Colorado, in and to the said real property.

WOW, THEREFORE, by virtue of the foregoing and under the authority vested in him as State
Bank Commissioner, the said party of the first part, for and in consideration of Two Thousand Dollars
($2,000.00) in cash, to the said party of the first part in band paid by the said party of the
second part, the receipt whereof is hereby confessed end acknowledged, has granted, bargained, sold
and conveyed, and by these presents does grant, bargain, sell and convey unto the said party of the
second part, its successors and assigns forever, all the right, title and interest of the said party
of the first part, as such State Bank Commissioner, and of the said The Grover State Bank, situated
in the Town of Grover, County of Weld and State of Colorado, either in law or equity, in and to the
above bargained and hereinafter described premises, situate, lying and being in the County of Weld,
and State of Colorado, viz:
Lots Twenty [20), Twenty-one (21), Twenty-two (22) and Twenty-three (23), Block
Eight (8), in the Original Town of Grover, Colorado, with improvements thereon.
TO EAU AND TO HOLD the said premises above bargained and described, with the appurtenances,
unto the ssiTll-County,the party of the second part, its successors and assigns forever.
It is expressly understood that this conveyance is made without covenants of warranty, and
that its intent is to convey to the party of the second part only such title as is.vested in the party
of the first part, as State Bank Commissioner of the State of Colorado, and such title, legal or
equitable, as is vested in the said The Grover State Bank, Grover, Colorado.
IN WITNESS WHEREOF, the said party of the first part has hereunto set his hand and seal the
day and year first above written.
