RE: APPROVE SEISMIC MINERAL PERMIT AGREEMENT AND AUTHORIZE CHAIR TO
SIGN - GEOKINETICS USA, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Seismic Mineral Permit Agreement
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and Geokinetics USA, Inc., with terms and conditions being as
stated in said agreement; said properties being described as follows:
1) Lot A of Corrected Recorded Exemption#943; being
part of the SW1/4 SW1/4 of Section 26, Township 9
North; Range 66 West of the 6th P.M., Weld County,
Colorado [LE0273]
2) NUN 19478; Lot 19 thru Lot 22, Block 34; being part
of the H &J Subdivision; being located in Section 33,
Township 9 North, Range 66 West of the 6th P.M.,
Weld County, Colorado [LE0274]
3) NUN 19474; All of Block 33; being part of the H and J
Subdivision; being located in Section 33, Township 9
North, Range 66 West of the 6th P.M., Weld County,
Colorado [LE0274]
4) Part of the SE1/4 of Section 1, Township 8 North,
Range 66 West of the 6th P.M., Weld County,
Colorado [LE0275]
WHEREAS, after review, the Board deems it advisable to approve said agreement,a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Seismic Mineral Permit Agreement between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, and Geokinetics
USA, Inc., be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.

Dear Property Owner,
Enclosed you will find a permission form to cross your property/or properties that we
ask you to respond to and mail back to us. We are doing a seismic survey looking for oil
/natural gas. We lay a cable out on top of the surface that will record seismic measures
that we create. The cable looks just like an ordinary extension cord. This cable will sit
on top of the surface for about 1-2 weeks and then we will pick it back up. We will be
utilizing vibe trucks that may travel across your property in various locations. They are
equipped with a plate that lowers to make contact with the surface.This is to create the
vibration necessary for the cable to record the data needed and to hopefully locate oil/
natural gas pockets. We hope you will sign the permit and join us in the exploration of
oil and natural gas in the area. If you have any other questions please call me as soon as
possible. We are in the permit stage and should start this survey by September 1,2010.
This is not a mineral lease; it is simply a surface permit to conduct the test. We
appreciate you working with us on this program and ask that you call our permit
agent should you have any questions regarding this Seismic Program.
Upon granting Geokinetics USA,Inc. permission,we would appreciate your answering
the following questions about your property. These answers will help us assess the best
way to cross your property.

This permit shall include any surface or mineral interests you own within this seismic survey, including but not limited
to, the surface interests described above.
Our operations will be conducted in accordance with standard industry practices and in a prudent and careful manner,
and we agree to indemnify and hold you harmless from all liability and claims, if any,which may result from the
operations conducted under this permit. In addition, Geokinetics USA, Inc. agrees to indemnify and reimburse
landowner for any physical loss or damage to the property as described in the land description resulting from the
seismic and/or geophysical testing conducted by Geokinetics USA, Inc. In the unlikely event that this survey is
cancelled or moved,we will notify you and this permit shall become null and void. Unless otherwise voided by
conditions stated herein,this agreement shall survive any lease, sale,trade or conveyance of property interests
described above and made after executed date of this agreement and will be binding on successors or assigns.
If your permission is granted, please so indicate by signing this permit form in the space provided below and return
one copy of the permit in the enclosed courtesy envelope and retain the other copy for your records. Please fill in
your phone number if it is not already indicated below. It is very important that you include your SSN or Tax I.D. for
payment and inform us of any Oil and Gas lease and tenant/renter information affecting the lands covered by this
Permit. Permittee represents that he/she has full legal authority to grant permission for entry to the described lands
for the purpose of conducting the requested survey. This Agreement(a)constitutes the entire agreement of the
Parties with respect to the subject matter and supersedes any prior agreement or understanding with respect to the
subject matter hereof and (b)may be executed in separate counterparts via facsimile or telecopy.

In researching our records I do not show evidence of County ownership for the parcels listed
in the attached request. Would you please provide documentation which leads you to believe
these four mineral acreages are under County ownership so that I may establish the necessary
files and process your request accordingly? Upon receipt we will list this matter on the
Agenda for consideration and signature by the Board of Weld County Commissioners.

Mr. Barker, I came by your office yesterday and was told you are the one I need to speak to
in order to get my surface permit signed to do a 3-D seismic survey on the land described in
the permit. My company Geokinetics has been hired by Anadarko Pertoluem to do a seismic in an
78 square mile area in Weld County. The cover letter basically explains what we are doing,
but please feel free to contact me with any questions in regards to our operations. I have
attached a copy of the permit and cover letter for you to review, I will need a signature
once you approve everything and I will be happy to come by and sign, and give you a copy as
well.

Esther, I have attached a copy of the revised permit, and also the profile for each of the 4 listed parcels on the
permit. I went to the tax assessor office and was able to obtain proof that Weld County does in fact own the
properties. These are for surface and I have included everything that you need in order to get this permit signed
