RE: APPROVAL OF RECORDED EXEMPTION NO. 285 - AUSTIN P. STONEBRAKER
AND WILLIAM N. STONEBRAKER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 4th day of January, 1978, in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that the div-
ision into two parcels of a certain parcel of land, as shown on
the plat known as Recorded Exemption No. 285, being the property
of Austin P. Stonebraker and William N. Stonebraker, located on all
that part of the North Half of Section 12, Township 1 North,
Range 68 West of the 6th P.M. , Weld County, Colorado, and being
more particularly described as follows, to-wit:
All that part of the NW Corner of Section 12, thence
along the West line of said Section 12; S00°11'15" E
1852.23 feet; thence along an existing fence N 89°15'00"
E 3066.58 feet to the West R.O.W. line of Union Pacific
Railroad, thence along said R.O.W. N 6°15'48" E 197.43
feet to a point of curve; thence along the arc of a curve
to the right (radius of said curve being 5722.72 ft. ,
chord of said arc bears N 7°48'29" E 308.55) a distance
of 308.57 ft. ; thence leaving said R.O.W. , S 89°50'12" W
525.48 ft. to the N-S centerline of said Sec. 12; thence
N 00°33'46" W 1336.22 ft. to the N-a corner of said Sec.
12; thence S 89°27' 33" W 2597.34 ft. to the point of
beginning, containing 116.078 acres more or less.
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 20-38-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A (3) of the Weld County Subdivision
Regulations.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Austin P. Stonebraker and
William N. Stonebraker, be exempt from the definition of the terms,
"subdivision" and "subdivided land" pursuant to its authority
under Section 30-28-101 (10) (d) .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 4th day of
January, A.D. , 1978.

I have scheduled a meeting with the Weld County Planning Commission
for November 1, 1977, at 1 : 30 p.m. Said meeting will take place
in the County Commissioners Hearing Room, first floor, Weld County
