RE: ACTION OF THE BOARD CONCERNING ZCV #1000101 AGAINST BOYD AND
HELEN ARNOLD FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Boyd Arnold, ZCV #1000101, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of October, 2010, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, the property owner was present at said hearing, and
WHEREAS, after hearing the testimony and statements provided, the Board deems it
advisable to refer the matter back to the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV#1000101 be, and hereby is, referred back to the Department
of Planning Services.

VIOLATION REMEDY:
It has been brought to my attention a Pre-Application meeting was conducted on September 2, 201O. It is my
understanding during the meeting you advised Michelle Martin, Planner since the process was so expensive
you would need to consider whether or not to proceed with the Use by Special Review (USR) process; however,
in either event, no additional races would be conducted until the USR process was completed. Nevertheless,.
on September 18, 2010, the Weld County Sheriffs Office was once again advised of a large horse event, this
time with around 500 attendees occurring on this property.
RECOMMENDATION:
The Department of Planning Services recommends this case be forwarded to the County
Attorney's Office for immediate legal action.

08/18/2010 Telephone call I called Colorado Tenderfoot Properties (303-732-1115) - Listing
agent is a Liz. I left her a voice mail.
08/21/2010 Law enforcement contact Deputy Travis Wayman received a report of an active horse racing
event. Upon arrival he noted approximately 300-400 people with
approximately 100 vehicles. His report noted that he did only see
approximately 3 horses. The event was conducted Saturday.
08/21/10 at approximately 10:30 am. Deputy Wayman advised
Helen Arnold to contact the Planning &Zoning Office to apply for the
appropriate permits.
08/25/2010 Telephone call Andy Arnold (303-710-0912) called. He said his family received my
letter. I asked if he had any questions. He said nope, it looks like
the first step is just filling out this paperwork. He asked if he could
submit the information on-line. I said he could fax or e-mail it. He
said they would get it faxed in. I asked if he could get it turned in
sometime this week. He said that shouldn't be a problem. I advised
him that I already sent out the 30 day letter this morning. He said he
would see about getting that faxed in. I told him to call if he had any
questions once he got started with it. He said he would.
09/18/2010 Telephone call I received a message from Jaime (WCSO -Animal Control). The
Sheriff's Office received another complaint regarding a race occurring
on this property right now with approximately 500 people. Incident
Number# 242675.
INSPECTION SUMMARY:

Inspection Result Comment Upon a visual inspection of the property, the following notes were taken: I did
see what appeared to be a straight path (maybe dirt track). I saw a real estate
sign for Colorado Tenderfoot Properties (303-732-1115). No pictures were taken
during this inspection.

winter. Im sure this must be a violation or everyone
in Weld County would start up a RV park on there
property also.

business day before or as soon as possible to the above mentioned violation hearing date.
The Department of Planning Services staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal actions to remedy the violation. Our records indicate

On Thursday, September 2, 2010 an informal discussion took place at the Greeley
Administrative Offices Conference Room regarding an outdoor rodeo arena. (The legal
description is Lot C AmRE-2363; Part SE4 of Section 14, T2N, R64W of the 6th P.M.; Situs
Address is 28667 CR 20)
Background Information:
The applicants have been farming this site and would like to supplement their income by operating a
straight track as well as an outdoor rodeo arena.
The applicants expect 1 event per week with approximately 200 to 250 people on site. The events
would start at 9 am and run till before dark. No alcohol or organized gambling would take place on
site.
Building Department
The applicants stated that they are not proposing any new buildings or utilizing any of the existing
buildings for the operation of the arena.
The applicants will need to address accessibility of the site. A designated handicapped area will
need to be identified.
Health Department
According to Health Department Policy, portable toilets and bottled water are acceptable for 6
months or less. For a year-round business, permanent restroom facilities will need to be installed.
Dust Abatement and Waste Handling Plans are required. The applicants indicated that the parking
area is grass. The Waste Handling Plan will need to include the contact information of the trash
haulers.
The applicants indicated that there are currently no announcers.
Staff informed the applicants that the existing pond is not an allowed use for watering horses. The
applicants will need to find another source of water for the animals or people will need to bring in
their own water.
The applicants indicated that there will be no food sales on site as well as no overnight stay.
Public Works
The applicants will need to submit a traffic narrative which will include the types of vehicles
accessing the site as well as an estimate of the number of trips per day. Public Works Traffic
Engineer, Janet Carter, will determine from this narrative if a traffic study will be required.
The applicant indicated that there are currently three (3) accesses on the east side of the property.
Only 1 access is allowed per parcel.
The site is not located in a designated floodplain.
No Drainage Report is required; however the applicant shall provide a short description of the
historic stormwater flows across the property and how their application will affect those flows. The
description shall include but not be limited to: 1) where the water originates if it flows onto the
property from an offsite source, 2)where it flows to as it leaves the property, 3)the direction of flow
across the property, and 4) if there have been previous drainage problems with the property. The
application shall also provide flow arrows on the map showing where the stormwater starts, how it
goes across the property, and where it leaves the property. The applicant will still be responsible for
providing a water quality feature that conforms to the methodology outlined in Volume 3, Section
4.4.2 of the Urban Storm Drainage Criteria manual.
Planning Department
The applicant is currently in violation for operating without an approved and recorded Use by Special
Review Permit. The applicants stated that they have ceased all operation since being notified. Staff
informed the applicants that if they continue to operate an investigation fee of$1250 will be added
onto the USR application of $2500.
No lighting is proposed right away; however they may plan for it in the future.
According to Senate Bill 35, the USR boundary will need to encumber the entire parcel boundary.
Staff urged the applicant to contact staff for any questions:
Planner On Call available Monday through Friday 7:30 a.m. to 4:30 p.m.
Staff explained the USR process. The applicant shall submit 4 packets for a 7 day completeness
review. After the 7 day completeness review the applicant will be informed of what items are still
required to make the application complete. Staff requested that the applicant submit the remaining
material in electronic form. Upon submittal of a completed application it will be sent out for referral
for 28 days. The applicant will then meet with their Planner to discuss the referrals and address as
many of the referrals as possible. At that meeting the Planning Commission hearing will be
scheduled. The Board of County Commissioners hearing typically follows approximately 3 weeks
after the Planning Commission hearing.
