FORT LUPTON, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County. Colorado, held a public hearing on the 5th day of April, 1978 at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board. of County Commissioners, for the purpose of hearing the application of Ronald Heitman, 610 South McKinley, Fort Lupton, Colorado 80621, for the granting of a Special Use Permit for a hog operation on the property described below: The East one-half Northwest one-quarter of Section 27, Township 1 North, Range 66 West of the 6th Principal Meridian, Weld County, more particularly described as: Beginning at the North one-quarter corner said Section 27; thence S00°12'30" E on an assumed bearing along the East line said East one-half Northwest one-quarter a distance of 2656.65 feet to the center of said Section 27; thence N89°50'40" W along the South line said Fast one-half Northwest one-quarter a distance of 1324.64 feet to the Southwest corner said Fast one-half North- west one-quarter; thence N00°07'20" W along the West line said East one-half Northwest one-quarter a distance of 2653.04 feet to the Northwest corner said East one-half Northwest one-quarter; thence N90°00'00" E along the North line said East one-half Northwest one-quarter a distance of 1320.64 feet to the point of beginning. Contains 30.61 acres more or less. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the grant of the Special Use Permit for a hog operation on the above described real estate by the petitioner, and WHEREAS , Section 3. 3.E. 4 .d of the Weld County Zoning Resolution authorizes such a use in an Agricultural District subject to the further requirements of Section 6. 1 (4) of the Zoning Resolution and upon approval by the Board of County Commissioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, both in support of and opposed to the application, has studied the T Df.C ':SG 2 780225 request of the petitioner, and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Special Use Permit for a hog operation on the above-described real estate conforms to the pur- poses of the Section 3. 3.E. of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the petitioner for a Special Use Permit for a hog operation on the above described tract of land, be and hereby is , granted, subject to the Development Standards contained in the Special Use Permit. BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated February 7, 1978 , be and hereby are incorporated as the findings of fact of the Board of County Commissioners in this matter. C. RECOMMENDATION February 7, 1978 compatible with the future development in the area and will not adversely affect the health, safety, and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. The single family residence, hog operation and management practices as outlined and controlled in the Development Standards will make this operation compatible with the surrounding area by minimizing the potential adverse impacts. B. The proposal is for an agri-business in an agriculturally zoned area, with existing land uses being predominantly agricultural . C. The Weld County Extension Agent has indicated the facilities will provide adequate space for proposed number of animals. He did not observe any problems with the proposed operation. D. The Weld County Health Department has indicated the proposed operation is in compliance with all applicable Weld County and State Health Standards and Regulations providing the applicant complies with the stipulations as indicated in the Health Department's letter dated January 30, 1978 E. The City of Brighton Planning Commission has indicated they have no objections to the proposed hog operation. F. The Weld County Engineering Department indicated no engineering problems could be identified with the proposed operation. G. The State Engineer, Division of Water Resources, indicated the domestic/livestock well may be utilized for the proposed hog operation and they have no objections to the approval of this application. H. The applicant has submitted a petition form signed by several of the surrounding owners in support of this request . The Planning Commission's recommendation for approval is subject to no building permits for any structure be issued on the Special Use Permit area until the Development Standards have been placed on the Special Use Permit plat and said plat has been recorded in the Weld County Clerk and Recorder' s office. • Ronald Heitman SUP-349:78 :1 P. C. RECOMMENDATION February 7, 1978 Comment : 1. A letter was submitted from James Massey, one of the adjoining landowners who signed the petition in favor of this request being approved, indicating he is only in favor of this request if Mr. Heitman maintains the operation. He is opposed if any one else takes over the operation. (See copy in attached packets) . The SUP, if approved, is a permit which goes with the land and is transferrable to another property owner. However, any future property owner is required to comply with the Development Standards approved as part of the SUP. Ronald Heitman - SUP DEVELOPMENT STANDARDS 1. The permitted uses as shown on the hereon described parcel shall be a single family residence and a hog farrowing and finishing operation which is designed to handle a total of 500 head of hogs to include sows, boars, and piglets, and all uses allowed by right under Section 3. 3(B) of the Weld County Zoning Resolution . 2. The Special Use Permit area shall be maintained in such a manner as to prevent fugitive dust, soil erosion, and the growth of noxious weeds. 3. All sewage disposal facilities installed on the site shall conform with all applicable Weld County and State Health Regulations. The applicant shall obtain a permit from the Weld County Health Department for the construction of an individual sewage disposal system. The domestic well and leach field must be separated by a minimum of 100 feet. 4. Access shall be limited to the one existing point as shown hereon. 5. There shall be no discharge from the proposed hog operation into streams, other bodies of water, or adjacent drainage systems without obtaining a wastewater discharge permit from the Water Quality Control Commission, State Health Department . 6. The Special Use Permit shall be limited to the plans sub- mitted and governed by the Development ,Standards stated above. A supple- mental report was prepared by Lord and Associates in answer to con- cerns of the Planning Commission . The pit noise and ambient conditions are within State limits and the scrapper operation will be controlled by Best-Way so that any noise will not be objectionable to surrounding neighbors. Mr. Mathias also indicated that there will be no more dust from the gravel pit operation than there is with the farming operation. Tom Connell , attorney for Best-Way, then reviewed the request for the change of zone and how the property in question was zoned several years ago. Chuck Cunliffe then read the motion by the Planning Commission made on January 17, 1978 , and then read the staff ' s recommendation for tabling the application. The floor was then opened for comments from the audience. At this time, Tom Hellerich, representing Ray Larson, surrounding property owner , again spokein opposition of the proposal primarily because of the need for the change of zone and was very critical of Lord' s supp- lemental report . He indicated the report was inconclusive and totally vacant to any of the questions asked by the Planning Commission at the last meeting regarding drainage between the berms and the street . Vicki Reed then presented two more petitions to the Planning Commission in opposition of the proposal and supported Mr . Hellerich ' s comments regarding the need for the change of zone . She also reviewed the mining plan in the 10th phase of operation and showed by use of a map that l of the 45 acres will be a major dis- turbance. She also reviewed the noise study taken by Lord and Associates and felt it was not accurate. Tara Frank, Dr . Larry Wikholm, Robert Foose, Esther Rempel , Keith Tanner and Margaret Ruhl all expressed their opposition to the proposal . The Weld County Health Department has indicated the proposed operation is in compliance with all applicable Weld County and State Health Standards and Regulations providing the applicant complies with the stipulations as indicated in the Health Department ' s letter dated January 30, 1978.
