RE: Closure of southernmost access onto County Road 5 and installation of screening fence for Mile High
Dairy
Dear Sirs and Madams,
There are still two outstanding conditions of approval for the Mile High Dairy facility under Amended Use
by Special Use Permit 686 (AMUSR-686) that was approved by the Board of County Commissioners on
May 21, 2008. The southernmost access into the dairy facility has not been closed and the screening
fence has not yet been installed.
The southernmost access into the dairy property is required to be closed (and is indicated as closed on
the plat that was submitted for recording). It is my understanding that this access has not been closed and
is still being used as an access by the dairy facility. Therefore, the Departments of Planning Services and
Public Works are requiring that this access be closed by no later than Monday, February 1st 2010.
Evidence that the access has been closed (in the form of a photograph) shall be submitted to the
Department of Planning Services. In the event the access is not closed by Monday, February 1512010,
staff will schedule a probable cause hearing before the Board of County Commissioners for
noncompliance with conditions of approval for AMUSR-686.
Mile High Dairy, LLC agreed to install a fence along the southern boundary of the dairy site. An
improvements agreement was submitted indicating that the fence would be installed by December 31st,
2009. However, the improvements agreement schedule (exhibit"B") of the agreement states that the
improvements shall be completed .5 years from the date of approval of the final plat. The final plat was
submitted for recording on October 13, 2010. To allow ground sufficient time to thaw for fence installation
while maintaining consistency with the improvements agreement("Schedule B"), staff will require the
applicant to install the screening fence by no later than: April 13th 2010. If the fence is not installed by this
date, then staff will schedule a hearing before the Board of County Commissioners for noncompliance with
the requirements for Amended Use by Special Review Permit 686 (AMUSR-686).
