HomeMy WebLinkAbout20253308 Record of Proceedings Minutes Board of County Commissioners Weld County, Colorado Monday, December 8, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, December 8, 2025, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Controller, Rusty Williams Minutes: Commissioner Ross moved to approve Minutes of the Board of County Commissioners meeting from November 19, 2025, as printed. Commissioner James seconded the motion and it carried unanimously. Furthermore, Commissioner Maxey moved to approve Minutes of the Board of County Commissioners meeting from November 24, 2025, as printed. Commissioner James seconded the motion and it carried unanimously Certification of Hearings: Commissioner Maxey moved to approve the below listed Hearing Certificates. Commissioner Ross seconded the motion, which carried unanimously. 1. PCSC25-0012 — Peitz Land Investments, LLC 2. COZ25-0010 — Hollingshead Materials, LLC 3. USR25-0012 — Debra and Jeffrey Garcia 4. COZ25-0008 — 12524 Weld County Road Realty 1, LLC, and 12524 Weld County Road Realty 2, LLC 2025-3308 Z J Z3 BC0016 I Page 2 Monday, December 8, 2025 www.weld.gov Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner Ross moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. Presentations and Proclamations: 1. University Bulldogs Day, Girls Volleyball Class 4A State Championship — December 8, 2025: Commissioner James read the certificate for the record. Team Captains shared their experiences winning the championship season, which began with five (5) hard losses, and allowed for strong bonds to be built throughout the season. Ryan Wehrman, Coach, thanked the Board for their recognition of the team's hard work and dedication, shared aspects of the team's efforts, acknowledged the school and community support, and stated their school is the second smallest competing at 4A in the state. Upon Chair Buck's request, each team member present introduced themselves for the record, indicated their grade in school, and the position they play on the team. Each of the Commissioners extended their congratulations to the team for their accomplishments and applauded their outstanding leadership skills and hard work as a part of Team Weld. (Clerk's Note: The group gathered for a photo opportunity.) 2. Recognitions of Service, Department of Human Services — Susan Bjorland and Lesley Cobb: Commissioner Peppler read the certificate recognizing Lesley Cobb for the record. Jamie Ulrich, Director of the Department of Human Services, stated Ms. Cobb has worked for Weld County for 34 years, which began in the Treasurer's Office, shared she has been a joy to work with, builds morale, and is great with developing efficiencies to help manage the volume of contracts the Department of Human Services processes annually. Tami Grant, Deputy Director of the Department of Human Services, shared the impacts Ms. Cobb has had on the families of Weld County with her incredible efforts working with the Child Welfare division. In the early days she would help establish foster care and kinship rates before there were state contracts and assured alignment and consistency among other counties. Ms. Cobb expressed her heart-felt appreciation for the great workplace and opportunities to grow, and stated she will greatly miss all the friendships made throughout her tenure. In turn, each Commissioner extended their gratitude for her incredible commitment and dedication to the citizens of Weld County with her joyous spirit and smile and wished her the best for her future endeavors. Furthermore, Chair Buck read the certificate recognizing Susan Bjorland for the record. Ms. Ulrich highlighted Ms. Bjorland's incredible work ethic, shared that she was great at reminding her colleagues of the reason why they are called to serve others in the capacities that the Department of Human Services provides to the citizens during tough times. Ms. Grant stated Ms. Bjorland served on the Workforce Development Board as a small business owner representative, was a contracted employee with the County prior to working for the County, and shared her warm 2025-3308 BC0016 Page 3 Monday, December 8, 2025 www.weld.gov smile and laughter will be greatly missed. Ms. Bjorland shared her heart-felt appreciation for the opportunities she had, and stated it has been her privilege to serve the community for as long as she has. In turn, each Commissioner extended their appreciation for her incredible commitment and dedication to the citizens of Weld County. (Clerk's Note: The group gathered for a photo opportunity.) Warrants: 1 . General Warrants: Commissioner Maxey moved to approve the General Warrants, as printed. Commissioner Ross seconded the motion and it carried unanimously. 2. Commissioner Warrants — Perry L. Buck: Commissioner Ross moved to approve the Warrant, as printed. Commissioner James seconded the motion, and upon a roll call vote of four (4) to zero (0), the motion carried with Commissioner Buck abstained. Bids: 1. Approve Bid #B2500123, Owner Representation for Weld County Judicial Center Development — Facilities Department: Toby Taylor, Purchasing Department, reviewed the evaluation committee process and stated staff recommends selecting the bidder with the highest proposal scores and met specifications, Level5 Collaborative, for a total amount of $9,325,000.00. Commissioner Ross moved to approve said bid. The motion was seconded by Commissioner Peppier. Commissioner Maxey commended staff for their diligence and clarified the process to ensure the best company was selected to execute the aggressive timeline for this project. Commissioners James and Ross echoed the sentiments of Commissioner Maxey. There being no further discussion the motion carried unanimously. 2. Approve Bid #B2500132, Conduct Oral Auction for Large-Tract Oil and Gas Lease (N1/2 [Consisting of Lots 1-4; S1/2 N112] of S3, T7N, R63W — 321.16 acres) and Authorize Chair to Sign: Rusty Williams, Weld County Controller, stated the sole bid received was from Bison IV Properties Colorado, LLC, to lease 321.16 mineral acres for the amount of $1,500.00 per mineral acre, for a total of $481,740.00. Commissioner Maxey moved to approve said lease and authorize the Chair to sign. The motion was seconded by Commissioner Ross and it carried unanimously. New Business — General: 1 . Consider Contract ID #10142 Intergovernmental Agreement for Transfer of Licenses and Maintenance for Cisco Webex Videoconferencing Systems, and Authorize Chair to Sign: Ryan Rose, Director of the Department of Information Technology, stated in November 2020, the County procured the Cisco 2025-3308 BC0016 Page 4 Monday, December 8, 2025 www.weld.gov system; however, the Colorado Judicial Department has centralized all judicial arraignment equipment across the state. He indicated the agreement allows for the transfer of ownership for twelve (12) Webex Videoconferencing Systems, which will eliminate approximately $10,000.00 of County funds annually for maintenance and support. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Peppier and it carried unanimously. 2. Consider Temporary Closure of County Road 52.25 Between County Roads 13 and 15.5: Amy Mutchie, Department of Public Works, requested said closure to begin December 8, 2025, and go through December 12, 2025, for the replacement of an irrigation culvert and road repairs due to being washed out. She stated water will be used, as needed, for dust control on the gravel portions of the detour route. Commissioner Maxey moved to approve said temporary closure. The motion was seconded by Commissioner Ross and it carried unanimously. New Business — Ordinances: 1. Second Reading of Code Ordinance #2025-16, In the Matter of Repealing and Reenacting, with Amendments, Chapter 23 Zoning of the Weld County Code (EV Charging Stations): Commissioner James moved to read Code Ordinance #2025-16 by title only. The motion was seconded by Commissioner Ross and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Jim Flesher, Department of Planning Services, stated Planning Commission reviewed the week prior, reviewed the proposed changes to allow EV charging stations in various zone districts, and indicated there are no additional changes since First Reading, and staff recommends approval. There being no public testimony concerning the matter, Commissioner James moved to approve Code Ordinance #2025-16 on Second Reading. The motion was seconded by Commissioner Ross and it carried unanimously. New Business — Planning: 1. Consider Vacation, VAC25-0023, of Use by Special Review Permit, USR-995 — Patricia Conlon, and Paul and Michael Hungenberg: Molly Wright, Department of Planning Services, stated the applicants have requested to vacate Use by Special Review Permit, USR-995, approved in 1993, as a result of the applicant's recent USR permit application for a solar energy facility. She explained the vacation ensures there are no overlapping of permits and stated staff recommends approval. Commissioner Ross moved to approve said vacation. The motion was seconded by Commissioner James and it carried unanimously. 2025-3308 BC0016 Page 5 Monday, December 8, 2025 www.weld.gov 2. Consider Vacation, VAC25-0024, of Minor Amendment to Use by Special Review Permit, MUSR14-0011 — Patricia Conlon, Suzanne Lilly, Gerry Ball, PDC Energy, Inc., Union Colony Investors, LLC, Jonathan and Olivia Cain, Saylor Properties, LLC, and Rebecka Mathias: Ms. Wright stated the applicants have requested to vacate Minor Amended Use by Special Review Permit, MUSR14-0011, approved October 21, 2015, as a result of the property owner's application submittal for a Change of Zone, COZ25-0008. She explained the vacation satisfies a Condition of Approval, and staff recommends approval. Commissioner Maxey moved to approve said vacation. The motion was seconded by Commissioner Ross and it carried unanimously. 3. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Chevy Truck Parts, LLC, c/o Douglas Ruppel: Adria Schiel, Assistant County Attorney, reviewed the property location, stated the property is in violation for operating an oil and gas business without a USR and additional storage of tires and geothermal equipment, She stated the Court assessed daily penalties, in the amount of $100.00, and indicated the property was last certified by the Board on March 1, 2025. While photographs were displayed by Nicole Brick, Code Compliance Officer for the Department of Planning Services, Ms. Schiel stated staff recommends certification of penalties from April 2, 2025, through November 9, 2025, with penalties amounting to $22,200.00. In response to Commissioner Peppier, Ms. Brick confirmed the property is still in violation. Douglas Rupple, property owner, was present and provided a historical timeline and context for the long-standing violations. In response to Commissioner Maxey, Ms. Brick confirmed the tire business has vacated the property but there are still tires on the property as a commercial junk yard, and the new geothermal company does use the property for storage but does not operate on the property. Maxwell Nader, Department of Planning Services, clarified that there is Code that allows for combining a USR and SPR if that is desired by the applicant, but is not common due to many uses allowed as a use by right in the 1-3 Commercial Zone District. Mr. Nader further countered previous statements made by Mr. Rupple, and stated that Diana Aungst had taken over the case, and she sent very clear communication to the property owner with the expired documents for the permit application and that he would need to re-submit a new application with updated documents. After further discussion, the Board found Mr. Rupple to be non-compliant with the Weld County Code and Commissioner Ross moved to approve said certification. The motion was seconded by Commissioner Maxey and it carried unanimously. 4. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Jacob Rettenberger and Sherry Louk: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of$50.00, that were determined by the Weld County Court. While Ms. Brick displayed photographs, Ms. Schiel stated the property is non-compliant with the Weld County Code, confirmed there has been 2025-3308 BC0016 Page 6 Monday, December 8, 2025 www.weld.gov no contact with the owners since 2023, and indicated staff recommends certification of penalties in the amount of $21,750.00. There being no property owners present, Commissioner James moved to approve said certification. The motion was seconded by Commissioner Maxey and it carried unanimously. 5. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Homar Manriquez: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of $75.00, that were determined by the Weld County Court. While Ms. Brick displayed photographs, Ms. Schiel stated the property is non-compliant, and staff recommends certification of penalties in the amount of$32,625.00. There being no property owner present, Commissioner Maxey moved to approve said certification. The motion was seconded by Commissioner Ross and it carried unanimously. 6. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Adam and Daniela Flores: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of $100.00, that were determined by the Weld County Court. While Ms. Brick displayed photographs, Ms. Schiel stated the property is non-compliant with the Weld County Code, and staff recommends certification of penalties in the amount of$41,600.00. Ms. Brick added she informed the property owners that Chapter 23 of the Weld County Code has recently changed and Mr. and Mrs. Flores submitted a permit application but there has not been a meeting set by staff to review yet. Daniela Flores indicated the trucking business that was previously on her property is no longer operating, the only vehicles left are trucks that do not currently run, and shared their intent for moving forward on the property. In response to Commissioner James, Ms. Flores indicated the accrual of daily penalties is cheaper than the rental, but further explained background information for context. After further discussion, Commissioner Maxey moved to continue said certification to June 8, 2026, at 9:00 a.m. The motion was seconded by Commissioner James and it carried unanimously. (Clerks Note: Chair Buck took a recess, with the meeting reconvening at 10:47 a.m.) 7. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Kathy Prescher: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of $10.00, that were determined by the Weld County Court. While Cynthia Villanueva, Code Compliance Officer for the Department of Planning Services, displayed photographs, Ms. Schiel stated the property is non-compliant with the Weld County Code, and staff recommends certification of penalties in the amount of $3,010.00. There being no property owner present, Commissioner Maxey moved to approve said certification. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Manuel Montez: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of $15.00, that were determined by the Weld County Court. While Ms. Villanueva displayed photographs, Ms. Schiel stated the property is non-compliant with the Weld County Code, and staff recommends certification of penalties in the amount of $6,525.00. There being no property owner present, Commissioner James moved to approve said certification. The motion was seconded by Commissioner Ross and it carried unanimously. 9. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment— Frank Cress: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of $25.00, that were determined by the Weld County Court. While Ms. Villanueva displayed photographs, Ms. Schiel stated the property is non-compliant with the Weld County Code, however, Ms. Villanueva has been contacted by the Town of Platteville who indicated they are willing to assist the property owner, Frank Cress, with roll-off dumpsters and staff requested a continuance to allow the Town and Mr. Cress further time to bring the property into compliance. Commissioner Ross moved to continue said certification to September 14, 2026, at 9:00 a.m. The motion was seconded by Commissioner James and it carried unanimously. Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
