RE: APPROVAL OF LOT SIZE VARIANCE NO. 58 - MARJORIE L. HATCHER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 27th day of March, 1978 , in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Marjorie L.
Hatcher, which land is more particularly described as follows:
The West 1 of the NWT of the NWT of Section 9,
Township 1 North, Range 68 West of the 6th P.M. ,
Weld County, Colorado;
WHEREAS, the owner of said tract of land desires to obtain
a variance from the minimum lot size requirement so that said
applicant may make application to the Board of County Com-
missioners for a recorded exemption, as set forth in Section 9-4A.
(6) of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services, feels that the applicant has shown good cause
for granting a lot size variance under Section 9-4.A. (6) of the
Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot
size requirements , be, and hereby is, granted to Marjorie L.
Hatcher for the above-described parcel of land.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
March, A.D. , 1978 .

Dear Commissioners :
The ,attached letter and related materials are in reference to a request by
Marjorie L. Hatcher for a lot size variance. The property is described as
WNW*NW4 Section 9, T1N, R68W of the 6th P.M. , Weld County, Colorado . This
property is located 12 miles east and 12 miles north of Erie. The property
in question contains approximately 20 acres of Class II irrigated soils.
The request is to obtain a variance from the minimum lot size requirement ,
Section 9-4 A. (6) so that she may make application to apply for a recorded
exemption. Section 9-4 A. (6) of the Weld County Subdivision Regulations
states :
"That the original tract or parcel of land to be divided under
this section meets the minimum lot size requirement estab-
lished by the Weld County Zoning Resolution; variance from
this requirement being allowed only upon good cause being
shown to the Board of County Commissioners or where said
tract or parcel of land lies within the Comprehensive Plan
area of an existing incorporated town of Weld County. "
If this lot size variance is granted, Marjorie Hatcher will proceed with her
application for a recorded exemption to divide the property into two parcels.
One parcel is proposed to contain approximately 5 acres which has an existing
set of improvements on it . The second parcel of approximately 15 acres would
become eligible as a residential building site .
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends this request be approved
for the following reasons :
1 . The request is in compliance with the intent clause of the Recorded Exemp-
tion Procedure (Section 9-2 of the Weld County Subdivision Regulations)
in that the proposed use of the property would be compatible with the
surrounding agricultural land uses.
2. The Town of Erie has indicated that they have no opposition to the re-
quest .

3. The request , as proposed, has low utility for agricultural uses due to
the size of the proposed parcels.
4. The request complies with Section 9-4 A. (6) of the Weld County Subdi-
vision Regulations.

a party who would like to purchase the South 5 acres and all

available on the property located on the Wzj NW4, NW4, of

when the water main will be completed. This line is now,
under construction and should be in service in April, 1978.
The membership will require the then current membership
price, and all Company policies and requirements will have to
be met.
