RE: APPROVAL OF VACATION OF RECORDED EXEMPTION NUMBER 243 -
GERALD D. MOSSBERG AND S. L. AND CLAUDIA BURKE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 29th day of December, 1976 , the Board of
County Commissioners of Weld County, Colorado approved the ap-
plication of Gerald D. Mossberg and S. L. and Claudia Burke for
Recorded Exemption number 243 to exempt the below described parcel
of land from the definition of "subdivision" and "subdivided land" ,
and
WHEREAS, Gerald D. Mossberg and S. L. and Claudia Burke now
desire to vacate Recorded Exemption number 243 for the reason that
the purchase and sale of said land was not completed and said
parties would like to proceed with a request for a Subdivision Ex-
emption, and
WHEREAS, the Department of Planning Services has recommended
approval of said vacation of Recorded Exemption number 243, as
subdivision of the property has not occurred. The subject property
is described as Part of the Eh of Section 24 , EZSW4 of Section 24 ,
and Part of the S'NWa of Section 24 , all in Township 4 North, Range
65 West of the 6th P.M. , Weld County, Colorado, being more particul-
arly described as follows :
A tract of land being part of the E2 Section 24, Eh SWa
Section 24 and part of the Sz NW4 Section 24. T4N, R65W,
6th P.M. , Weld County, Colorado being more particularly
described as:
Considering the east line said Section 24 to bear S.
00°00'00" W. , and all bearings relative thereto:
Beginning at the Sa Corner of said Section 24: thence
along the south line EZ SWa said Section 24 S 89°53'26" W,
1316.11 feet to the SW Corner E' SW4 said Section 24;
thence along the west line E1/2 SA said section 24 N
00°32'56" E. , 2673.73 feet to the NW Corner Ez SWa said
Section 24; thence along the south line NWQ said Section
24 S 89°55'42" W. , 304.46 feet to a point on the east
right-of-way line of the Farmers Reservoir and Irrigation
Company's Gilmore Canal; thence S 89°55'42" W, 101.96 feet
to the west right-of-way line of the said Gilmore Canal;
thence, S 89°55'42" W. , 300.00 feet along the south line
NWT said Section 24; thence,
N 00°04'18" W, 303.43 feet; thence,
N 89°55'42" E, 417.80 feet to a point on the west line of
the said Gilmore Canal; thence along the west right-of-
way line of the said Gilmore Canal S 21°08'44" W, 325.49
feet to a point on the south line NA said Section 24;

way line of said Gilmore Canal; thence
N 21°08'44" E, 53.64 feet along the right-of-way of the
Gilmore Canal; thence,
N 89°55'42" E, 744.52 feet to a point on a curve to the
right which has a central angles£ 35°44'14" and a radius
of 1619.00 feet and the chord of which bears N 58°54'45" E,
993.54 feet to a point on the east line SEa NW4 said Section
24; thence along the west line NE4 said Section 24N 00°21'00" E
1401.84 feet; thence,
S 89°50'04" E. , 417.00 feet; thence
N 00°21'00" E . , 718.00 feet to a point on the north line NEa
said Section 24; thence,
S 89°50'04" E. , 2182.52 feet to the NE Corner of said Section
24; thence,
S. 00°00'00" W. , 4021.94 feet along the east line said Section
24; thence,
S 89°53'26" W. , 660.00 feet; thence,
S. 00°00'00" W. , 1320.00 feet to a point on the south line SE4
said Section 24; thence,
S 89°53'26" W. , 1972.22 feet to the point of beginning.
The above described tract contains 370.01 acres, more or less
excluding rights-of-way reserved for County Road purposes
along the northerly, easterly and southerly side of said tract
and excluding that portion (7.85 acres, more or less) of that
land held by Warranty Deed by the Farmers Reservoir and
Irrigation Company, recorded in Book 314, Page 371, Weld County
Records.
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado that it would be in the best
interest of Weld County to grant said vacation of Recorded Exemption
number 243 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the vacation of Recorded
Exemption number 243, be and hereby is, granted.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 17th day of
April, A.D. , 1978.

RE: Vacation of RE-243
Dear Commissioners :
The attached plat and related items are in reference to a request
by Albert Johnston representing Gerald D. Mossberg and Mr. & Mrs.
S. L. Burke, to vacate Recorded Exemption #243 . The subject pro-
perty is described as Pt . EZ Section 24, EaSW4 Section 24 , and
Pt . SNW* Section 24 , all in T4N, R65W of the 6th P.M. , Weld
County , Colorado. This property is located 5 miles southeast of
LaSalle . This vacation is necessary in order for the property
owners to proceed with their request for a Subdivision Exemption .
Based upon the information submitted, the Department of Planning
Services Staff recommends approval for this requested vacation,
since subdivision of this property has not occurred. This request
if approved, would appear to have no adverse effects on the sur-
rounding agricultural uses, surrounding property owners, or the

Dear Mr. Honn:
Due to the fact that a recorded exemption on land in the E% of
Section 24, Township 4 North, Range 65 West of the 6th P.M.
was applied for, approved, and recorded, and the purchase and
sale of said land was not completed, we request that the above
recorded exemption be vacated.
We are enclosing a plat for approval of vacation of recorded
exemption on said property.

scheduled a meeting with the Board of County Commis-
sioners for April 17, 1978, at approximately 9: 30 a.m.
This meeting will take place in the County Commissioners
Hearing Room, First Floor, Weld County Centennial Center,
915 - 10th Street , Greeley, Colorado . It is recommended
